ðHusbandðð)€on€the€grounds€of€inappropriate€marital€conduct€andÏirreconcilable€differences.€€The€trial€court€granted€both€parties€a€divorce€and€orderedÏHusband€to€pay€$800.00€per€month€in€rehabilitative€alimony€for€eighteen€months.€€TheÏtrial€court€awarded€custody€of€the€partiesðð€three€minor€children€to€the€Husband€andÏordered€Wife€to€pay€child€support.€€Wife€was€awarded€the€Hadley€Street€duplexes,€andÏHusband€was€awarded€the€Limewood€residence,€the€Oak€Park€property€and€theÏClayphil€property.€€Each€party€was€allowed€to€keep€all€items€of€personal€propertyÏcurrently€held€in€their€possession.€The€trial€court€equally€divided›€the€partiesðð€account€atÏBoatmanððs€Bank€which€contained€the€partiesðð€remaining€fire€insurance€proceeds.€€The€Ïtrial€court€declined€to€award€Wife€a€portion€of€the€Husbandððs€retirement€account€andÏordered€each€party€to€pay€their€own€attorney€œfees.›€Husband€appeals€the€judgment€ofÏthe€court€below€arguing€that€the€trial€court€erred€in€its€division€of€the€real€property,€in€itsÏdivision€of€the€fire€insurance€proceeds,€and€in€its€award€of€rehabilitative€œalimony.€€€ForÏthe€reasons€stated€hereafter,€we€reverse€the€judgment€of€the€court€below€as€to€theÍaward€of€the€Clayphil€and€Hadley€properties€and€as€to€the€award€of€the€fire€insuranceÏproceeds€and€affirm€the€judgment€of€the€trial€court€in€all€other€respects.›ÌÌà@ àò òFACTSó óÌÌà àOn€June€14,€1989,€the€parties€œmarried›€and€on€March€19,€œ1993›€Wife€filed€forÏdivorce.€€œThis›€was€the€second€marriage€for€the€Husband€and€the€seventh€marriage€forÏthe€Wife.€€In€May€1996€at€the€time€of€trial,€Husband€was€sixty„four€years€of€age,€andÏWife€was€forty.€ÌÌà àHusband€attained€his€bachelorððs€€degree€in€architecture€from€the€University€ofÏIllinois€in€1958,€received€his€architecture€license€in€1963€and€earned€his€masterððsÏdegree€in€philosophy€from€Memphis€State€University€in€1974.€€œHusband›€taught€anÏarchitecture€class€at€State€Technical€Institute€of€Memphis€(ð ðState€Techðð)€for€seventeenÏœyears.›€Before€retiring€from€his€job€at€State€Tech,€Husbandððs€salary€was€approximatelyÏ$40,000.00€per€year.€ÌÌà àWife,€on€the€other€hand,€has€not€attained€any€college€degrees.€€Before€marryingÏHusband,€Wife€worked€as€an€architectural€draftsman€at€Professional€Service€IndustriesÏand€attended€Husbandððs€architecture€class€at€State€Tech.€€œAfter›€the€parties€married,ÏWife€quit€her€job€at€Professional€Service€Industries€and€began€working€part„time.€ÏœWifeððs›€jobs€during€the€marriage€included€working€in€Husbandððs€architecture€businessÏand€working€for€a€roofing€consultant€firm.€ÌÌà àWhile€working€for€the€Husbandððs€business,€Wife€drafted€plans,€performedÏelectrical€repairs,€and€served€as€the€administrator€of€certain€projects.€€œWife›€worked€forÏHusbandððs€business€in€1989,€1990,€1991€and€1992.€€œAt›€trial,€Husband€testified€that€theÏmost€he€ever€made€in€a€year€from€his€architecture€business€was€$10,000.00€and€thatÏWife€was€working€for€him€the€year€he€made€that€amount.€€œHusband›€further€testified€thatÏduring€the€years€that€Wife€worked€in€his€business€she€performed€less€than€fifty€percentÏof€the€work.€€Wife€was€not€paid€a€salary€for€the€work€she€performed€for€HusbandððsÏbusiness.€€ÌÌà àœThe€parties€were€married€thirty€days€after€Wife€received€a€divorce€from€her€sixthÏhusband.