āFor€the€assistance€of€the€Trial€Court€and€counsel€on€remand,€the€proceedings€andĪpresent€status€of€the€case€as€revealed€by€the€abbreviated€record,€will€be€discussed.ĖĖā āOn€April€12,€1994,€the€husband€sued€for€divorce€on€grounds€of€irreconcilableĪdifferences€and€cruel€and€inhuman€treatment,€requesting€distribution€of€marital€property€andĪdebts,€custody€of€two€children€and€child€support.ĖĖā āOn€April€26,€1994,€the€wife€answered€admitting€irreconcilable€differences,€denyingĪcruel€and€inhuman€treatment,€and€requesting€dismissal€of€the€husbandđđs€complaint.€€By€cross„complaint,€the€wife€sought€divorce,€child€custody€and€support,€and€division€of€marital€estate.ĖĖā āOn€January€11,€1995,€the€wife€filed€the€following€motion:ĖĶĶā8 āā8  Comes€now€Amy€Elizabeth€(Michelle)€Gee,€defendant/cross„plaintiff,€and€moves€the€Court,€prior€to€making€a€determinationĪas€to€custody€which€determination€is€currently€set€to€beĪannounced€on€January€17,€1995,€to€allow€her€to€present€proof€ofĪmaterial€changes€in€circumstances€affecting€the€custody€of€theĪchildren€since€the€hearing€in€this€cause€on€November€15,€1994.€ĪThese€changes€are€to€the€detriment€of€the€children,€has€adverselyĪaffected€them,€has€emotionally€adversely€affected€them,€andĪthose€changes€are€definitely€not€in€the€best€interest€of€theĪchildren.ĖĖā8 āā8  James€Michael€Gee€continues€to€ignore€what€is€in€the€bestĪinterest€of€the€children€regarding€bed„time,€living€conditions,Īetc.ĖĖĖĶĶā āThe€motion€was€resisted€by€the€husband.ĖĖā āOn€March€30,€1995,€at€12:30€P.M.,€the€Trial€Court€entered€a€đ đFinal€Decree€ofĪDivorce,đđ€stating:ĖĶĶā8 āā8  This€cause€came€to€be€heard€on€November€15,€1994,€andĪNovember€22,€1994€before€the€Honorable€Alex€œDarnell›,ĪChancellor€of€the€Chancery€Court€for€Montgomery€County,ĪTennessee€upon€plaintiffđđs€complaint€for€absolute€divorce,Īdefendantđđs€answer€and€counter„complaint,€the€testimony€of€theĪparties,€statements€of€counsel€and€the€entire€record€in€this€cause,Īfrom€all€of€which€it€appears€to€the€Court€that€each€party€hasĪalleged€and€proved€inappropriate€marital€conduct€and€as€a€result,Īthe€parties€should€be€declared€divorced.€€It€is€therefore,Ėā8 āā8 āOn€the€same€date,€March€30,€1995,€at€12:40€P.M.,€the€Trial€Court€entered€an€orderĪstating€that€the€cause€was€heard€on€November€15€and€22,€1994,€January€17€and€27,€1995,€andÍFebruary€17,€1995.€€Said€order€awarded€joint€custody€to€the€parties€and€physical€custody€onĪalternating€weeks.€€The€husband€was€ordered€to€pay€the€wife€$450€per€month€rehabilitativeĪalimony€pursuant€to€T.C.A.€đđ€36„5„101(d)(1).€€The€husband€was€ordered€to€provide€healthĪcare€for€the€children€and€to€pay€cost€of€day€care€to€be€selected€by€the€parties.€€The€residence€ofĪthe€parties€was€awarded€to€the€husband€subject€to€a€mortgage€and€further:ĖĶĶā8 āā8 ā€.€.€.€To€balance€the€equation,€the€court€is€of€the€opinion€thatĪJames€Michael€Gee€shall€pay€to€Amy€Gee€the€sum€of€$2,500.00Īin€a€lump€sum€or€the€sum€of€$2,650.00€in€equal€monthlyĪinstallments€over€a€period€of€ten€(10)€months,€whichever€heĪshould€choose.€€The€first€payment€shall€be€due€no€later€thanĪthirty€(30)€days€from€the€entry€of€this€order.ĖĖĖĶĶThe€husband€was€ordered€to€pay€the€wife€$3,253.95€as€her€share€of€the€cash€value€of€anĪinsurance€policy€on€his€life,€and€$600€fee€for€her€counsel.