àAppellantððs€father,€George€Briggs€Hoffman,€died€on€July€9,€1992,€at€the€age€of€28Ïyears,€as€a€result€of€injuries€sustained€from€a€vehicular€accident€in€Nashville.€€This€wrongful€deathÏaction€is€pursued€against€Mr.€Wilkins,€the€driver€of€the€vehicle.€€The€complaint€alleges€theÏfollowing:ÌÌÓÓà8 àThat€on€or€about€July€9,€1992,€at€approximately€12:40€a.m.,ÏJoseph€E.€Wilkins€was€operating€his€1987€Jeep€Wrangler€southerlyÏon€Heritage€Drive€when€he€began€to€stop€his€automobile€in€order€toÏallow€the€deceased€to€enter€the€vehicle.€€At€this€time,€the€deceasedÏwas€walking€southerly€on€Heritage€Drive€enroute€[sic]€to€hisÏautomobile.€€However,€before€the€deceased€was€able€to€completelyÏenter€the€vehicle,€the€Defendant€Joseph€E.€Wilkins€accelerated€hisÏvehicle€which€caused€the€deceased€to€fall€from€the€vehicle.€€At€theÏtime€of€this€accident,€George€Briggs€Hoffman€received€serious€andÏpainful€injuries€which€ultimately€resulted€in€his€death€.€.€.€.€€€ÌÌÌÌÓÓAppellant€alleged€that€Wilkinsðð€actions€violated€both€statutory€and€common€law€and€wereÏnegligent.€ÌÌà àWilkins€answered€the€complaint,€denying€any€liability,€and€setting€forth€theÏaffirmative€defenses€of€assumption€of€risk€and€Hoffmanððs€own€negligence€in€attempting€to€enterÏthe€vehicle€while€in€an€intoxicated€condition.× ƒ% ××  ×€€He€also€moved€for€summary€judgment,€submittingÏhis€own€deposition€as€well€as€that€of€Bryan€Christopher€Hempel€in€support€thereof.€€In€response,ÍAppellant€submitted€the€affidavits€of€two€police€officers€who€investigated€the€incident,€Jeff€BallÏand€Sergeant€J.€Hooper€of€the€Nashville€Metropolitan€Police€Department.€€ÌÌà àThe€events€preceding€this€incident,€which€remain€undisputed,€are€as€follows:€€OnÏthe€eve€of€the€accident,€the€deceased€accompanied€Mr.€Wilkins,€by€traveling€as€a€passenger€inÏWilkinsðð€1987€Jeep€Wrangler,€to€the€home€of€Wilkinsðð€friend,€Chris€Hempel,€arriving€aroundÏ10:00€in€the€evening.€€The€three,€along€with€Hempelððs€roommate,€Rodney€Pruitt,€played€cards€atÏthe€Hempel€residence€until€the€early€morning€hours,€around€12:30€a.m.,€when€Hoffman€expressedÏa€desire€to€leave.€€He€requested€that€Wilkins€drive€him€back€to€his€own€vehicle€parkedÏapproximately€one„half€mile€from€the€residence.€€When€Wilkins€refused,€Hoffman€exited€theÏhome,€sprinting€southerly€on€Heritage€Drive€towards€his€own€vehicle.€€Minutes€later,€Wilkins€andÏHempel€attempted€to€catch€up€with€him€in€Wilkinsðð€Jeep.ÌÌà àAccording€to€Wilkinsðð€deposition,€Hoffman€had€consumed€approximately€14€shortÏbeers€prior€to€the€incident.€€He,€thus,€believed€Hoffman€ð ðveryðð€drunk€and€wanted€to€catch€up€withÏhis€friend€to€prevent€him€from€driving.€€Wilkinsðð€intentions€were€then€to€drive€Hoffman€to€his€ownÏresidence.€€Wilkins€described€the€resulting€encounter€with€the€deceased€as€follows:ÌÌÓÓà8 àA.à àSo€we€hopped€in€the€Jeep,€proceeded€to€go€down€the€streetÏto€get€him.€€And€he€was€running€on€the€left€side€of€me,€and€I€askedÏhim€to€get€in€the€Jeep€and€„„€because€he€was€drunk,€and€he€said,Ïð ðIððm€not€drunk€yet,ðð€and€dashed€at€my€Jeep.ÌÌà8 àQ.à àWere€you€stopped?ÌÌà8 àA.à àI€was€in€the€process€of€stopping.ÌÌà8 à.€.€.€.ÌÌà8 àQ.à àHow€fast€were€you€going?