€Upon€divorcing€her€sixth€husband€and€marrying€her€seventh€husband,ÏWifeððs€assets€included€a€$2,100.00€to€$2,500.00€savings€account,€stereo€equipment,Ïtelevisions,€a€bedroom€suite,€sofas€and€other€furniture.€ÌÌà àUpon€entering€the€marriage,€Wife€had€two€minor€children€from€previousÏmarriages,€ages€10€and€12.›€œShortly›€after€the€marriage,€Wifeððs€œsister,€who€lived€inÏAlabama€with€her€three€minor€children,€informed›€œWife›€that€she€could€œno€longer€supportÏher€children.›€€After€visiting€the€€three€œchildren,€a€four€year€old€and€1€year€old€twins,›ÏHusband€and€Wife€decided€that€they€wanted€to€care€for€them.€€œIn›€December€œ1989,€theÏthree€children›€were€placed€in€the€physical€custody€of€Husband€and€Wife.€€œLater,›€œinÏJune›€1991,€Husband€and€Wife€œadopted€Wifeððs€sisterððs€three€minor€children.Ìà àÌà àInstead€of€sending€the€children€to€public€schools€during€the€first€of€the€marriage,ÏWife€taught€the€children€at€home.€€During€the€latter€part€of€the€marriage,€€the€partiesÏsent€the€children€to€public€schools,€and€Wife€monitored€the€childrenððs€progress€withÏtheir€homework.€ÌÌà àBefore€the€partiesðð€marriage€in€February€1987,€Husband€acquired€the€Oak€ParkÏproperty.€€At€the€time€of€the€marriage€in€June€1989,€the€mortgage€balance€due€on€theÏproperty€was€$64,396.29.€€After€the€partiesðð€marriage,€Husband€paid€a€portion€of€theÏ$64,396.29€mortgage€on€the€Oak€Park€property€with€marital€assets.€€However,ÏHusband€testified€that€he€paid€the€majority€of€the€$64,396.29€mortgage€balance€withÏproceeds€from€his€own€separate›€retirement€income.€œSometime›€in€1993,€Husband€paidÏthe€entire€mortgage€balance€on€the€Oak€Park€property.€ÌÌà àDuring€the€marriage,€Wife€helped€maintain€the€Oak€Park€property.€€œWife›€sweptÏthe€property€when€it€flooded,€fixed€an€electrical€outlet€and€repaired€the€air€conditionerÏon€the€property.€€œAt›€trial,€the€parties€stipulated€that€this€property€had€a€market€value€ofÏ$76,000.00€and€that€this€property€was€without€a€mortgage.€Ìà àÌà àSeven€months€before€the€marriage€in€November€1988,€Husband€purchased€theÏClayphil€property.€œWife›€testified€that€since€the€marriage€in€June€1989,€all€mortgageÏpayments€on€the€Clayphil€property€have€been€made€from€joint€marital€funds.€€WifeÏfurther€testified€that€she€performed€extensive€work€on€the€Clayphil€property€throughoutÏthe€course€of€the€marriage€including€painting,€cleaning,€mowing€the€lawn,€building€aÍfence,€clearing€the€land€and€performing€the€plumbing,€electrical€and€air€conditioningÏrepairs.€€œThe›€parties€stipulated€that€the€market€value€of€the€Clayphil€property€wasÏ$54,000.00€and€that€the€mortgage€on€the€property€was€$41,000.00.€€ÌÌà àIn€September€1989,€Husband€purchased€the€residence€located€at€6358ÏLimewood.€€€œHusband›€paid€$25,000.00€in€cash€as€a€down€payment€on€the€propertyÏand€signed€a€$5,000.00€promissory€note.€€œThe›€$25,000.00€cash€down€payment€on€theÏproperty€came€from€the€separate€funds€of€the€Husband€except€for€$2,000.00€toÏ$3,000.00€which€came€from€the€Wifeððs€separate€property.€€œThe›€Limewood€residenceÏbecame€the€primary€marital€residence€of€the€parties.€€€œMoreover,›€the€LimewoodÏresidence€has€been€the€only€house€wherein€Allen,€Dusty€and€Sandy€have€lived€sinceÏthey€have€resided€with€the€parties.€ÌÌà àDuring€the€marriage,€Wife€helped€maintain€the€Limewood€property.