On31August1995,thetrialcourtdismissedthepetitionfindingthatpetitioner'spetitionforwritofcertiorariwasnottimelyfiled.Petitionerfiledatimelynoticeofappealastothetrialcourt'sdecision.Afterreviewingtherecord,weareoftheopinionthatthetrialcourtcorrectlyfoundthatthepetitionforcommonlawwritofcertiorariwasnottimelyfiled. TennesseeCodeAnnotatedsection279102providesthatthepetitionforwritofcertiorarimustbefiledwithinsixtydaysfromtheentryoftheorderorjudgmentcomplainedof.Thissixtydaytimelimitisajurisdictionalprerequisiteandappliesbothtocommonlawandstatutorywritsofcertiorari. PetitionercomplainsoftwoBoarddecisionsinthiscase.Thesearetherecisionofhisparolein1993andthedenialofparolein1995.Petitioner'sclaimastotherecisionofhisparoleisclearlytimebarred.PetitionerfiledthepetitionforwritofcertiorarinearlytwoyearsaftertheBoarddecidedtorescindpetitioner'sparole. Theviabilityofpetitioner'ssecondclaimismoredifficulttodetermine.In Jenningsv.Traughber ,No.01A019509CH00390,1996WL93763(Tenn.App.1996),thiscourtaddressedasimilarissue.Inthatcase,thiscourtdeterminedthatthedecisionoftheBoardwasnotfinaluntiltheBoardinformedtheinmatethatithaddeniedhisrequestforanappeal. Jennings ,1996WL93763,at*3.In Jennings ,asinthepresentcase,theBoardinformedtheinmatebyletter.ThiscourtusedthedateoftheletterasthedateoftheentryoftheBoard'sorder. Id.  Applyingthisanalysistothepresentcase,petitionerreceivedtheletterfromtheBoardinforminghimthatithaddecidedtodenyhisrequestforanappealon3February1995.Thus,thedatefromwhichthesixtydaysbegantorunwas3February1995.Petitionerfiledhiswriton19May1995,morethansixtydaysaftertheentryoftheBoard'sorder.Petitioner'spetitionwasnottimelyfiledandthetrialcourtcorrectlyfoundthatitdidnothavejurisdictiontohearthepetition.Thetrialcourtproperlydismissedthepetition.
