'MemorandumOpinion 'X     Thisextraordinaryappealarisesoutofanorderenjoiningaprivateschoolfromexpellingoneofitsstudentsaccusedofsmokingmarijuana.ϜWefirstfindthatthisisanappropriatecaseforanextraordinaryappealpursuanttoTenn.R.App.P.10.Sincetheschoolsapplicationandthestudentsanswerfullysetforththepartiespositionsandthematerialfacts,wedispensewithfurtherbriefingandoralargumentandproceedtothemeritsoftheappealinordertosavethepartiesadditionaltimeandexpense. /   כBecausecourtsshouldnotinterfereintheinternalaffairsofprivate,voluntaryorganizationsunlessthereisashowingthattheorganizationsprocedureshavenotbeenfollowedorthattheorganizationhasotherwiseactedinanarbitrary,oppressiveorunlawfulmanner,wehavedeterminedthatthetrialcourtsorderenjoiningtheschoolfromexpellingthestudentuntilaftertheconclusionofthefinalexaminationsshouldbereversedandthecaseremandedtothetrialcourtforfurtherproceedingsinaccordancewithTenn.Ct.App.R.10(b). 0      I.     Duringthe199697academicyear,NicoFlowerswasasophomoreatMetropolitanBaptistSchools( Metropolitan),aprivateeducationalinstitutionoperatedbytheMetropolitanBaptistChurchinMadison.Therulesandregulationscontainedintheschoolsstudenthandbookmandateexpulsionofanystudentusingdrugs.Theschoolsreenrollmentform,signedbyMr.Flowerslegalguardians,provides:Theteachersandadministrationareherebygivenfulldiscretioninthedisciplineofourchildorchildren,thiswouldinclude...expulsionfromtheschool.̛̜  OnMay2,1997,twostudentsatMetropolitantoldtheschooladministrator,GrantEndicott,thatMr.FlowershadadmittedsmokingmarijuanapriortoattendingtheschoolsApril11,1997springconcert.Twoadditionalstudentslaterconfirmedtheadmission.ThreeofthesestudentsstatedthattheyalsoobservedMr.Flowersacting funnyandthattheysmelledmarijuanaonhisbreathandclothes.Whiledenyingthatheactuallysmokedmarijuana,Mr.FlowersadmittedtoMr.Endicottthathetoldtheotherstudentsthathehaddoneso.Basedonthesefacts,Mr.EndicottdeterminedthatMr.Flowershadviolatedtheschoolspolicyprohibitingtheuseofdrugsandexpelledhim.̛̜  OnMay8,1997,Mr.FlowersfiledacomplaintfortemporaryandpermanentinjunctivereliefintheChanceryCourtforDavidsonCounty.OnMay19,1997,thetrialcourtenjoinedMetropolitanfrompreventingMr.Flowersfromattendingschooluntilaftertheconclusionofthefinalexaminationsforthecurrentsemester.Thereafter,theexpulsionwouldbereinstated.̜  OnMay16,1997,MetropolitanfiledaTenn.R.App.P.10applicationforanextraordinaryappealseekingreviewoftheinjunction.MetropolitanalsosoughtastayoftheorderpursuanttoTenn.R.App.P.7.OnMay21,1997,thiscourtorderedMr.Flowerstofileananswertotheapplication.Metropolitansubsequentlysupplementeditsapplicationwithcertifiedcopiesofthetrialcourtsorderand,onMay23,1997,thiscourtstayedenforcementofthetrialcourtsinjunctionpendingdispositionoftheTenn.R.App.P.10application.Mr.Flowershasnowfiledananswertotheapplication.̜   II .    ThesoleissueinthisappealiswhetherthetrialcourtproperlyenjoinedtheexpulsionofMr.FlowerspursuanttoTenn.R.Civ.P.65.04.̛  Tenn.R.Civ.P.65.04(2)provides: 0   0   ӜAtemporaryinjunctionmaybegrantedduringthependencyofanactionifitisclearlyshownbyverifiedcomplaint,affidavitorotherevidencethatthemovantsrightsarebeingorwillbeviolatedbyanadversepartyandthemovantwillsufferimmediateandirreparableinjury,lossordamagependingafinaljudgmentintheaction,orthattheactsoromissionsoftheadversepartywilltendtorendersuchfinaljudgmentineffectual.         Havingreviewedtherecord,weconcludethatMr.Flowershasnotshownthatanyofhisrightshavebeenorwillbeviolatedbyhisexpulsion.Attendanceataprivate,religiouseducationalinstitutionisaprivilege,notaright.See,Tenn.SecondarySch.AthleticAssnv.Cox,425S.W.2d597,602(Tenn.1968).Moreover,theschoolhasnotbreachedanyexplicitcontractualobligationtoMr.Flowers.  Metropolitansrules,agreedtobyMr.Flowerslegalguardianswhenheenrolled,leavedisciplinaryandexpulsiondecisionstothesolediscretionoftheschooladministration.WhileMr.FlowersadmitsthathiscontractwithMetropolitangrantedtheschoolwidediscretionindisciplininghim,heassertsthataninjunctionisappropriateunderTenn.R.Civ.P.65.04becauseoftheoppressiveandarbitrarywayinwhichtheschoolexerciseditsdiscretion.Thustheonlyissuetobedecidediswhetherthecourtmayreviewthediscretionarydecisionoftheschoolsadministrator.  Thecourtswillgenerallynotinterferewiththeinternalaffairsofprivate,voluntaryassociations.OriginalLawrenceCountyFarmOrganization,Inc.v.Tenn.FarmBureauFederation,907S.W.2d419,421(Tenn.Ct.App.1995);Moranv.Vincent,588S.W.2d867,870(Tenn.Ct.App.1979).Courtsmayinterveneonlywheretheassociationsprocedureshavenotbeenfollowedorwheretheassociationotherwiseactsinanarbitrary,oppressiveorunlawfulmanner.Cokev.UnitedTransportationUnion,552S.W.2d402,405(Tenn.Ct.App.1977).̜  WecannotsaythattheschoolsdecisiontoexpelMr.Flowerswasarbitrary,oppressiveorunlawful.MetropolitansdecisionwasbasedontheaccusationsoffourstudentswhostatedthatMr.Flowerstoldthemhehadsmokedmarijuanaonanumberofoccasions.ThreeofthesestudentsobservedactionsbyMr.Flowersconsistentwithmarijuanauseandalsosmelledmarijuanaonhisbreathandclothing.Inlightofthesefactsandthebroaddiscretiongrantedtheschoolsadministrationinthestudenthandbookandenrollmentform,thecourtfindsnobasisonwhichtosecondguesstheschoolsdecision.̜   III.