€€œWife›Ïpainted,€wallpapered€the€bathrooms,€installed€new€countertops,€and€helped€superviseÏthe€enclosure€of€the€carport€and€the€addition€of€a€bedroom€onto€this€residence.€€œAt›€trial,Ïthe€stipulated€market€value€of€the€Limewood€property€was€$62,500.00;€and€theÏmortgage€on€the€property€was€$32,500.00.€ÌÌà àIn€September€1992,€the€parties€purchased€two€duplexes€on€Hadley€Street.€€PartÏof€the€money€for€the€purchase€of€the€Hadley€property€came€out€of€the€partiesðð€jointÏaccount,€and€$46,500.00€of€the€purchase€price€for€the€Hadley€property€came€from€theÏsale€of€Husbandððs€separate€property€on€Finley€Street.€€œHowever,›€before€the€FinleyÍStreet€property€was€sold,€Wife€testified€that€she€helped€maintain€the€Finley€propertyÏand€that€marital€funds€were€used€to€repair,€remodel,€paint€and€install€sewer€lines€onÏthe€Finley€property.€€ÌÌà àWife€also€helped€maintain€the€Hadley€property.€€Wife€painted€the€Hadley€StreetÏduplexes,€helped€with€the€yard€work€and€collected€the€rent.€€œAccording›€to€the€testimonyÏadduced€at€trial,€the€market€value€of€the€two€Hadley€duplexes€was€$77,000.00;€and€theÏjoint€mortgage€on€the€two€Hadley€properties€was€$25,000.00.€ÌÌà àœThe›€day€after€Thanksgiving€œ1992,›€the€partiesðð€home€on€Limewood€caught€fire.€ÏœThe›€parties€thereafter€received€approximately€$58,500.00€in€insurance€proceeds€fromÏtheir€insurance€company€to€compensate€them€for€the€damage€from€the€fire.€€œPrior›€toÏtrial,€approximately€$40,000.00€in€fire€insurance€proceeds€was€divided€betweenÏHusband€and€Wife€for€different€items€that€were€lost€in€the€fire.€€œAt›€the€time€of€trial,Ïapproximately€$23,000.00€of€the€partiesðð€fire€insurance€proceeds€remained€in€theÏparties€joint€bank€account.€ÌÌà àHusband€testified€that€$30,488.50€of€Wifeððs€separate€personal€property€wasÏdestroyed€by€the€fire€and€that€prior€to€trial€Wife€had€received€$30,820.50€in€fireÏinsurance€proceeds.€€œHusband›€further€testified€that€$33,097.50€of€his€separateÏpersonal€property€was€destroyed€by€the€fire€and€that€prior€to€trial€he€had€receivedÏ$9,160.50€in€fire€insurance€proceeds.€ÌÌà àDuring€the€marriage,€rent€money€from€the€partiesðð€rental€property€went€into€theÏpartiesðð€joint€account.€ÌÌà àAt€trial,€Wife€testified€that€she€helped€maintain€the€Clayphil€property,€the€OakÏPark€property€and€the€œFinley›€Street€property€prior€to€the€marriage.€€œHowever,›€whenÏHusband€was€asked€how€much€the€Oak€Park,€the€Clayphil,€the€Limewood,€the€œFinley›Ïand€the€Hadley€Street€properties€œhad€increased›€in€value€during€the€marriage€due€toÏthe€work€that€Wife€had€expended€on€the€properties,€Husband€testified€that€according€toÏhis€tax€records,€the€property€values€either€remained€constant€or€declined€during€theÏmarriage.€ÌÌà àNonetheless,€during€the€marriage,€Wife€served€as€the€primary€caretaker€for€theÏchildren,€and€Husband€worked€in€his€architecture€œbusiness.€Wife€also›€œcontinued›€herÏarchitectural€schooling€at€Memphis€State€University€throughout€part€of€the€marriage.€€InÏAugust€1992,€Wife€withdrew€from€her€classes€at€Memphis€State€University€due€toÏcomplications€with€her€pregnancy.€œÌÌà àAt›€trial,€Wife€requested€that€the€court€award€her€$800.00€per€month€inÏrehabilitative€alimony.€œWife›€stated€that€such€an€award€would€enable€her€to€completeÏher€college€education€and€attain€a€bachelor€of€science€degree€in€architecturalÏtechnologies.