ðwifeðð),Ïapproximately€89%€of€the€marital€property.€€For€reasons€stated€hereinafter,€we€affirmÏthe€judgment€of€the€trial€court.ÌÌà àHusband€and€wife€were€married€on€May€23,€1958.€€œAt›€the€time€of€trial,€theÏparties€had€been€married€thirty„seven€years.€€œThe›€parties€have€five€grown€children.€ÏœWife›€testified€that€she€is€disabled€and€receives€a€disability€check€from€social€security€inÏthe€amount€of€$606€per€month.€€œIn›€addition€to€this€check,€wifeððs€only€other€source€ofÏincome€is€the€$240€per€month€œshe›€receives€from€sitting€with€an€elderly€woman.€ÌÌà àHusband€works€for€Miller€and€Company€a€manufacturer€of€plain€and€quarterÏsawn€hardwoods.€€œIn›€1996,€he€earned€$13,175.68.€€œThereafter,›€from€January€1,€1997Ïuntil€May€1,€1997,€€he€earned€$6,243.87.€€€ÌÌà àWife€testified€that€on€June€23,€1995,€while€she€was€inside€the€house,€œhusband›Ïœtook›€his€gun€into€the€his€yard€and€fired€off€several€rounds.€€œWife›€contends€that€whenÏhusband€returned€œto›€the€house,€he€threatened€to€ð ðknock€her€brains€out.ðð€€œWife›€statesÏthat€instead€of€hitting€her€in€the€head,€husband€missed€and€hit€her€in€the€shoulder.€€ÏœHusband›€œran›€out€of€the€œhouse€whereupon›€wife€called€the€police.€€œOfficers›€Jerry€ElstonÏand€Mickey€Sadler€were€dispatched€to€the€scene€at€approximately€10:15€p.m.€to€10:30Ïp.m.€that€same€evening.€€When€they€arrived€at€the€scene,€Officer€Elston€found€husbandÏsitting€on€the€front€porch€at€his€œneighborððs›€house.€€œAs›€husband€stood€up€and€walkedÏtoward€the€police€car,€Officer€Elston€noticed€that€husband€had€a€pistol€protruding€fromÏthe€front€pocket€of€his€jeans.€€œOfficer›€Elston€instructed€defendant€to€ð ðput€his€hands€up.ðð€ÏœHusband›€proceeded€to€œraise›€his€hand€up€and€œdown.›€€œOfficer›€Elston€testified€that€thisÏcontinued€for€twenty€to€thirty€seconds€at€which€time€husband€withdrew€the€pistol€fromÏhis€jeansðð€pocket.€€œAs›€the€gun€was€coming€up€toward€Officer€Elston,€Officer€Elston€drewÏhis€œpistol›€and€shot€husband.€ÌÌà àWife€contends€that€prior€to€this€time,€husband€had€been€physically€abusive€toÏher.€€œSpecifically,›€she€testified€that€the€abuse€stretched€back€as€far€as€1980.€€œWife›Ïfurther€contends€that€husband€complained€about€her€œhousekeeping,›€but€insists€that€heÏnever€assisted€her.€€œA›€particular€problem€that€wife€testified€about€was€husbandððsÏdrinking€problem.€€œShe›€states€that€his€drinking€problem€had€progressively€worsenedÏover€the€years€of€the€deteriorating€marriage.€€œShe›€further€contends€that€he€has€madeÏno€payments€on€the€partiesðð€marital€debts,€including€the€mortgage€and€upkeep€on€theÏmarital€home.€€ÌÌà àOn€the€other€hand,€œhusband›€œcontends€not€only›€that€he€never€abused€wife€butÏalso€that€wife€and€he€have€not€had€an€argument€in€ten€years.€€œHusband›€states€that€heÏdoes€not€know€how€this€whole€situation€came€up.€ÌÌà àWife€filed€a€complaint€for€divorce€on€December€28,€1995.€€œThe›€trial€court€issuedÏa€restraining€order€and€an€òòex€parteóó€order€of€protection€œthat›€same€day.