€€Further,€the€order€provided:ĖĶĶā8 āā8  It€is€further€ordered,€adjudged€and€decreed€that€there€will€be€noĪchild€support€payable€in€connection€with€this€case€due€to€theĪequal€sharing€of€the€children€and€joint€custody€herewithĪawarded.ĖĖā8 āā8  €It€is€further€ordered,€adjudged€and€decreed€that€the€defendant,ĪAmy€Gee,€shall€have€15%€of€plaintiffđđs€military€pension€payableĪmonthly€upon€retirement€of€the€plaintiff.ĖĖĖĶĶā āOn€the€same€date,€March€30,€1995,€at€12:50€P.M.,€the€Trial€Court€entered€theĪfollowing€order:ĖĶĶā8 āā8  This€cause€came€to€be€heard€on€January€17,€1995,€upon€motionĪof€the€defendant/counter„plaintiff€to€allow€her€to€present€proof€ofĪmaterial€changes€in€circumstances€affecting€the€custody€of€theĪchildren€since€the€hearing€in€this€cause€on€November€15,€1994,Īas€well€as€the€defendant/counter„plaintiffđđs€motion€for€aĪclarification€as€to€the€award€of€the€residence€of€the€parties.€ĪUpon€the€statements€of€counsel€and€the€record€as€a€whole,€theĪCourt€is€of€the€opinion€that€the€motions€are€not€well€taken€andĪshould€be€denied.€€It€is€therefore,Ėā8 āā8  Ordered€that€the€plaintiffđđs€motion€to€reopen€the€proof€as€wellĪas€the€plaintiffđđs€motion€for€a€clarification€are€hereby€denied.ĖĖĖĶĶā āOn€May€1,€1995,€the€husband€moved€the€Trial€Court€to€hold€the€wife€in€contempt€forĪfiling€an€affidavit€after€the€Court€had€refused€to€hear€further€evidence.ĖĖā āOn€July€20,€1995,€the€Trial€Court€entered€an€order€overruling€the€husbandđđs€motion€toĪalter€or€amend€the€đ đFinal€Decree€of€Divorce€entered€on€March€30,€1995€at€12:30€P.M.đđĖĖā āOn€July€26,€1995,€the€Trial€Court€entered€an€order€stating:ĖĶĶā8 āā8  This€cause€came€to€be€hard€on€Friday€June€9,€1995€uponĪdefendantđđs€Motions€to€Alter€or€Amend€the€Final€Decree€ofĪDivorce€and€the€Final€Order€with€regard€to€child€custody€andĪproperty€division,€as€well€as€plaintiffđđs€Motions€for€aĪRestraining€Order€and€for€Contempt.€€Upon€the€arguments€ofĪcounsel€and€the€record€as€a€whole€the€Court€was€of€the€opinionĪthat€ōōthere€may€be€certain€matters€with€regard€to€debts€andĪvacation€property€that€have€not€beenķķ€ōōresolvedķķ,€and€that€thoseĪmatters€should€be€resolved;€and€that€the€affidavit€of€Vicki€HunterĪshould€be€sealed;€and€that€plaintiff€should€be€allowed€anĪopportunity€to€supplement€his€motion€for€restraining€order€withĪthe€affidavits€of€persons€in€his€chain€of€command.€€It€isĪtherefore,Ėā8 āā8  Ordered€that€the€parties€shall€communicate€with€regard€to€theĪōōdisposition€of€certain€debts€and€the€vacation€property€identifiedķķĪōōby€the€defendant€as€not€having€been€allocated€in€connectionķķ€ōōwithĪthe€termination€of€these€proceedingsķķ.ĖĖā8 āIt€is€obvious€from€the€above€excerpts€from€the€order€of€July€26,€1995,€that€all€of€theĪissues€between€the€parties€were€not€resolved€by€said€order€and€that€certain€issues€do€in€factĪremain€for€resolution,€to€wit,ĖĶĶā8 āā8  disposition€of€certain€debts€and€the€vacation€property€identifiedĪby€the€defendant€as€not€having€been€allocated€with€theĪtermination€of€these€proceedings.ĖĖĖĶĶā āAlso,€it€appears€that€an€issue€remains€as€to€the€restraint€of€communication€withĪsuperiors€of€the€husband.ĖĖĖā āUnder€these€circumstances,€the€orders€of€the€Trial€Court€are€not€appealable,€but€areĪsubject€to€revision€at€any€time€before€entry€of€a€final€judgment€adjudicating€all€the€claims,€rightsĪand€liabilities€of€the€parties.€€œT.R.C.P.›€Rule€54.02,€œT.R.A.P.›€Rule€3(a).ĖĖā
