ðto€make€possibleÏmedical€assistance€to€those€recipients€determined€to€be€eligible€underÏthis€chapter€to€receive€medical€assistance€that€conforms€to€theÏrequirements€of€title€XIX€of€the€Social€Security€Act€[codified€in€42ÏU.S.C.€1396€òòet€seq.óó(1992€&€Supp.€1996)]€and€the€regulations€promulgatedÏpursuant€thereto.ðð€€T.C.A.€€ðð€71„5„102€(1995).€€Ìà àT.C.A.€€ðð€71„5„117€provides€in€part,€pertinent€to€the€issue€beforeÍus:ÌÓÓà8 àà8 àò ò71„5„117.€€Recovery€of€benefits€„€StateððsÏright€of€subrogation€„€Assignment€ofÏinsurance€benefit€rights€„€CommissionerÏauthorized€to€require€certain€informationÏidentifying€persons€covered€by€thirdÏparties€„€Stateððs€right€of€action.€„€ó ó(a)ÏMedical€assistance€paid€to,€or€on€behalf€of,€anyÏrecipient€cannot€be€recovered€from€a€beneficiaryÏunless€such€assistance€has€been€incorrectlyÏpaid,€or,€unless€the€recipient€or€beneficiaryÏrecovers€or€is€entitled€to€recover€from€a€thirdÏparty€reimbursement€for€all€or€part€of€the€costsÏof€care€or€treatment€for€the€injury€or€illness€forÏwhich€the€medical€assistance€is€paid.€€To€theÏextent€of€payments€of€medical€assistance,€theÏstate€shall€be€subrogated€to€all€rights€ofÏrecovery,€for€the€cost€of€care€or€treatment€forÏthe€injury€or€illness€for€which€medicalÏassistance€is€provided,€contractual€orÏotherwise,€of€the€recipients€against€any€person.€ÏMedicaid€payments€to€the€provider€of€theÏmedical€services€shall€not€be€withdrawn€orÏreduced€to€recover€funds€obtained€by€theÏrecipient€from€third€parties€for€medicalÏservices€rendered€by€the€provider€if€these€fundsÏwere€obtained€without€the€knowledge€or€directÏassistance€of€œthe›€provider€of€medicalÏassistance.€€When€the€state€asserts€its€right€toÏsubrogation,€the€state€shall€notify€theÏrecipients€in€language€understandable€to€allÏrecipients,€of€recipientððs€rights€of€recoveryÏagainst€third€parties€and€that€recipient€shouldÏseek€the€advice€of€an€attorney€regarding€thoseÏrights€of€recovery€to€which€recipient€may€beÍentitled.€€ÌÌà àThe€Med€asserts€that€Medicaid€payments€are€a€part€of€socialÏsecurity€benefits€and€that€ð ðthe€wording€of€the€statute€[T.C.A.€€ðð€29„26„119]€is€clear€that€plaintiff€cannot€recover€medical€expenses€paid€for€byÏsocial€security€benefits.ððà àÌà àOur€Supreme€court€was€faced€with€a€similar€issue€in€ò òòòNance€byÏNance€v.€Westside€Hosp.ó óóó,€750€S.W.2d€740€(Tenn.€1988).€€€In€ò òòòNanceó óóó,Ïthe€Court€considered€the€question€of€whether€workerððs€compensationÏbenefits€were€included€within€the€scope€of€T.C.A.€€ðð€29„26„119.€òòò òÏóóó óPlaintiff€Nanceò òòò€ó óóósustained€a€back€injury€during€the€course€of€hisÏemployment€with€Stauffer€Chemical€Company.€€During€surgery€to€repairÏa€damaged€disc,€he€suffered€an€adverse€reaction€to€an€anestheticÏresulting€in€serious€permanent€injuries.€€The€plaintiffððs€guardianÍbrought€a€medical€malpractice€suit€against€the€hospital€and€otherÏhealth€care€providers.€€Stauffer€Chemical€intervened€in€the€suit€in€orderÏto€assert€its€statutory€subrogation€lien€for€workerððs€compensationÏbenefits€paid€to€and€for€Nance.€€The€defendants€asserted€that€underÏT.C.A.€€ðð€29„26„119,€the€workerððs€compensation€benefits€ð ðpaid€orÏpayableðð€to€the€plaintiff€constituted€collateral€source€benefits€thatÏwere€not€recoverable€against€the€defendants.Ìà àThe€Court€determined€that€although€workerððs€compensationÏbenefits€are€not€specifically€provided€for€in€T.C.A.€€ðð€29„26„119,€suchÏbenefits€are€included€in€the€general€wording€ð ðany€other€source,ððÏbecause€workerððs€compensation€benefits€are€within€the€sameÏclassification€of€benefits€specified€in€the€statute.€€The€Court€held€thatÏthe€plaintiff€could€recover€from€the€defendants€the€amount€of€workerððsÏcompensation€benefits€paid€to,€or€on€behalf€of,€the€plaintiff.€€The€CourtÏstated:ÌÓÓà8 àà8 à[W]e€think€the€Legislature€intended€to€excludeÏworkerððs€compensation€benefits€from€the€scopeÏof€T.C.A.€ðð€29„26„119€by€the€inclusion€of€theÏmodifying€phrase€ð ðand€such€losses€are€notÏreplaced,€or€indemnified.ðð€€In€order€to€mitigateÏthe€damages,€the€statute€requires€that€theÏbenefits€be€paid€or€payable€and€also€indemnify€orÍreplace€the€tort€victimððs€losses.