€€œOn€January›€5,Ï1996,€after€a€hearing€on€these€matters,€the€trial€court€issued€an€order€of€protection€andÏa€temporary€injunction.€€œThereafter›€on€January€17,€1996,€husband€filed€an€answer€toÏwifeððs€complaint€including€a€counterclaim€for€divorce€and€a€restraining€orderÏprohibiting€her€from€disposing€of€the€partiesðð€assets.€€œThe›€trial€on€this€matter€was€heardÏon€May€5,€1997,€whereupon€the€trial€court€took€the€matter€under€advisement€andÏissued€its€findings€on€May€12,€1997.€€œOn›€July€11,€1997,€an€order€was€entered€whichÏgranted€wife€a€divorce€from€husband€on€the€grounds€of€inappropriate€marital€conduct.€ÏThe€trial€court€divided€the€marital€property€as€follows:ÌÓÓœ›à8 à2.€€Whether€the€final€order€for€absolute€divorce€hasÏcontradictory€provisions€regarding€the€award€of€the€realÏproperty.ÌÌà8 àà8 à3.€€Whether€the€court€erred€in€denying€the€husbandððsÏrequest€to€reimburse€appellant€for€assets€disposed€of€priorÏto€trial.ÌÓ  ÓÓÓœÌÓ  Ó›à àInasmuch€as€this€case€was€tried€by€the€trial€court€sitting€without€a€jury,€thisÏCourtððs€review€on€appeal€is€governed€by€Tennessee€Rule€of€Appellate€ProcedureÏ13(d),€which€directs€us€to€review€the€case€òòde€novoóó.€€òòRoberts€v.€Robertson€County€Bd.€ofÏEduc.óó,€692€S.W.2d€863,€865€(Tenn.€Ct.€App.€1985);€òòHaverlah€v.€Memphis€œAviation,€›Inc.óó,Ï674€S.W.2d€297,€300€(Tenn.€Ct.€App.€1984);€Tenn.€R.€App.€P.€13(d).€€In€conducting€a€òòdeÏnovoóó€review€of€the€record€below,€however,€this€Court€must€presume€that€the€trialÏcourtððs€findings€of€fact€are€correct.€€Under€this€standard€of€review,€we€must€affirm€theÏtrial€courtððs€decision€unless€the€trial€court€committed€an€error€of€law€affecting€the€resultÏor€unless€the€evidence€preponderates€against€the€trial€courtððs€findings.€€òòRobertsóó,€692ÏS.W.2d€at€865.ÌÓÓÌà àÌÓ  ÓÓÓò òà àWhether€the€trial€court€erred€in€the€division€of€maritalÏproperty.ó óÓ  Óà àIt€is€well€settled€in€this€state€that€there€is€a€presumption€that€maritalÏproperty€is€owned€equally.€€òòSee€Salisbury€v.€Salisburyóó,€657€S.W.2d€761€(œTenn.€Ct.ÍApp.€›1983).€€In€this€case€all€property€is€marital€property€and€is€presumed€to€be€equallyÏowned.€€Under€such€circumstances€it€is€the€duty€of€the€courts€to€make€suchÏadjustments€as€may€be€necessary€to€reach€an€equitable€division€of€the€property,€takingÏinto€consideration€the€factors€established€in€Tenn.€Code€Ann.€ðð€36„4„121(c),€which€ourÏGeneral€Assembly€has€provided€for€guidance.€€ÓÓTenn.€Code€Ann.€ðð€œ36„4„121(c)›Ïprovides:ÌÌà8 àœ(c)›€In€making€equitable€division€of€marital€property,€the€court€shallÏconsider€all€relevant€factors€including:ÌÌà8 àà8 à(1)€The€duration€of€the€marriage;Ìà8 àà8 àÌà8 àà8 à(2)€The€age,€physical€and€mental€health,€vocational€skills,Ïemployability,€earning€capacity,€estate,€financial€liabilitiesÏand€financial€needs€of€each€of€the€parties;ÌÌà8 àà8 à(3)€The€tangible€or€intangible€contribution€by€one€(1)€partyÏto€the€education,€training€or€increased€earning€power€of€theÏother€party;ÌÌà8 àà8 à(4)€The€relative€ability€of€each€party€for€future€acquisitions€ofÏcapital€assets€and€income;ÌÌà8 àà8 à(10)€Such€other€factors€as€are€necessary€to€consider€theÍequities€between€the€parties.