Onappeal,Mr.Hurdleraisesnoissueconcerningthetemporaryinjunction.HearguesthatthetrialcourterredindenyinghisMotionforSummaryJudgment.OurreviewofthetrialcourtsdenialofMr.HurdlesMotionforSummaryJudgmentis denovo ontherecordbeforethisCourt,withnopresumptionofcorrectness. Carvellv.Bottoms ,900S.W.2d23,26(Tenn.1995).Fromourreviewofthiscaselaw,including Ashleyv.Volz ,218Tenn.420,404S.W.2d239(Tenn.1966)and Owensv.Church ,675S.W.2d178(Tenn.App.1984),andourreviewoftherecordinthiscause,itappearsthattherearematerialdisputedfactsthatrequiretheconsiderationofevidenceandtestimony.Therefore,thedenialofMr.HurdlesMotionforSummaryJudgmentisaffirmed.
