ItiswellsettledunderTennesseelawthatapartyappealingageneralsessionscourtjudgmenttocircuitcourthastherighttodismisstheappealatanytimepriortotrialincircuitcourt.Storiev.Griffin,51S.W.2d488,489(Tenn.1932);C.B.Donaghy&Co.v.McCorkle,98S.W.1050,105051(Tenn.1907);Dayv.Hagler,slipop.(Tenn.Ct.App.June25,1985).OursupremecourtinC.B.Donaghy&Co.v.McCorkle,98S.W.1050(Tenn.1907),statedthat [i]tisthegeneralrulethattheappellantmayhavehisownappealdismissedatanytimewhilethecauseremainswithinthejurisdictionoftheappellatecourt. Upondismissalofanappealfromgeneralsessionscourt,thejudgmentofthegeneralsessionscourtshallbeaffirmed.McCorkle,98S.W.at1051.SeealsoStoriev.Griffin,51S.W.2d488,489(Tenn.1932)(statingappellanthadarighttodismisshisappealfromthejudgmentofthejusticeofthepeacecourttochancerycourtandhavethejudgmentofthejusticeofthepeacecourtaffirmed). InDayv.Hagler,slipop.(Tenn.Ct.App.June25,1985),thisCourtaddressedanissuesimilartotheoneinthecaseatbar.TheissueinDaywaswhetherapartyappealingfromageneralsessionscourtjudgmenttocircuitcourtmaydismisshisappealwhendoingsowouldpreventhisnonappealingadversaryfromprovingadditionaldamagesincircuitcourt.Inholdingthattheappellantcoulddismisshisappeal,thisCourtstatedthat [t]helawisclearthatapartyappealingaGeneralSessionsjudgmenttoCircuitCourthastherighttodismisstheappealatanytimepriortotrialinCircuitCourt.Day,slipop.at2.InDay,thecourtsaid:8 8 Additionally,thereisnoinjusticeapparent.PlaintiffsadditionalexpensesoughtintheCircuitCourtaroseaftertheGeneralSessionsjudgmentwouldhavebecomefinalhadtherebeennoappeal.Therewouldbenocauseofactionforthoseexpensesinthateventuality.Inshort,theplaintiffisinthesamepositionasifnoappealhadbeentakenbythedefendant.Shestillhasherjudgmentfor$3,246.00.Whereisthereaninjustice?Day,slipop.at2.ӛ AlthoughPlaintiffcitesthecaseofWarev.MeharryMedicalCollege,898S.W.2d181(Tenn.1995),forthepropositionthatanappellantloseshisrighttodismisshisappealfromageneralsessionscourtjudgmentonceanamendedcomplaintandananswertotheamendedcomplaintarefiledincircuitcourt,Plaintiffspropositionisinerror.TheSupremeCourtinWareheldthatapartymayappealfromajudgmentingeneralsessionscourttocircuitcourtandamendthecomplainttoseekdamagesbeyondthemonetaryjurisdictionallimitsofgeneralsessionscourt.ThecourtinWaredidnotmodifythelongstandingprinciplethatanappellantmaydismisshisappealfromajudgmentofthegeneralsessionscourtatanytimepriortotrialincircuitcourt.Thus,inthepresentcase,thecircuitcourtsrefusaltoallowtheDefendantvoluntarilytodismisshisappealfromthejudgmentofthegeneralsessionscourtwasinerror.