ÌÌÓÓÌà àAll€the€factors€enumerated€above€do€not€apply€in€each€case.€€œFor€instance,€in›Ïthis€œcase,›€the€existence€of€separate€property€is€œminimal,›€and€neither€party€at€the€time€ofÏthe€marriage€had€an€estate.€ÌÌà àTrial€courts€have€wide€latitude€in€fashioning€an€equitable€division€of€maritalÏproperty.€€òòFisher€v.€Fisheróó,€648€S.W.2d€244,€246€(Tenn.€1983).€€Their€decisions€mustÏbe€guided€by€the€factors€in€Tenn.€Code€Ann.€ðð€36„4„121(c),€òòEllis€v.€Ellisóó,€748€S.W.2dÏ424,€427€(Tenn.€1988),€and€must€be€made€without€regard€to€marital€fault.€€Tenn.€CodeÏAnn.€ðð€36„4„121(a)(1);€€€òòBowman€v.€Bowmanóó,€836€S.W.2d€563,€567„68€(Tenn.€Ct.€App.Ï1991).€€The€decision€is€not€a€mechanical€one€and€is€not€rendered€inequitable€becauseÏit€is€not€precisely€equal,€òòBatson€v.€Batsonóó,€769€S.W.2d€at€859,€or€because€both€partiesÏdid€not€receive€a€share€of€each€piece€of€property.€€òòThompson€v.€Thompsonóó,€797ÏS.W.2d€599,€604€(Tenn.€Ct.€App.€1990).€€Appellate€courts€defer€to€the€trial€courts€inÏthese€matters€unless€their€decisions€are€inconsistent€with€the€factors€in€Tenn.€CodeÏAnn.€ðð€œ36„4„121(c)›€or€are€not€supported€by€the€preponderance€of€the€evidence.€ÏòòBarnhill€v.€Barnhillóó,€826€S.W.2d€443,€449„50€(Tenn.€Ct.€App.€1991).ÌÌà àWhile€the€courts€must€include€all€of€the€parties'€marital€property€in€the€maritalÏestate,€they€are€not€required€to€award€both€parties€an€interest€in€each€piece€of€maritalÏproperty.€€Tenn.€Code€€Ann.€ðððð€36„4„121(a)€and€36„4„121(f)(1)€permit€trial€courts€toÏdivest€and€reinvest€title€to€property€and€to€make€distributive€awards€in€order€to€achieveÍequity.€€€Thus,€unless€the€facts€require€otherwise,€the€courts€generally€judge€theÏfairness€of€a€property€division€by€its€final€results.ÌÌ€à àœWhen›€considering€the€relevant€factors€listed€in€Tenn.€Code€Ann.€ðð€36„4„121(c),Ïwe€agree€with€the€judgment€of€the€trial€court.€€As€of€the€date€the€decree€of€divorce€wasÏissued€by€the€trial€court,€the€duration€of€the€marriage€had€been€approximately€37Ïyears.€€ÌÌà àPresently,€wife€is€disabled€and,€consequently,€has€a€very€limited€means€ofÏsupport.€€Specifically,€wife€draws€$606€per€month€from€her€disability€check€andÏanother€$240€per€month€from€sitting€with€an€elderly€woman.€€Husband,€on€the€otherÏhand,€is€not€disabled€and€is,€in€fact,€gainfully€employed€with€a€lumber€company.€€HeÏdraws€a€wage€of€$5.25€per€hour€and€works€full€time.€€Together€with€€bonuses€and€profitÏsharing,€husband€earned€$6,243.87€in€the€first€four€months€of€1997.€€œThis›€evincesÏdefendantððs€ability€to€acquire€income€and€capital€assets€in€the€future.€€Wifeððs€ability€toÏdo€so€is€very€limited.€€ÌÌà àAs€œnoted›€above,€Tenn.€Code€Ann.