àOn€May€12,€1995,€a€petition€was€filed€in€Juvenile€Court€for€ShelbyÏCounty,€Tennessee,€charging€the€defendant€with€the€delinquent€act€of€attemptÏto€commit€murder€in€the€first€degree.€€After€an€evidentiary€hearing€in€juvenileÏcourt,€defendant€was€found€to€have€committed€the€delinquent€act€and€wasÏcommitted€to€the€Tennessee€Department€of€Youth€Development€for€anÏindefinite€period€of€time.€€Defendant€appealed€to€the€circuit€court€for€a€trial€deÏnovo,€and€the€record€was€certified€to€the€circuit€court€on€July€18,€1995.€€OnÍJuly€19,€1995,€defendant€filed€a€motion€in€the€circuit€court€to€stay€the€judgmentÏof€the€juvenile€court€and€to€set€bond.€€This€motion€was€granted,€and€defendantÏwas€released€from€custody€pending€the€trial€of€the€case.€€Defendant€demanded€aÏjury,€and€the€case€was€set€for€trial€on€December€6,€1995.€€At€the€conclusion€ofÏthe€trial€on€December€12,€1995,€the€jury€returned€a€verdict€finding€thatÏdefendant€had€committed€the€delinquent€act€of€attempted€second€degreeÏmurder.€€The€court€subsequently€entered€an€order€on€the€jury€verdict,€and€theÏdefendant€has€appealed.€€Ìà óóó,€717€S.W.2d€290€(Tenn.€1986),€aÏtruck€owner€appealed€the€decision€of€the€Department€of€Safety€permittingÏforfeiture€of€his€truck€with€an€altered€vehicle€identification€number.€€TheÏadministrative€law€judge,€after€conducting€a€hearing€on€the€case,€failed€toÏcomply€with€the€provisions€of€T.C.A.€ðð€4„5„314€(g)€(1985)€requiring€that€aÏdecision€be€rendered€in€writing€within€90€days€after€conclusion€of€the€hearing.€ÏOur€Supreme€Court,€after€noting€that€forfeiture€statutes€are€strictly€construedÏbecause€forfeitures€are€not€favored€in€the€law€and€that€because€the€proceedingsÏare€quasi€criminal€the€presumption€of€innocence€must€be€considered,€said:ÌÓÓà8 óóó€Thus,€in€cases€like€the€present€oneÏwhere€no€prejudice€has€been€shown,€we€can€infer€thatÍthe€legislature€intended€for€the€ninety€day€provisionÏto€be€directory€in€nature.€€Since€the€statue€isÏdirectory€rather€than€mandatory,€violation€of€theÏninety€day€rule€does€not€nullify€the€forfeiture€hearingÏor€order.ÌÌÓÓò àIn€the€case€before€us,€the€45€day€period€relates€only€to€the€time€for€theÏhearing€and€does€not€relate€to€the€merits€of€the€case.€€Defendant€was€dulyÏreleased€from€custody€after€the€appeal€was€filed,€and€there€has€been€no€showingÏof€any€prejudice€to€the€defendant€by€the€failure€to€conduct€the€trial€within€theÏ45€day€period.€€This€Court,€like€our€Supreme€Court€in€ò òòòGarrettó óóó,€can€infer€thatÏthe€legislature€intended€the€45€day€provision€to€be€directory€in€nature.€€ThisÏissue€is€without€merit.Ìà àIn€defendantððs€second€issue,€he€asserts€that€he€could€not€have€committedÏa€delinquent€act€of€attempted€second€degree€murder€because€there€is€noÏcriminal€offense€of€attempted€second€decree€murder€in€this€state.€We€mustÏrespectfully€disagree.Ìà àT.C.A.€ðð€39„12„101€(1991)€provides:ÌÓÓà8 àà8 àò ò39„12„101.€€Criminal€attempt.€ó ó„€(a)€A€personÏcommits€criminal€attempt€who,€acting€with€the€kindÏof€culpability€otherwise€required€for€the€offense:Ìà8 àà8 à(1)€Intentionally€engages€in€action€or€causes€a€resultÍthat€would€constitute€an€offense€if€the€circumstancesÏsurrounding€the€conduct€were€as€the€person€believesÏthem€to€be;ÌÌà8 àà8 à(2)€€Acts€with€intent€to€cause€a€result€that€is€anÏelement€of€the€offense,€and€believes€the€conduct€willÏcause€the€result€without€further€conduct€on€theÏpersonððs€part;€orÌÌà8 àà8 à(3)€Acts€with€intent€to€complete€a€course€of€action€orÏcause€a€result€that€would€constitute€the€offense,€underÏthe€circumstances€surrounding€the€conduct€as€theÏperson€believes€them€to€be,€and€the€conductÏconstitutes€a€substantial€step€toward€the€commissionÏof€the€offense.ÌÌà8 àà8 à(b)€Conduct€does€not€constitute€a€substantial€stepÏunder€subdivision€(a)(3)€unless€the€personsðð€entireÏcourse€of€action€is€corroborative€of€the€intent€toÏcommit€the€offense.ÌÌà8 àà8 à(c)€It€is€no€defense€to€prosecution€for€criminalÏattempt€that€the€offense€attempted€was€actuallyÏcommitted.ÌÌÓÓà àDefendant€contends€that€since€second€degree€murder€is€ð ða€knowingÏkilling€of€anotherðð€T.C.A.€ðð€39„13„210€(a)(1)€(1991),€an€attempt€to€commitÏsecond€degree€murder€would€involve€the€ð ðspecific€intentðð€to€commit€ð ðaÏknowing€act.ðð€€We€do€not€disagree€œthat€that›€could€be€the€result,€but€it€is€clearÏthat€in€second€degree€murder,€the€murder€is€the€intended€result€of€theÏperpetratorððs€act.€€If€the€perpetrator€actually€possesses€an€intent€to€kill,€he€orÍshe€may€be€charged€with€attempted€murder.€€ò òòòSee€State€v.€Kimbroughó óóó,€924ÏS.W.2d€888,€892€(Tenn.€1996).Ìà àOnce€a€homicide€or€attempted€homicide€it€established,€it€is€presumed€toÏbe€the€offense€of€murder€in€the€second€degree€or€an€attempt€to€commit€murderÏin€the€second€degree,€and€to€elevate€the€offense€to€first€degree€murder€or€anÏattempt€thereof,€the€state€must€prove€the€elements€of€premeditation€andÏdeliberation.€€ò òòòState€v.€Boydó óóó,€909€S.W.2d€50,€53€(Tenn.€Crim.€App.€1995).€€InÏò òòòBoydó
