Inthisactiontoenforcevisitationrightsbythepaternalgrandparents,theTrialJudgeorderedvisitationandthemotherhasappealed.  ThechildwasbornonApril3,1993,andonJune20,1994,thepaternalgrandmotherfiledapetitionforvisitation.OnSeptember20,1994,theTrialJudgeenteredanorderfollowinganevidentiaryhearing,whereinhedetermined:0 0 thattheminorchild,EmilyG.Phillips,dob4393,suffersfromparticularandseveremedicalproblems,andisnotachildthatcanberemovedfromthehomeoftherespondentandhergrandmother,Mrs.RansomHall.However,theCourtdoesfindthatthepetitioners,beingthefraternalgrandmotherandfatherofthechildshouldbegrantedonehourofvisitationeachweekatthehomeofMrs.Hallinordertoattempttoestablisharelationshipwiththechild.  OnJuly13,1995,theappellantsbriefinformsusthattheCourt reheardthematter anda finalorder wasenteredonJuly19,1995,andprovided,interalia thatthepetitionershouldbeawardedvisitationoftheminorchild,EmilyG.Phillips,dob4393from9:00a.m.until1:00p.m.onSaturday,everyotherweek. ThisorderwasstayedbytheTrialϜCourt,pendinganappeal,andthemotherinsiststheevidencepreponderatesagainsttheCourtsfindingthatvisitationwiththepaternalgrandmotherisinthebestinterestoftheminorchild.  T.C.A.366302establishestherightforgrandparentstovisitwithgrandchildrenuponfindingbyacourtofcompetentjurisdiction thatsuchvisitationrightswouldbeinthebestinterestoftheminorchild.  )   כ  AtthetrialonJuly13,andduringthedirectexaminationofthegrandmother,theCourtinterposed:0 0 Ididntseewehadanyneedtosithereandrehasheverythingwehadgonethroughbeforeandwehad,andallthetestimonythatwasstartedherewaseverythingthatIhadheardand,youknow,absentanythingtothecontraryIjustdidntseetheneedtodoitalloveragain.0 0  Iunderstandtherespectivepositionsofbothsides.IknowafterweheardthisthelasttimeItalkedtoDr.Puckettaboutthechildsmedicalconditionandheinformedmethattherewasnothingabouttheshuntthatwouldpreventtheothergrandmotherfromhavingthechildwithherjustaslong[sic]thechildwastakencareof,andhecouldntseeanyharminthat.TheevidenceinthisrecordpreponderatesagainsttheTrialJudgesdecision,andwevacate.T.R.A.P.Rule13(d).  ItwashighlyirregularandimproperfortheTrialCourttoconsultanexpertwitnessexparte,andrelyonthatinformationinmakinghisjudgment.ThebasistoauthorizetheCourttoconsultanexpertisfoundinRule706,TennesseeRulesofEvidence,andtheCourtmustscrupulouslyfollowthatrule.AlsoseeDoverv.Dover,821S.W.2d593(Tenn.App.1991).  ThepartiesareentitledtomakeanorderlypresentationofalloftheirevidenceanditistheCourtsdutytodecidethefactualissuesfromtheevidencepresentedinCourt.    Accordingly,thejudgmentoftheTrialCourtisvacatedandthecauseremandedforanewtrial.Inviewofthecircumstancespresented,webelievethisisanappropriatecaseforaguardianadlitemtobeappointedfortheminorchildbeforetherearefurtherproceedingsintheTrialCourt.Accordingly,uponremand,theTrialJudgewillappointaguardianadlitemforthechildandproceedinaccordancewiththisopinion.
