Thiscasearoseoutofadisputebetweenthepartiesovertheconstructionoftheplaintiffsresidence.Theplaintiffs,husbandandwife,suedtheircontractorfordamagescausedbybreachofthepartieswrittencontract,andforremovalofacontractorslienfiledagainsttheirresidence.Theyalsosoughtdamagesarisingoutofthefilingofthelien.Thedefendantfiledacounterclaimformoniesdueforworkperformedunderthecontractandfordamages,includingattorneyfees.Thetrialcourtdismissedtheoriginalcomplaint,awardedthedefendantajudgmentfor$10,000,anddecreedthathe beallowedtoenforcehislienagainstthe[plaintiffs]property,tothesatisfactionofsaidjudgment.Plaintiffsappeal,essentiallyarguingthattheevidencepreponderatesagainstthetrialcourtsjudgmentandthatthetrialcourterredinfailingto judiciallyremovethecontractorslien.Theappelleeraises,asanadditionalissue,thefailureofthetrialcourttoawardattorneyfeesunderthecontract.
