PlaintifffiledacomplaintagainstDefendantandMs.Grahamon28February1991.ThecomplaintoriginallysoughtanaccountingofinsuranceproceedsawardedtoDefendantandcontainedthefollowingallegation:8  ThatonMarch15,1986,Respondents,StevenD.andLoriG.Graham,as Borrowers,signedapromissorynoteintheamountof$10,477.17,accompaniedbysaidDeedofTrust.SeeExhibitsF1F2.Plaintiffamendedthecomplainton28December1992toallegefraudonthepartofDefendant.On12September1996,Plaintifffiledasecondamendedcomplaintwhichcontainedaclaimfortheloanamountevidencedbythenoteexecutedon15March1986.ThepartiesagreedattrialthatafterthesecondamendmenttheonlyissuebeforethecourtwaswhetherPlaintiffcouldrecovertheloanprincipleandinterestandherattorneysfees.X ?   ԀThechancerycourtruledinfavorofPlaintiffintheamountof$13,987.02.Thisamountincludedtheloanprincipleandprejudgmentinterest,butnoattorneysfees.Plaintiffmovedforanamendedjudgmentawardingherattorneysfees,butthecourtdeniedhermotion.Thereafter,bothpartiesfilednoticesofappealandlateragreedonthedesignationofPlaintiffasAppellant.   AttorneysFees    Plaintiffreliesontheprovisioninthedeedoftrustallowingapartytorecoverattorneysfeestosupportherclaimtofeesinthisactiononthenote.DefendantarguesthatthedeedoftrustandthenoteareseparatedocumentsandthatPlaintiffmaynotrecoverattorneysfeesunderthenotebecausethepartiesdeletedtheparticularprovisionofthenotewhichdealtwithattorneysfees. ItistheopinionofthiscourtthatPlaintiffisnotentitledtoattorneysfees.Toexplain,giventhepartiesactions,wemustconcludetheyintendedtodeletetheprovisioninthenotereferringtoattorneysfees.Inaddition,althoughthedeedoftrustprovisionreliedonbyPlaintiffdidallowforattorneysfees,itonlyappliedtoanactionforenforcementofthedeedoftrust.Thepresentactionisonthenote,nottoenforcethedeed @   .Therefore,eveniftheattorneysfeeprovisionfromthedeedweretoapplytotheactiononthenote,Plaintiffwouldstillbeunabletorecoverherattorneysfees. @ StatuteofLimitations  DefendantcontendstheapplicablestatuteoflimitationsisTennesseeCodeAnnotatedsection283109(a)(3).Thissectionprovides: Thefollowingactionsshallbecommencedwithinsix(6)yearsafterthecauseofactionaccrued:...(3)Actionsoncontractsnototherwiseexpresslyprovidedfor.Tenn.CodeAnn.283109(a)(3)(1980).Thus,DefendantarguesPlaintiffhadtofilehercomplaintwithinsixyearsofthematuritydateorby17February1994.DefendantthenarguesPlaintiffscomplaintwasnottimelybecauseshedidnotactuallystateacauseofactiontorecovertheloanprincipleandinterestuntilshefiledthesecondamendedcomplainton12September1996.Inresponse,Plaintiffcontendsthestatuteoflimitationsdidnotbarherclaimbecausethesecondamendedcomplaintrelatedbacktothedateoftheoriginalcomplaint. Rule15.03oftheTennesseeRulesofCivilProcedureisrelevantandprovides: Whenevertheclaimordefenseassertedinamendedpleadingsaroseoutoftheconduct,transaction,oroccurrencesetforthorattemptedtobesetforthintheoriginalpleading,theamendmentrelatesbacktothedateoftheoriginalpleading.Tenn.R.Civ.P.15.03(West1995).ThisRulereplacedthepreviouscodesection20"1505whichgavethetrialjudgesmorediscretionindecidingwhetheramendmentsrelateback. Karashv.Pigot ,530S.W.2d775,777(Tenn.1975). In Karash ,thecourtheldthatanamendedcomplaintallegingassaultandbatteryduetoanonconsensualbloodtransfusionwouldrelatebacktotheoriginalcomplaintwhichwasbroughtforphysiciannegligence.X A   ԀIninterpretingRule15.03,thecourtstated:8 Rule15.03hasneverbeenconstruedbyourcourts;however,itslanguageissoclearandunequivocalthatitisvirtuallyselfconstruing...ThegreatliberalityofthisRuleisconvincinglydemonstratedbytheensuingprovisionspermittinganewparty,undercertaincircumstances,tobebroughtinnotwithstandingthefactthatthestatutehasrunatthetimeoftheamendment...TheNewRulesofCivilProcedurearedesignedtoinsurethatcasesandcontroversiesbedeterminedupontheirmeritsandnotuponlegaltechnicalitiesorproceduralniceties. Id. at777.Inaddition,theystatedthat leave(toamend)shallbefreelygivenwhenjusticesorequires,againshowingtheliberalityoftheRule. Id. (quoting Branchv.Warren ,527S.W.2d89(Tenn.1975)). Theoriginalcomplaintcontainedallegationsconcerningtheagreementbetweentheparties.Clearly,theactiononthenotearoseoutofthesameconduct,transactionoroccurrencesetforthorattemptedtobesetforthintheoriginalcomplaint.Boththeoriginalandsecondamendedcomplaintsrevolvedaroundthesamerealestatetransactionwhichspreadoveranextendedperiodoftime.ItistheopinionofthiscourtthatPlaintiffsclaimwasnotbarredbythestatuteoflimitationsbecausehersecondamendedcomplaintrelatedbacktotheinitialcomplaint.
