ChristopherJohnsonwasarrestedforburglaryonSeptember21,1984.HewastriedandconvictedoffirstdegreeburglaryinthecourtofJudgeJosephDiRisio,andwassentencedtofifteenyearsimprisonmentonOctober15,1986.FollowingasubsequenttrialinthecourtofJudgeDouglasMeyer,thejuryfoundhimguiltyofanotherchargeofseconddegreeburglary,andonMay12,1987atenyearsentencewasimposedonhimforthatoffense,tobeservedconsecutivelytohisfifteenyearsentence,resultinginatotaleffectivesentenceoftwentyfiveyears.Mr.Johnsonwasunabletopostbond,andheremainedintheHamiltonCountyJailthroughouthistwotrialsandconvictions,untilhewastransferredtothepenitentiaryonMay3,1988.  JudgeMeyersjudgmentrecitedthattheappellantwouldbeallowedjailcredit fromandafterSeptember22,1984.WhenMr.Johnsonbeganservinghistimeinthepenitentiary,hereceived1,321daysofpretrialjailcredits,whichtheDepartmentofCorrectionappliedtowardshisinitialfifteenyearsentence.  Mr.Johnsonarguesthathewasentitledtoreceivecreditagainstbothsentencesforthetimehespentinjail,onthegroundthathewasentitledtoreceivesuchcreditsonhisfirstsentenceunderTenn.CodeAnn.4023101(b),andthatadditionallytheprovisionforjailcreditonMr.JohnsonssecondsentencebecamebindingontheDepartmentofCorrectiononceJudgeMeyersjudgmentbecamefinal,whetheranypartofthatjudgmentwaserroneousornot.  Tenn.CodeAnn.4023101(b)readsinrelevantpart: 0   0   Thetrialcourtshall,atthetimethesentenceisimposedandthedefendantcommittedtojail,theworkhouse,orthestatepenitentiaryforimprisonment,renderthejudgmentofthecourtsoastoallowthedefendantcreditonhissentenceforanyperiodoftimeforwhichhewascommittedandheldinthecityjail...pendinghisarraignmentandtrial.Thedefendantshallalsoreceivecreditonhissentenceforthetimeheservedinthejail,workhouseorpenitentiarysubsequenttoanyconvictionarisingoutoftheoriginaloffenseforwhichhewastried.         IfweweretoacceptMr.Johnsonsingeniousargument,hewouldreceivetwodaysofpenitentiarycreditforeachdayspentintheHamiltonCountyJail.However,theabovequotedstatutewasnotenactedtocreateagreaterbenefitforthosewhofacemultipletrialsthanforthosewhoareonlysubjecttoasingletrial.AstheCourtofCriminalAppealshasstated: 0   0   Thepurposeofthestatutewastoprovidejailtimecreditpriorandsubsequentlytoconvictionforindigentsunabletomakebond.Thelegislatureinitswisdomrecognizedaninjusticebetweenthepersonofmeanswhocouldmakebondandthepersonwhocouldnotandhadtolanguishinjail.Statev.Abernathy,649S.W.2d285,286(Tenn.Cr.App.1983).         WethereforefindthatMr.Johnsonreceivedallthebenefitthestatuteentitledhimtowhenhispenitentiarytimewasreduceddayfordaybyhistimeinjail.  IfthejudgmentinthesecondtrialcouldbeinterpretedtoallowMr.Johnsontoapplythesamejailtimetwicetoreducetwoconsecutivesentences(andwearenotconvincedthatitdoes),thenJudgeMeyersisentitledtocorrectthejudgmentforillegality,eventhoughithasbecomefinal,becauseithascontravenedthetermsofTenn.CodeAnn.4023101(b).SeeStatev.Burkhart,566S.W.2d871(Tenn.1978).@ II.   Theappellantalsoarguesthathedidnotreceivesentencereductioncreditsthathewasentitledtoforthetimehespentinjailafterhisconviction,priortohistransfertoStatecustody.WhileMr.Johnsonnotesthatthechancellorincorrectlystatedthathewasseekingsentencereductioncreditsfor pretrialjailtime,whenhewasactuallyseekingsuchcreditsforpostconvictionjailtime,thiserrordoesnotaffectthecorrectnessofthechancerycourtsdeterminationthathewasnotentitledtothereliefhesought.  Tenn.CodeAnn.4121236enablesinmatescommittedtothecustodyoftheDepartmentofCorrectiontoreceivesentencereductioncreditsforgoodinstitutionalbehavior.Anamendmenttothatstatuteaddedasectionthatextendedthesamesentencereductionprivilegesforthetimethataconvictedfelonwasincarceratedpriortosentencing(Acts1989,Ch.42,2).  HoweverthatsectionwasenactedafterMr.Johnsonwastransferredtothepenitentiary,andtheamendedsectioncontainsnosuggestionthatsentencereductioncreditsforpresentencingjailtimewastobeawardedretroactively.AsourSupremeCourthassaid, Alawwillnotbegivenaretrospectiveoperation,unlessthatintentionhasbeenmanifestedbythemostclearandunequivocalexpression.Hendersonv.Ford,488S.W.2d720,721(Tenn.1972),quotingJenningsv.Jennings,165Tenn.295,54S.W.2d961(1932).@ III.
