DemetreousFlengas,thehusband,andKimberlyDeniseFlengas,thewife,weregrantedanabsolutedivorceinSeptember1994inHamiltonCounty.Shortlythereafter,theTrialCourtentereditsmemorandumopinionandorderwhichdirectedthedivisionoftheparties'assetsandliabilities.Itisfromthisorderthatthehusbandappeals.  ThepartiesweremarriedonAugust5,1989.Theyhavenochildrentogether,butthehusband'sdaughterfromapreviousmarriagelivedwiththepartiesuntilshortlybeforetheparties'separation.ThehusbandfiledhiscomplaintfordivorceinFebruaryof1994.Thewifeaskedthatthecomplaintbedismissedandshethenfiledacounterclaimseekingdivorce.  AnonjurytrialwasheldonJuly18and19,1994.AnorderofabsolutedivorcewasenteredonSeptember9,1994.InAprilof1995,asalreadynoted,theTrialCourtissueditsmemorandumorderthatdirectedthedivisionofassetsandliabilities.Thepartiesownedvariousassets,includinganumberofautomobiles.Thisappeal,however,isconcernedwithonlyoneasset:themaritalhome.  In1980,priortotheparties'marriage,thehusbandpurchasedahouseinSignalMountain,Tennesseefor$55,000.Thetitletothehouseisinthehusband'snameonlyandisseparatepropertyofthehusband.However,theTrialCourtorderedthatwhilethewifeisnotentitledtoanyshareinthehusband'sseparateproperty,sheisentitledtoshareintheappreciationofsuchpropertysincethemarriage.TheTrialCourtnotedthat"[a]lthoughtherewasnoevidenceintroducedregardingtheactualincreaseinvalueoftheresidencesincethemarriage,itisclearthatmostoftheimprovements,whichweresubstantial,weremadebythepartiesfollowingthemarriage."Therefore,theTrialCourtorderedthatthehousebesoldandthat"thenetproceedsfromthesale,afterthedeductionofthebalanceowedonthemortgages,theheatingandairconditioningsystem,realestatesalesfees,closingcosts,andanyunpaidpropertytaxes,"bedividedbetweenthepartiessothatthehusbandwouldreceive75percentandthewife25percent.  Thehusbandpresentstheseissueforappeal:    I. Whetheratrialcourtmayawardaninterestinaspouse'sseparatepropertytotheotherspousedespitenoevidencethattheseparatepropertyincreasedinvalue.II. Whetheratrialcourtmayadmitalayopinionregardingvaluebyawitnesswhoisnotanexpertanddoesnotowntheproperty.      Thereisnoquestionthatthemaritalhomeisseparatepropertybelongingtothehusband.However,T.C.A.364121(b)(1)(B)providesthat"anyincreaseinvalueduringthemarriage,ofpropertydeterminedtobeseparateproperty"ismaritalpropertysolongaseachpartytothemarriage"substantiallycontributedtoitspreservationandappreciation."SeealsoEllisv.Ellis,748S.W.2d424(Tenn.1988).TheCodedefinessubstantialcontributionas"thedirectorindirectcontributionofaspouseashomemaker,wageearner,parentorfamilyfinancialmanager,togetherwithsuchotherfactorsasthecourthavingjurisdictionthereofmaydetermine."T.C.A.364121(b)(1)(C).  Inthecasebeforeus,thereisevidencethatthepartiesmadeseveralimprovementstothemaritalhomeandadjoiningproperty.Amongtheimprovementswere:addingagarage,addingacovereddeck,addingawoodstoragebuilding,enclosingapatio,installingcentralheatandair,fencinginaportionoftheproperty,installinganupperdrivewayandvariousotherimprovements.Theseimprovementsweredonebythepartiesthemselves,byworkersthepartiestradedwithorbyindividualswhowerepaidfortheirwork.ThehusbanddoesnotcontesttheTrialCourt'sfindingthatthewifesubstantiallycontributedtotheinstallationoftheimprovements.  Thehusbandinsteadinsiststhatbecausethewifefailedtoproduceanyactualevidenceofanincreaseintheproperty'svaluesheisnotentitledtoaninterestintheproperty.Determiningthevalueofsuchpropertyisafactquestionandthus,thetrialcourt'sdeterminationmustbegivengreatweightonappeal.Wallacev.Wallace,733S.W.2d102(Tenn.App.1987).TheTrialCourt'sdecisionwithregardtovaluationofmaritalpropertywillbepresumedtobecorrectunlesstheevidencepreponderatesotherwise.Wallace,supra.  Thedifficultyhereisthatthereisnoactualevidenceregardingthevalueofthehusband'sequityinthepropertyatthetimeofthemarriage.Attrial,thehusbandtestifiedthatthepropertywasworth$80,000whilethewifetestifiedthatthepropertywasworth$175,000.Alsointroducedintoevidencewasthefactthatpriortotheinstallationoftheheatingandcoolingsystemthepartieshadinsuredthepropertyfor$137,000.Atthetimeofthetrial,thepropertywasencumberedbyafirstmortgageof$25,500,asecondmortgageof$20,000andalienof$5,800fortheheatingandcoolingsystem.  Itistrue,asinsistedbythehusband,thatourcaseshaveheldthattheburdentoproveanincreaseinthepropertyvaluefallsupontheonewhoclaimsaninterestintheincrease.Brysonv.Bryson,anunpublishedopinionofthisCourtfiledinNashvilleonAugust26,1988;Cutsingerv.Cutsinger,anunpublishedopinionofthisCourtfiledinNashvilleonOctober4,1995.However,inthecaseatbarthereisnoquestionthatsubstantialimprovementsweremadetothepropertyduringthemarriage;indeed,thehusbandconcedesthatthisistrue.Inlightofthiswearedisinclinedtostrictlyapplytherulehereinbeforesetout,butinsteadbelievethisisanappropriatecaseforremandundertheprovisionsofT.C.A.273128, j   ׀aswasemployedinHazardv.Hazard,833S.W.2d911(Tenn.App.1991).  Therefore,intheinterestofjusticetobothparties,thiscaseisremandedtotheTrialCourttoreceiveevidenceandtodeterminethenetvalue(afterdeductionofanyencumbrances)ofthepropertyatthetimeofthemarriage.Theamountsofoundistheseparatepropertyofthehusbandandwillbesetasidetohimoutofthenetproceedsfromthesale.Thebalanceofthenetproceeds,havingbeenfoundbytheTrialCourttobemaritalproperty,willbedividedbetweenthepartiesinsuchproportionsastheTrialCourtfindsjustuponconsiderationofthefactorssetforthinT.C.A.364121(c).  Inviewofourresolutionofthefirstissue,itisnotnecessarytoaddressthesecond.
