PlaintifffiledthisactioninAprilof1994,allegingϜshewasthemotherofJulieMarieHolt,bornJanuary22,1983,andthatsheandthedefendanthad formallylegitimatedthechild inSeptember1988.Shefurtherallegedthatthedefendanthadrefusedtosupportthechildandshesought childsupportarrearagesinanamountdeterminedproperbytheCourtfortheelevenyearsthathehasrefused .Indefendantsanswer,hestated withrespecttotheclaimsforpastduechildsupport,thedefendantwouldshowthatheisnotindebtedforpastduechildsupport,andfurtherinterposesthedefenseoflaches.   Subsequently,atrialwasheldandtheTrialJudgedeterminedthedefendantwasemployedandwascapableofpayingchildsupport,andorderedchildsupportbeginningonSeptember30,1994.Astotheaforementionedallegations,heruled thatthematterofchildsupportarrearageand/orestablishmentofpastchildsupportshallbereservedpendingfurtherordersoftheCourt. Subsequently,theCourtenteredjudgment,fromwhichplaintiffappeals,whichstatesinpertinentpart:0 0 TheCourtfurtherfinds,orders,adjudgesanddecreesthattheplaintiffsclaimforchildsupportarrearageisnotsustainedbytheproofofferedinthecase,andtheCourtfixesthechildsupportarrearageat$1,800.00ratherthanthe$50,976.00allegedbytheplaintifftobedueandowingasaresultofthecalculationsofthedefendantsincomefromtheyears1983throughSeptember23,1994.  TherecorddemonstratesthattheTrialCourtdidnothearevidenceontheissue,andwevacatehisjudgmentandremandforatrialonthemerits.  Appellant,inherstatementofevidence,concedesthat thestatementofcounsel...isbasicallyalltheoralevidencegiveninthecase .Intherecordisacopyofthepetitionandorderoflegitimation,whichsimplyaskstheCourttolegitimatethechildwithnorequestforsupportormedicalbenefits,whichthestatuteafforded.WeunderstandfromcommentsofcounselbeforetheTrialJudgethataftertheorderoflegitimationthepartiesmarriedandweresubsequentlyeitherdivorcedorthemarriagewasannulled,allapparentlywithoutanyprovisionsforsupportfortheminorchild.  StateexrelColemanv.Clay,805S.W.2d752(Tenn.1991)isinstructiveontheissuesbeforeus.Weholdthatatthetimethechildwaslegitimated,themother,bynotincludingthestatutorybenefitspersonaltoher,waivedanyrighttorecoveryforthoseexpenses.Clay,Id.755.TennesseeCodeAnnotated,Section362102statesthatthefatherofachildbornoutofwedlockisliablefor thenecessarysupportandeducationofthechild .Thisobligationbeginsatbirthandcontinuesuntilthechildreachesmajority,andactionsforsupportmaybemaintainedagainstthefatheratalltimesduringthechildsminority.SeeTennesseeDepartmentofHumanServicesv.Hinton,660S.W.2d506(Tenn.App.1983). '   כ  Upontrial,theTrialCourtwillbeguidedbythestatutewhichrendersthefatherliableforsupportfromandafterthechildsbirth.Thestatute,however,givestheCourt discretiontoorderaretroactivesupportawardbacktothatϜdate, butthe amountandmethodofpayment iswithinthesounddiscretionofthejuvenilecourtJudge.Clay,755.WeremandthecasetotheJuvenileCourttodeterminetheissuesafterthepartieshavepresentedtheirevidence.