ÌÌà8 àA.à àTen€to€fifteen€miles€per€hour.ÌÌà8 àQ.à àAnd€tell€us€whether€or€not€Briggs€Hoffman€made€contactÏwith€your€Jeep.ÌÌà8 àA.à à.€.€.€.€€I€would€say€he€did.ÌÌà8 à.€.€.€.ÌÌà8 àA.à àWell,€I€didnððt€ever€see.€€All€I€saw€was€him€make€the€motionÏtoward€my€Jeep.€€I€donððt€know€what€happened€after€that.ÌÌà8 àQ.à àAnd€as€you€saw€him€make€the€motion€toward€your€JeepÏdidnððt€you€continue€to€look€at€him?ÌÌà8 àA.à àNo.€€I€continued€to€slow€down.€€I€was€in€the€process€ofÏshifting€gears.€€Gearing€down,€put€it€that€way.ÌÌà8 àQ.à àOkay.€€And€so€you€let€your€eyes€stay€forward€toward€theÏwindshield?ÌÌà8 àA.à àYes,€sir.ÌÌà8 àQ.à àAnd€did€not€look€to€see€what€he€was€doing?ÌÌà8 àA.à àYes,€sir.ÌÌà8 àQ.à àDo€you€know€whether€or€not€he€ever€got€a€foot€on€yourÏrunning€board?ÌÌà8 àA.à àYes,€sir,€he€did.ÌÌà8 àQ.à àHow€do€you€know€that?ÌÌà8 àA.à àThere€was€a€big€footprint€there.ÌÌà8 àQ.à àAnd€how€do€you€know€that€it€was€his?ÌÌà8 àA.à àWell,€it€matched€tread€on€his€tennis€shoes.ÌÌà8 àQ.à àOkay.€€Do€you€know€which€foot€he€got€there,€the€right€or€theÏleft?ÌÌà8 àA.à àI€believe€it€was€his€left.ÌÌà8 à.€.€.€.€ÌÌà8 àQ.à àOkay.€€Do€you€know€whether€or€not€he€got€his€hands€on€theÏJeep€in€any€way?ÌÌà8 àA.à àNo,€sir.€€ÌÌÌÌÓÓà àWilkins€described€the€Jeep€as€a€5€speed€with€two€front€seats,€and€a€back€seatÏsufficient€to€transport€ð ð[t]wo€small€people.ðð€€Entry€into€the€back€seat€could€be€accomplished€fromÏeither€side€of€the€vehicle€ð ð[b]y€lifting€the€front€seat€up€(using€a€release€lever)€and€stepping€into€theÍback€seat.ðð€€There€was€also€a€running€board€or€step,€approximately€one€and€a€half€feet€long,Ïlocated€directly€in€front€of€the€door.€€He€opined€that€Hoffman€could€have€entered€the€vehicle€fromÏeither€side,€but€he€ð ðjust€anticipated€[Hoffman]€giving€[him]€time€to€stop€and€get€in€the€Jeep.ðð€€HeÏð ðdidnððt€care€which€side€[Hoffman]€got€in€on.ðð€€Wilkins€commented€that€Hoffman€never€wouldÏhave€had€to€step€on€the€running€board,€if€he€had€given€Wilkins€ð ðtime€to€slow€down.ðð€€WilkinsÏð ðexpectedðð€Hoffman€to€give€him€time€to€bring€the€vehicle€to€a€complete€stop.€€Wilkins€estimatedÏthat€the€Jeep€moved€another€10€feet€after€he€observed€Hoffman€move€or€dash€toward€the€vehicle.€ÏAt€this€time,€he€was€gearing€down€from€second€to€first€gear.€€After€the€Jeep€came€to€a€stop,ÏWilkins€observed€Hoffman€lying€approximately€5€feet€behind€it.€€Wilkins€stated€that€he€first€knewÏsomething€had€happened€when€ð ðChris€.€.€.€slung€his€hand€across€my€chest€and€said€ððStop.ðð€ððÏWilkins€then€ð ðhit€the€brakes.ðð€€The€incident€occurred€approximately€two€and€a€half€blocks€from€theÏHempel€residence.€€Wilkins€stated€that€prior€thereto,€he€had€consumed€3€short€beers.€€ÌÌà àThe€deposition€of€Mr.€Hempel€adds€that€the€Jeep€was€open€all€around€the€back€andÏthe€top€was€off€at€the€time€of€the€accident.€€When€Wilkins€requested€that€Hoffman€enter€the€Jeep,ÏHoffman€was€running€out€in€front€of€the€Jeep€on€the€opposite€side€of€the€street.€€Hempel€describedÏthe€incident€as€follows:ÌÌÓÓà8 àA.à à.€.€.€.€€€Well,€he€darts€across€the€street,€and€I€seen€himÏcoming€across€the€street.€€I€seen€him€jump€up.€€I€knew€what€he€wasÏfixing€to€do.