WhethertheCoExecutorshostilitytoward P LauraEmilyBlessingWard,thedaughterandonlychildofCarltonA.Blessing,deceased,whichhostilitywasevidencedbytheirunfairtreatmentofMs.WardinthecourseoftheadministrationofMr.Blessingsestate,requiredtheremovaloftheCoExecutors. ` 2. WhethertheTrialCourtproperlyexcluded *!+ evidenceoftheconversionofcertainofCarltonA.BlessingsassetsbyJohnO.Blessing,oneoftheCoExecutors,priortoMr.Blessingsdeath,whichconversionwasnotobjectedtobytheotherCoExecutor,andwhichconversionandlackofobjectionshowedthattheCoExecutorswereeitherignorantorcontemptuousoftheresponsibilitiesofafiduciaryandsowereincapableoffulfillingtheirfiduciarydutiesasCoExecutors.̛̜   ` ThestandardofreviewastodismissalofanonjurycaseattheconclusionoftheplaintiffsproofissetoutinthecaseofCityofColumbiav.C.F.W.Const.Co.,557S.W.2d734 6P-: (Tenn.1977),whereintheSupremeCourtstatedthefollowing(atpage740): 9p0> ЇӜ ` ThemotionauthorizedbythisruleisnottobeconfusedwithamotionfordirectedverdictwhichisauthorizedbyRule50,TennesseeRulesofCivilProcedure.Motionsforadirectedverdictareneithernecessarynorproperinacasewhichisbeingtriedwithoutajury.Motionsfordismissalinnon-jurycasesunderRule41.02(2),TennesseeRulesofCivilProcedure,andmotionsfordirectedverdictsinjurycasesunderRule50,TennesseeRulesofCivilProcedure,aresomewhatsimilar,but,thereisafundamentaldifferencebetweenthetwomotions,inthat,inthejurycase,thejudgeisnotthetrieroffactswhileinthenon-jurycaseheisthetrierofthefacts.Inthejurycasehemustconsidertheevidencemostfavorablyfortheplaintiff,allowallreasonableinferencesinplaintiff'sfavoranddisregardallcounteractingevidence,and,soconsidered,ifthereisanymaterialevidencetosupportaverdictforplaintiff,hemustdenythemotion.Butinthenon-jurycase,whenamotiontodismissismadeatthecloseofplaintiff'scaseunderRule41.02(2),thetrialjudgemustimpartiallyweighandevaluatetheevidenceinthesamemannerasthoughheweremakingfindingsoffactattheconclusionofalloftheevidenceforbothparties,determinethefactsofthecase,applythelawtothosefacts,and,iftheplaintiff'scasehasnotbeenmadeoutbyapreponderanceoftheevidence,ajudgmentmayberenderedagainsttheplaintiffonthemerits,or,thetrialjudge,inhisdiscretion,maydeclinetorenderjudgmentuntilthecloseofalltheevidence.Theactionshouldbedismissedifonthefactsfoundandtheapplicablelawtheplaintiffhasshownnorighttorelief.   ` Astothefirstissue,wedeemitappropriatetoaffirmtheTrialCourtundertheauthorityofRule10(a)ofthisCourt. 09/3 Ї   ` Astotheothertwoissues,theTrialCourtwasoftheopinionthatonlymisdeedsonthepartofthepersonalrepresentativeswhichoccurredaftertheirqualificationsassuchwouldbecompetenttoshowthattheyshouldberemoved,andexcludedanyevidenceofpriormisconduct.WeareinclinedtobelievethattheTrialCourtwascorrectinthisdetermination.   ` Moreover,eveniftheexcludedevidence,whichwaspreservedbyanofferofproof,hadbeenadmitted,itwas,inourview,insufficienttowarrantremoval.ThemostseriouscomplaintwasthatMr.Blessing,operatingunderapowerofattorneyfromthedeceased,hadtheBeneficiaryina$5000lifeinsurancepolicychangedfromhimselfandfiveotherindividuals,includingMs.Ward,tohimselfalone.Theundisputedproofshows,however,thatthechangesweremadeinaccordancewiththewishesofthedeceased.WealsonotethatattrialMr.Blessing,throughcounsel,offeredtopaytoMs.Wardonesixthoftheproceedsofthepolicy,whichisallshewouldhavereceivedhadnochangeofbeneficiaryoccurred.   ` FortheforegoingreasonsthejudgmentoftheTrialCourtisaffirmedandthecauseremandedforsuchfurtherproceedings,ifany,asmaybenecessary,andcollectionofcostsbelow.CostsofappealareadjudgedagainstMs.Wardandhersurety.  @8.2      `     h   _______________________________   `     h   HoustonM.Goddard,P.J.CONCUR:________________________________HerschelP.Franks,J.________________________________CharlesD.Susano,Jr.,J.   `
