%P   ` Sincetheinsuredwasshottwicebydifferentpeople,theDistrictAttorneyemployedDr.ClelandBlake,aforensicpathologist,toreviewanautopsyanddeterminethefiringpatternofeachshotgun,andtoreviewcertaindocumentsandaffidavitsforthepurposeofrenderinganopinionastowhethertheinsuredsdeathwasaccidental. ` Dr.BlakeopinedthatthedeathofHortonwasaccidentalinthatitcouldnothavebeenanticipated becausehecouldnothaveseenthedirectionfrom 30/, whichtheweaponwasfired.HeopinedthatHortonsdeathwascausedbytheshotgunblastadministeredbyhisparamoursson.  ` Dr.Blakerestedhisopinion,inpart,upontheaffidavitofPatriciaLawsonwhodeposedthatsheandHortonhadarguedheatedlythenightbeforetheshooting,andthatthediscordcontinuedthefollowingmorning.AfterHortonleftthetrailershe pickedupa.12gaugeshotgunwhichwaskeptforprotectionfromdogsandwalkedtothedoorofthetrailer.WhenHortonwasabout30feetdistant,heyelledatherandshepointedtheshotgunathimandpulledthetrigger.AtthispointHortonwasabout90feetaway. ` Shethendeposedthatshethendroppedtheshotgunandbegantorun.BeforereachingthetrailerHortoncaughtherandtheyfelltotheground.Herson,Matthew,hada.410gaugeshotguninthetrailer.Shedeposedthathe grabbedthe.410gaugeshotgun,steppedfrombehindthedoor,placedtheguntothebackoftheheadofMichaelHortonandkilledhiminstantly.ShefurtherdeposedthatMichaelHortonwasonthegroundwithhisbacktothedoorwhentheyoungsonstoodwiththeshotgun,andthathedidnotknowtheyoungsonwaspresent,orthathehadashotguninhishands,andcouldnotseetheyoungmanandhadnowayofknowingthattheyoungmanwouldputtheguntothebackofhisheadandpullthetrigger.@-LAW -`(&  ` Thedistinctionbetweenaccidentaldeathandaccidentalmeanshas 0/*( beenabolishedinTennesseebythecaseofHowellv.MinnesotaLifeIns.Co., P1,* 937S.W.2d809(Tenn.1996).Thecontrollinglegalprincipleis ifdeathisthe p3., unanticipatedandunexpectedresultofanintentional,voluntaryact,itisaccidentalintheordinaryandplainsenseofthewordandrecoveryisavailableunderanaccidentaldeathinsurancepolicy.HoHowell.Harrell. 9 52  ` TheappellantarguesthatPatriciaLawsonsaffidavitisunreliablebecause  shecouldnotpossiblyhaveknownwhatMichaelHortonknewordidnotknowatthetimeofhisdeath;andfurther,thattheaffidavitofDr.Blakeistaintedbecausehebasedhisopinionconcerningaccidentaldeath,inpart,ontheunreliableaffidavitofLawson.Inthisconnection,wenotethatthetrialjudgescomment [h]eraffidavitisinconflictwithanotherstatementshemade.So,thereisacontroversyastothat. ` Atrialcourtmustdisallowtestimonyintheformofopinionorinferencewhentheunderlyingfactsordataindicatealackoftrustworthiness.McDanielv.  МCSXTransportation,Inc.,955S.W.2d257(Tenn.1997).Itisapparentthatthe   affidavitofPatriciaLawsoncontradictshertestimonygivenintheCriminalCourtthatsherememberedfewofthedetails,andisthusunreliable.Further,weholdthatDr.Blake,apathologist,wasunqualifiedtostatealegalopinion.See, 0 McCallv.Wilder,913S.W.2d150(Tenn.1995).IftheaffidavitofPatricia P  Lawsonisunreliable,itfollowsthattheaffidavitofDr.Blakeisalsounreliableexceptastomattersanautopsyrevealed.Moreover,supportingaffidavitsmustbemadeonpersonalknowledge,Rule56.06,andotherthandatarevealedbytheautopsy,Dr.BlakesopinionwasnotbasedThus,initspresentposture,thiscasepresentstheaffidavitofanexpert,someofwhoseopinionsarebasedonthefaciallycontradictory,andhenceunreliable,testimonyofPatriciaLawson.Atthisjunctureintheproceedings,thoseopinionsbasedastheyareonfaciallycontradictorytestimonyareinadmissibleandcannotbeconsideredbyusonsummaryjudgment.SeeByrdv.Hall,847swS.W.2d208,215 &"  16(Tenn.1993).Furthermore,totheextentthatDr.Blake,apathologist,afttemptstostatealegalopinion,helacksthenecesarynecessaryqualifictionstodoso.SeeMcCallv.Wilder,913swS.W.2d150(Tenn.1995).WeareleftwithDr. -`(& Blakesopinionsasapathologistregardingtheresultsoftheautopsy.Thissimplyexhibitsestonpersonalknowledge.ablishesthatthedecedentwasshotintheheadfromnbehind,anundisputedmaterialfact,butcertainlynotonethat,standingalone,issufficientto warrantsummaryjudgmentinthiscase. 50.  ` Thetrialjudgecommentedthat thedata[Dr.Blake]reliesonaredisputedandmaynotbereliable.Therefore,Ihaveaproblemwithhisdeterminationthatthedeathwasaccidental.Weagree.  ` Thiscaseisnotanappropriateoneforsummaryjudgment,becausethefactsandconclusionstobedrawntherefromdonotpermitareasonablepersontoreachonlyoneconclusion.See,Carvellv.Bottoms,900S.W.2d23(Tenn.
