Inthisactionfordamagesforpersonalinjuriestothedeceased,thecomplaintallegedthedeceased wasplacedinaroomwhileindefendanthospital,andonApril18,1991,shewasfoundlyingonthefloorwithinjuriesaboutherheadandface. Itwasfurtherallegedthat itwasnotlearneduntilwellafterherdeath,inconversationwiththephysiciansoftheplaintiffdecedent,thatthedecedentmorelikelywouldhavesurvivedformanyyearshadshenotfallen...   ThecomplaintwasfiledonApril23,1992,andtheTrialCourt,respondingtodefendantsmotionforsummaryjudgment,heldthatthestatuteoflimitationshadexpiredpriortothefilingofthisaction.Plaintiffhasappealed.  TherecordrelieduponbytheTrialJudgeincludedthediscoverydepositionofplaintiff,thehusbandofthedecedent.HerecountedwhatheobservedonthenightofApril18,1991.Hetestifiedthatashewasproceedingdownthehalltowarddecedentsroomheheardascream,andrecognizedittobehiswifesvoice.Herantotheroomandfoundherlyingonthefloorwithfoodalloverthefloor,bloodonthefloor,andthedeceasedinastateofpanic.Herelatedthatshewasstretchedoutandmovingherarmsandscreaming,andheobservedhernoseϜbleedingfromacutonhernoseandthe backofherheadwasbleedingatthestitches. Thedeceasedhadhadheadsurgerytoremoveatumor,andhadbeendischargedfromanotherhospitalonApril13,followingthesurgery,butwasbroughttodefendanthospitalandadmittedthroughtheemergencyroom,duetocomplicationsfromherdiabetes.Plaintifftestifiedthatafewhourslaterheremovedhiswifefromthehospitalbecausethedoctorhadnotarrivedtoadministertoher,andhetookhertoahospitalinKnoxvillefortreatmentandobservation.  ItisplaintiffspositionthathedidnotknowuntilhetalkedtothetreatingphysicianinKnoxvillewhorepairedtheshuntatthesitusofherbrainsurgery,onoraboutApril24,1992,thatthefallhadprecipitatedadislodgementoftheshunt,andcreatedadditionalproblemsfordeceased.  Plaintiffinsiststhatsummaryjudgmentwasinappropriatebecause thestatuteoflimitationsthatshouldhaveappliedwasnot2926116(a)(1),butrather,2926116(a)(2),whichsimplystates...intheeventtheallegedinjuryisnotdiscoveredwithinthesaidoneyearperiod,theperiodoflimitationshallbeoneyearfromthedateofsuchdiscovery. Wecannotagreethatthediscoverystatuteisapplicabletotheundisputedfactsofthiscase.Ϝ  BothpartiesciteandrelyonRoev.Jefferson,875S.W.2d653(Tenn.1994)fordifferentreasons.However,weagreethatRoecontrolsthecasebeforeus.TheRoeCourtsaidthatinamedicalmalpracticeactionthestatuteoflimitationsistolleduntiltheplaintiffdiscoveredorreasonablyshouldhavediscoveredthatabreachofdutybydefendantoccurredwhichproducedinjuries,citingFosterv.Harris,633S.W.2d304(Tenn.1980).TheCourtalsocitedHoffmanv.HospitalAffiliates,652S.W.2d341(Tenn.1983),whichheldthatthediscoverystatuteonlyappliesincaseswheretheplaintiffdoesnotdiscoverandreasonablycouldnotbeexpectedtodiscoverthatshehasacauseofaction.Id.at6567.TheCourtelaborated:0 0 Itisnotrequiredthattheplaintiffactuallyknowthattheinjuryconstituteabreachoftheappropriatelegalstandardinordertodiscoverthathehasa rightofaction ;theplaintiffisdeemedtohavediscoveredtherightofactionifheisawareoffactssufficienttoputareasonablepersononnoticethathehassufferedaninjuryasaresultofwrongfulconduct.Id.at657.  Inthiscase,plaintiffobservedthedeceasedhadfallenfromthebed,wasbleedingfromhernoseandthesurgicalsite,andwasinahighlyagitatedstate.Hisconcernwassuchthatheremovedhertoanotherhospitalfortreatmentthenextmorning.TheseundisputedfactsaresufficienttoputareasonablepersononnoticethatthedeceasedhadsufferedanϜinjuryfromallegedwrongfulconductofdefendant.Accordingly,thestatuteoflimitationsranfromthedateofinjury,andtheTrialCourtreachedthecorrectresult.Weaffirmthesummaryjudgmentgrantedtodefendant.