€€That€phraseÏavoids€a€double€recovery€by€tort€victims€andÏalso€removes€from€the€statute€any€collateralÏsource€that€has€subrogation€rights.€€WhereÏbenefits€carry€a€right€of€subrogation€and€a€legalÏobligation€on€the€part€of€the€tort€victim€to€repayÏthe€collateral€source,€the€tort€victimððs€lossesÏhave€not€been€replaced€or€indemnified.ÌÌò òòòNanceó óóó,€750€S.W.2d€at€743.€€ÌÌÓÓà àWe€view€the€decision€in€ò òòòNanceó óóó€as€dispositive€of€the€issue€beforeÏus.€€The€Med,€however,€contends€that€ò òòòNanceó óóó€is€distinguishable€becauseÏworkerððs€compensation€benefits€are€not€specified€in€the€statute,€whileÏsocial€security€benefits€are€so€specified.€€This€distinction€is€tenuous€atÏbest.€€The€ò òòòNanceó óóó€Court€held€that€workerððs€compensation€benefits€wereÏincluded€within€the€scope€of€the€statute,€even€though€not€specificallyÏlisted.€€Ìà àDefendant€also€asserts€that€pursuant€to€T.C.A.€€ðð€71„5„117,€theÏstate€has€only€a€right€of€subrogation,€and,€therefore,€if€the€recipient€ofÏthe€medical€assistance€cannot€recover,€the€state€cannot€recover.€€WeÏmust€respectfully€disagree.€€The€ò òòòNanceó óóó€Court€held€that€where€there€isÏa€right€of€subrogation,€or€a€legal€obligation€on€the€part€of€the€tortÏvictim€to€repay€the€collateral€source,€the€victimððs€losses€have€not€beenÍð ðreplaced€or€indemnified,ðð€and,€therefore,€the€benefits€so€paid€areÏrecoverable€by€the€plaintiff.€€We€fail€to€find€a€meaningful€distinctionÏbetween€the€nature€of€the€benefits€paid€in€ò òòòNanceó óóó€and€the€benefits€paidÏin€the€case€at€bar.Ìà àDefendant€argues€that€the€right€to€recover€the€amount€of€theÏMedicaid€payments€is€based€solely€on€subrogation€pursuant€to€T.C.A.€€ððÏ71„5„117,€and€that€since€the€recipientððs€claim€is€barred€by€T.C.A.€€ððÏ29„26„119,€there€can€be€no€claim€by€the€subrogee.€€Defendant€may€haveÏoverlooked€the€provisions€of€42€U.S.C.€œ1396a€(a)€›€œ25(A)›€which€mandatesÏthat€Medicaid€payments€to€a€tort€victim€should€be€borne€by€theÏtortfeasor€when€possible.€€The€effect€of€42€U.S.C.€€ðð€1396a€œ(a)€25(A)›Ïwas€considered€in€ò òòòHarlow€v.€Chinó óóó,€545€N.E.2d€602€(Mass.€1989),€whereÏthe€plaintiff€brought€a€medical€malpractice€action€against€a€doctorÏbased€on€the€doctorððs€failure€to€diagnose€a€herniated€disc€in€theÏplaintiffððs€back.€€Plaintiff€had€received€Medicaid€benefits€and€defendantÏargued€that€the€Medicaid€payments€constituted€collateral€sourceÏbenefits€under€the€Massachusetts€medical€malpractice€statute,€and,Ïtherefore,€plaintiff€could€not€recover€the€amount€of€the€MedicaidÏpayments€from€the€defendant.€€In€holding€that€the€amount€of€theÍMedicaid€payments€were€recoverable,€the€Supreme€Judicial€Court€ofÏMassachusetts€stated:ÌÓÓà8 àà8 àA€Federal€statute€requires€that€States€receivingÏFederal€funds€must€pursue€recovery€of€the€fundsÏfrom€legally€liable€third€parties.€€42€U.S.C.€€ððÏ1396a€(25)€(1982).€€A€Federal€regulationÏrequires€the€State€to€reimburse€the€FederalÏgovernment€a€proportion€of€such€recovery.€€AÏœState€statute€duly›€provides€for€recovery€fromÏthird€parties€and€subrogation€of€the€plaintiffððsÏclaim.€€ÌÌà8 àà8 àThe€defendants€argue€with€regard€to€MedicaidÏbenefits€that€there€is€no€right€of€subrogationÏð ðbased€in€any€federal€lawðð€within€the€meaningÏof€G.L.€c.€231,€€ðð€60G(c).€€We€disagree.€€TheÏFederal€statute€implementing€partialÏreimbursement€of€State€Medicaid€programsÏmandates€that€any€State€receiving€these€fundsÏmust€pursue€reimbursement€from€legally€liableÏthird€parties.€€The€fact€that€technically€a€StateÏstatute€provides€for€the€subrogation€isÏirrelevant.€€Because€the€Commonwealthððs€pursuitÏof€reimbursement€is€required€by€Federal€law,€theÏright€of€subrogation€is€ð ðbased€inðð€Federal€law.ÌÌ545€N.E.2d€at€610€œ(citations›€and€footnotes€omitted).œ× ƒ. ××  ×›ÌÌÓÓœà àAt›€issue€is€whether€the€Medicaid€program€or€the€defendant€healthÏcare€provider€should€bear€the€costs€of€Medicaid€payments€made€to€theÏinjured€tort€victim.€€Both€federal€law€and€T.C.A.€œðð›€71„5„117€requireÏreimbursement€of€Medicaid€payments€by€responsible€third€parties.€€InÏò