€ðð€36„4„121(c)(1),€(2),€(4),€and€(8)€are€theÏfactors€that€œshould›€be€given€the€most€weight€in€making€a€division€of€property€in€thisÏcase.€€We€believe€these€subsections€weigh€more€heavily€in€favor€of€the€wife.€ÏAccordingly,€we€affirm€the€trial€courtððs€distribution€of€the€partiesðð€marital€property.€€€ÌÌÓ  ÓÓÓò òWhether€the€court€erred€in€denying€the€husbandððs€request€Ìto€reimburse€appellant€for€assets€disposed€of€prior€to€trial.ó óÌÌÓ  ÓÓÓà àHusband€contends€that€the€trial€court€erred€in€failing€to€award€him€one„half€ofÏ$1,500€received€in€October€of€1995,€for€the€sale€of€œcertain€real›€œproperty›€and€a€mobileÏhome€on€Reeves€Road.€€This€sale€occurred€after€Husband€had€left€the€marital€homeÏand€before€the€filing€of€the€Complaint€on€December€28,€1995.€€Husband€contends€thatÏthis€is€marital€property,€and,€as€such,€the€monies€collected€from€the€sale€of€suchÏproperty€should€be€divided€equally€between€wife€and€himself.€€We€disagree.ÌÌà àTenn.€Code€Ann.€ðð€36„4„121(b)(1)(A)€defines€ð ðmarital€propertyðð€as€follows:ÌÓÓà8 àà8 à(1)(A)€"Marital€property"€means€all€real€and€personalÏproperty,€both€tangible€and€intangible,€acquired€by€either€orÏboth€spouses€during€the€course€of€the€marriage€up€to€theÏdate€of€the€final€divorce€hearing€and€owned€by€either€orÏboth€spouses€as€of€the€date€of€filing€of€a€complaint€forÏdivorce,€except€in€the€case€of€fraudulent€conveyance€inÏanticipation€of€filing,€and€including€any€property€to€which€aÏright€was€acquired€up€to€the€date€of€the€final€divorceÏhearing,€and€valued€as€of€a€date€as€near€as€reasonablyÏpossible€to€the€final€divorce€hearing€date.Ìà àÌÓÓÌà à€After€a€careful€review€of€the€record,€we€find€that€the€property€and€mobile€homeÏon€Reeves€Road€was€not€marital€property€and,€therefore,€not€subject€to€distribution€byÏthe€trial€court.€€The€fact€of€the€matter€is€that€œhusband›€and€œwife›€conveyed€this€property€toÏtheir€three€daughters€on€July€19,€1979,€by€warranty€deed.€€As€such,€husband€and€wifeÏwere€no€longer€owners€of€this€property.€€Subsequently,€on€October€9,€1995,€the€threeÏdaughters€sold€the€land€to€Larry€Robinson€for€$1,500.€€The€fact€that€wifeððs€daughtersÏdecided€to€give€the€money€to€their€mother€is€of€no€consequence€œin›€this€matter.€€TheÍœmoney›€collected€from€the€sale€of€œthe›€property€was€not€marital€property.€€Accordingly,Ïwe€affirm€the€judgment€of€the€trial€court€refusing€to€distribute€the€œsaid€monies.›ÌÌà àAdditionally,€husband€protests€that€wife€disposed€of€the€money€in€a€€jointÏchecking€account€without€dividing€with€him.€€Wife€testified€that€she€took€the€moneyÏbecause€she€paid€all€the€bills.€€œThe›€trial€court€concluded€that€ð ðany€assets€that€theÏparties€owned€before€their€separation€have€since€been€dissipated,€except€for€the€homeÏand€furnishings.ðð€€Since€there€is€evidence€establishing€all€facts€found€by€the€trial€courtÏwell€beyond€the€"preponderance€standard,"€we€concur€with€the€findings€of€fact€madeÏby€the€trial€court€and€find€no€abuse€of€discretion.€€œÌÌà
