OnMarch2,1993RickyHembreeshotandseverelyinjuredhissisterinlaw.HewasindictedintheCockeCountyCircuitCourtforaggravatedassaultandfirstdegreemurder,wasconvictedofaggravatedassault,andwassentencedtosixyearsimprisonment.Hebecameeligibleforparoleafterserving30%ofhissentence.FollowingahearingonFebruary14,1995,theparoleboarddeclinedtoreleasehim,andrecommendedthathecontinuehisangermanagementtrainingandanyothertreatmentthatwasavailable.FurtherconsiderationofparolewasdeferreduntilFebruaryof1997.  Mr.HembreealsoappealedhisconvictiontotheCourtofCriminalAppeals.Thecourtupheldtheconviction,butinanopinionfiledMay18,1995,itfoundthatthetrialcourthaderredinsentencinghim.ThetrialcourthadappliedfouroftheenhancementfactorsfoundinTenn.CodeAnn.4035114toMr.Hembreescrime,andaccordinglygavehimthemaximumsentencepermitted.Theappealscourtfoundtwoofthefactors(theuseofafirearmandthepotentialforbodilyinjury)tobeinappropriateasenhancementfactors,becausetheywereessentialelementsoftheoffensechargedintheindictment.ThecourtaccordinglymodifiedMr.HembreessentencetofiveyearsinthecustodyoftheDepartmentofCorrection. $   ׀  ThePublicDefenderwrotealettertoCharlesTraughber,ChairmanoftheBoardofParoles,informinghimoftheactionoftheCourtofCriminalAppeals,andrequestingthatMr.Hembreebegrantedanearlierhearingtohavehisparolereconsidered.Mr.TraughberrespondedwithaletterstatingthatthemembersoftheBoardwhohadvotedonMr.HembreescasehadreviewedthePublicDefendersletterandMr.Hembreesfile,anddecidednottomodifythedateforhisnexthearing.  Mr.HembreethenfiledaPetitionforWritofCertiorariwiththeChanceryCourtofDavidsonCounty,arguingthattheParoleBoardsactionwaserroneousandunfairinlightofthereductioninhissentence.Thecourtdismissedthepetition,findingthatitfailedtostateaclaimuponwhichreliefcouldbegranted.Thisappealfollowed.@ II.   WebelievethattheChanceryCourtwascorrecttofindthatMr.HembreesPetitionessentiallyaskedittoreviewtheintrinsiccorrectnessoftheBoardsdecision.SuchareviewisbeyondthescopeoftheWritofCertiorari.UndertheWrit,thereviewingcourtmayonlyinquireintotheessentiallegalityoftheBoardsdecision.ItcanorderthattheentirerecordbesentupforreviewonlyuponafindingthattheBoardexceededitsjurisdiction,oractedfraudulently,arbitrarilyorillegallyinrenderingitsdecision.SeeYokleyv.State,632S.W.2d123(Tenn.App.1981);Powellv.ParoleEligibilityReviewBoard,879S.W.2d871(Tenn.App.1994). X   Inthepresentcase,nofactswereallegedtoindicatethattheBoardactedinexcessofitsjurisdiction,orthatitsactionswerefraudulent,arbitraryorillegal.Achangeinthelengthofsentencedoesaffectaprisonersreleaseeligibilitydate(RED),becausethatdateiscalculatedasapercentageofthefullsentence,butMr.HembreehadalreadyreachedhisRED,andreceivedthehearinghewasentitledto,bythetimehissentencewasreduced.   ThedecisiontograntordenyparoleisamattersolelywithinthediscretionoftheParoleBoard.SeeDoylev.Hampton,207Tenn.399,340S.W.2d891(1960).WebelievethatthechoiceofahearingdateaftertherequiredinitialhearingislikewisewithintheBoardsdiscretion.TheappellantimpliesthatiftheBoardhadknownthathissentencewouldbereduced,theywouldhaveadvancedthedateforhisnexthearing.Ofcoursethereisnowaytojudgethetruthofthatproposition.Itappearstous,however,thattheBoardwasgiventheopportunitytochangethehearingdateafteritwasinformedofthesentencereduction,butexerciseditsdiscretionindecliningtodoso.WeseenothingarbitraryintheBoardsdecision,nordowethinkittobemanifestlyunfairtorequireMr.Hembreetoserve75%ofhissentencebeforeheisreconsideredforparole.
