OnDecember14,1995,HusbandfiledamotiontocontinuethefinalhearingsetforJanuary3,1996onthegroundsthatheintendedtoappealthedecisionoftheGibsonCountyJuvenileCourtrelativetochildsupport.WhilethereisnoorderintherecordpertainingtotheHusbandsmotiontocontinue,itappearsthatthemotionwasdeniedastherewasahearingheldonJanuary3,1996. OnJanuary5,1996,WifefiledaMotiontoSpecifyPropertytobeSoldatPublicSale.InthismotionWifeacknowledgedthatonJanuary3,1996,thetrialcourt orderedthesaleofallmaritalpropertyatahearingheldonJanuary3,1995,includingthehome,Aerostarvanandotherpersonalproperty.HusbandthereafterfiledaResponsetoPlaintiffsMotiontoSpecifyPropertytobeSoldatPublic7 XXdXXd7Sale. OnFebruary23,1996,thechancellorenteredaFinalDecreeofDivorce,whichorderedthesaleofcertainmaritalassetsforthepurposeofpayingdebts.OnMarch18,1996,thetrialcourtenteredanorderdenyingWifesMotiontoSpecifyMaritalPropertytobeSold.OnMarch26,1996,thechancellorenteredanorderdismissingHusbandsMotionforRulingonPaternityafterhavingbeenwithdrawnbyHusband.Inthesameorder,thetrialcourtdeniedWifesMotionforCostsandAttorneyFees.OnApril24,1996,WifefiledherNoticeofAppealandCostBond,althoughinhernoticeofappealshedidnotdesignatethejudgmentfromwhichshewasappealing. Fromareviewofthisrecord,itappearsthattheFinalDecreeofDivorceenteredonFebruary23,1996,incorporatedbyreferencethefindingsintheInterimDecreeofDivorce.ItalsodividedthemaritalpropertyandawardedWifeacreditof$5,219.24inthemaritalproperty. ItappearstothiscourtthatthedecreeofthechancellorthatbroughtfinalitytotheproceedingswasthatenteredonFebruary23,1996.ThereforeWifesNoticeofAppealfiledonApril24,1996wasfiledbeyondthethirty(30)daytimeperiodsetforthinT.R.A.P.4(a).WealsonotethatWifefailedtofileanymotionforreliefpursuanttoRule60.02T.R.C.P.. InlightofthefactthatWifefailedtotimelyfilehernoticeofappealwehavenojurisdictionontheissuesraisedtherein.Accordingly,theappealmustbedismissed. Inlightoftheclarityofthesecircumstances,weareoftheopinionthatHusbandsrequestforcostsandattorneyfeesincurredbyhiminconnectionwiththisappealiswelltaken.Therefore,weawardthesecostsandexpensespursuanttoT.C.A.271122.Inconnectiontherewith,thismatterwillberemandedtotheChanceryCourtofGibsonCountyforahearinginthatcourttoascertainthenatureandamountofcostsandattorneyfeestobeawardedtoHusband.