€€Well,€I€throwed€my€arm€out€trying€to€tell€[Wilkins]€toÏgo€ahead€and€stop.€€I€couldnððt€even€get€my€arm€out€before€he€hadÏalready€fell.ÌÌà8 à.€.€.€.€ÌÌà8 àA.à àHe€was€trying€to€jump€up€on€the€side€of€the€Jeep€and€enterÏthrough€the€back€of€the€Jeep,€grabbing€ahold€of€the€roll€bar,€put€oneÏfoot€on€the€wheel€well,€one€foot€on€the€door€flare€down€at€theÏbottom€of€the€door,€and€he€was€trying€to€pull€himself€in€the€Jeep.ÌÌà8 àQ.à àWas€this€on€the€driverððs€side?ÌÌà8 àA.à àYes,€sir.ÌÌà8 àQ.à àPutting€one€hand€on€the€roll€bar?ÌÌà8 àA.à àUh„huh,€which€is€in€the€back€seat€of€the€Jeep.ÌÌà8 àQ.à àAnd€one€foot€on€the€fender?ÌÌà8 àA.à àOne€foot€was€on€the€wheel€well.ÌÌà8 à.€.€.€.€ÌÌà8 àA.à àItððs€got€a€little€rubber€wheel€well€thatððs€about€two€inches,Ïsticks€out€about€two€inches.€€He€put€one€foot€up€there,€and€the€otherÏfoot€he€put€down€on€the€flare€down€at€the€bottom€of€the€door.ÌÌà8 àQ.à àNow,€do€you€know€whether€he€put€the€right€foot€on€theÏwheel€well?ÌÌà8 àA.à àThat€would€be€correct,€I€believe,€yes,€sir.ÌÌà8 àQ.à àAnd€the€left€foot€on€€„„€what€did€you€call€that€place?ÌÌà8 àA.à àThe€door€flare€down€at€the€bottom.ÌÌà8 à.€.€.€.€ÌÌà8 àA.à à.€.€.€I€actually€seen€him€do€that.€€And€the€whole€time,€youÏknow,€[Wilkins]€is€coming€to€a€slow€stop.€€Well,€when€he€jumpedÏup€and€grabbed€it,€I€seen€him€slip€back.€.€.€.€€I€did€see€his€hand€slipÏoff€the€roll€bar€and€him€go€backwards.€€ÌÌÌÌÓÓà àThe€affidavit€of€Jeff€Ball€states€that€his€investigation€of€the€incident€revealed€ð ðscuffÏmarks€that€came€from€a€tennis€shoe€that€would€indicate€Mr.€Hoffman€had€his€right€foot€on€the€jeepÏand€was€dragging€his€left€foot€on€the€ground.ðð€€Officer€Ball€made€a€written€report€at€the€scene€ofÏthe€accident€which€was€attached€to€his€affidavit.€€It€reads,€as€here€pertinent:ÌÌÓÓà8 àà àDriver€of€Veh.€1€[Wilkins]€states€they€found€[Hoffman]€onÏHeritage€Dr.€and€he€told€him€to€come€and€get€in€the€jeep.€€He€statesÏhe€was€slowing€to€a€stop€when€[Hoffman]€jumped€on€the€left€side€ofÏthe€Jeep€and€said€ð ðIððm€in€letððs€go.ðð€[Wilkins]€states€as€he€proceeded€Ï[Hoffman]€fell€out€of€the€Jeep.€€ÌÌÌÌÓÓThe€report€also€indicates€that€Wilkins€passed€a€field€sobriety€test€at€the€scene€and€the€results€of€hisÏblood€alcohol€test€were€.03.€€It€denotes€that€the€investigation€uncovered€a€tennis€shoe€print€on€theÏstep€of€the€vehicle€indicating€that€Hoffman€was€on€the€left€side€of€the€jeep.€€The€report€states€thatÍthe€roll€bar€and€bikini€top€of€the€vehicle€ð ðhad€just€been€armor„all[ed]€and€had€a€slick€finishðð€and€thatÏð ð[t]his€may€have€hampered€[Hoffman]€from€gripping€and€swinging€his€body€up€inside€[theÏvehicle].ðð€€Finally,€the€report€discloses€that€Ball€reviewed€the€clothing€of€the€deceased€and€noticedÏthat€the€left€shoe€was€scuffed€with€asphalt€and€that€the€deceasedððs€left€ankle€was€injured.× ƒ& ××  ×€€ÌÌà àAppellantððs€sole€issue€on€appeal€is€whether€the€trial€court€erred€in€entering€summaryÏjudgment€for€Wilkins.€€Our€review€of€this€matter€is€in€accordance€with€Rule€56.03€T.R.C.P.,Ïwhich€provides€that€a€summary€judgment€is€to€be€rendered€if€the€pleadings€and€discoveryÏmaterials,€as€therein€set€forth,€show€that€there€is€no€genuine€issue€as€to€any€material€fact€and€thatÏthe€moving€party€is€entitled€to€a€judgment€as€a€matter€of€law.€€We€are€to€review€the€evidence€beforeÏus€in€the€same€manner€as€a€motion€for€a€directed€verdict€made€at€the€close€of€the€plaintiffððs€proof€„Ïall€evidence€must€be€viewed€in€a€light€most€favorable€to€the€motionððs€opponent€and€all€legitimateÏconclusions€of€law€must€be€drawn€in€their€favor.€€òòò òSee,€e.g.,€White€v.€Methodist€Hosp.ÏSouthóóó ó,€844€S.W.2d€642€(Tenn.€App.€1992).ÌÌà àOn€appeal,€Appellant€argues€that€there€are€inconsistencies€between€Wilkinsðð€andÏHempelððs€depositions€and€€the€statement€given€by€Wilkins€to€Officer€Ball€at€the€time€of€the€accidentÏwhich€clearly€create€genuine€issues€of€material€fact.€€She€further€points€to€the€evidence€of€the€leftÏfoot€being€dragged€by€the€deceased€which€she€contends€is€indicative€of€Hoffman€hanging€on€to€theÏJeep€while€Wilkins€failed€to€stop.€€It€is€her€contention,€therefore,€that€there€is€evidence€from€whichÏa€jury€could€reasonably€conclude€that€Wilkins€drove€away€in€his€Jeep,€an€open€vehicle,€withoutÏfirst€ascertaining€whether€his€passenger,€Hoffman,€was€seated.€€ÌÌà àWe€are€inclined€to€agree.€€Whether€intentional€or€not,€we€do€find€someÏdiscrepancies€€between€Wilkinsðð€deposition€testimony€and€his€statement€to€Officer€Ball€at€the€sceneÍof€the€accident.€€We€find€these€discrepancies€to€go€to€the€heart€of€this€matter:€Whether€Wilkins€wasÏnegligent€in€the€operation€of€his€vehicle€so€as€to€proximately€cause€the€death€of€Mr.€Hoffman.€€ForÏexample,€viewing€the€evidence€in€a€light€most€favorable€to€Appellant,€we€find€that€a€reasonableÏinference€can€be€made€that€Wilkins€never€intended€to€stop€his€vehicle,€once€Hoffman€proclaimed,Ïð ðIððm€in,€letððs€go.ðð€€According€to€the€officerððs€report,€Wilkins€thereafter€proceeded,€never€fullyÏstopping€or€determining€whether€Hoffman€was€seated€when€he€fell€out€of€the€Jeep.€€This€is€at€leastÏone€reasonable€interpretation€of€the€events€as€presented€here.€€Another€is€that€Hoffman€attempted€toÏenter€the€Jeep€without€allotting€sufficient€time€for€Wilkins€to€properly€stop,€although€he€was€in€theÏprocess€of€doing€so,€and€simply€fell€out€of€the€vehicle.€€These€are€matters€which€are€proper€for€juryÏresolution.€€We€also€find€material€the€evidence€indicating€that€Hoffman€was€dragging€his€left€foot.€ÏWe€believe€that€a€jury€could€reasonably€conclude€that€Wilkins€never€intended€to€completely€stop€hisÏvehicle€or€failed€to€properly€do€so€and€was,€thus,€negligent.ÌÌà àUnder€the€principles€espoused€in€òòò òMcIntyreóóó ó,€summary€judgment€is€proper€in€thisÏcase€only€if€we€are€able€to€conclude€as€a€matter€of€law€that€the€deceased€was€more€negligent€thanÏWilkins€or€that€Wilkins€was€not€negligent.€€òòò òSee,€McIntyreóóó ó,€833€S.W.2d€at€57.€€In€light€of€theÏevidence€before€us,€viewed€most€favorably€to€the€appellant,€we€cannot€do€so.ÌÌà àWe€conclude€that€genuine€issues€of€material€fact€exist€in€this€matter€appropriate€forÏjury€resolution.€€The€summary€judgment€entered€in€favor€of€the€appellee€is,€therefore,€reversed€andÏthis€cause€remanded€to€the€trial€court€for€a€trial€on€its€merits.€€Costs€are€assessed€against€Joseph€E.€ÌWilkins,€for€which€execution€may€issue€if€necessary.ÌÌÓ`