€€With€a€bachelorððs€degree€in€architectural€technologies,€Wife€could€thenÏacquire€her€architectððs€license.€ÌÌà àAt€the€time€of€trial,€Husband€had€retired,€and€Wife€was€working€as€a€temporaryÏemployee€at€St.€Judeððs€Research€Hospital€making€fourteen€dollars€per€hour.€€€Due€toÏher€temporary€status€at€the€hospital,€Wifeððs€job€was€scheduled€to€terminate€on€June€30,Ï1996.€€Ìà@ àò òLAWó óÌÌà àœThe€following›€three€œissues€are›€before€this€œCourt:›Ìà à1)€Whether€the€trial€court€erred€in€its€division€of€the€real€property;Ìà à2)€Whether€the€trial€court€erred€in€its€division€of€the€fire€insurance€proceeds;€andÌà à3)€Whether€the€trial€court€erred€in€awarding€the€Wife€rehabilitative€alimony€in€theÏamount€of€$800.00€per€month€for€eighteen€months.ÌÌà àIn€actions€for€divorce,€courts€shall€ð àIn€accordance€with€T.C.A.€ðð€36„4„121(c)(1),€trial€courts€consider€the€duration€ofÏthe€marriage€when€making€an€equitable€division€of€marital€property.€€In€cases€involvingÏa€marriage€of€relatively€short€duration,€it€is€appropriate€to€divide€the€property€in€a€wayÏthat,€as€nearly€as€possible,€places€the€parties€in€the€same€position€they€would€haveÏbeen€in€had€the€marriage€never€taken€place.€€òòBatsonóó,€769€S.W.2d€at€859.€€ÌÌà àAs€this€Court€stated€in€òòBatsonóó,€each€spouseððs€contributions€to€the€accumulationÏof€assets€during€the€marriage€is€an€important€factor€when€a€relatively€short€marriage€isÏinvolved.€€òòIdóó.€€€When€a€marriage€is€short,€the€significance€and€value€of€a€spouseððs€non„monetary€contributions€is€diminished,€and€claims€by€one€spouse€to€another€spouseððsÏseparate€property€are€minimal€at€best.€€€òòIdóó.€€€ÌÌà àœà8 à(A)›€All€real€and€personal€property€owned€by€a€spouseÏbefore€marriage;Ìà8 àœà8 à(B)›€Property€acquired€in€exchange€for€property€acquiredÏbefore€the€marriage;Ìà8 àœà8 à(C)›€Income€from€and€appreciation€of€property€owned€by€aÏspouse€before€marriage€except€when€characterized€asÏmarital€property€under€subdivision€(b)(1);€andÌà8 àœà8 à(D)›€Property€acquired€by€a€spouse€at€any€time€by€gift,Ïbequest,€devise€or€descent.€€ÌÌT.C.A.€ðð€36„4„121(b)(2)€(1996).ÌÌà àÌÌà àœT.C.A.›€ðð€36„4„121(b)(1)€defines€marital€property€as:ÌÌà8 àœà8 àall›€real€and€personal€property,€both€tangible€and€intangible,Ïacquired€by€either€or€both€spouses€during€the€course€of€theÏmarriage€.€.€.€[including]€income€from,€and€any€increase€inÏvalue€during€the€marriage€of,€property€determined€to€beÏseparate€property€in€accordance€with€subdivision€(b)(2)€ifÏeach€party€substantially€contributed€to€its€preservation€andÏappreciation.ÌÌÌÓÓà àIn€accordance€with€the€statute,€marital€property€includes€the€increase€in€value€ofÏseparate€property€ð àBecause€Husband€acquired€title€to€the€Oak€Park€property€over€two€years€beforeÏthe€partiesðð€marriage€in€February€1987€and€paid€the€majority€of€the€remainingÏ$64,396.29€mortgage€on€the€property€after€the€marriage€with€proceeds€from€his€ownÏseparate€retirement€account,€the€trial€court€did€not€err€in€awarding€the€Oak€ParkÏproperty€to€Husband.€€ÌÌà àSimilarly,€the€trial€court€did€not€err€in€awarding€the€Limewood€residence€toÏHusband.€€At€trial,€the€parties€had€accrued€$30,000.00€in€equity€in€the€LimewoodÏproperty.€€Upon€purchasing€the€property€in€September€1989,€Husband€paidÏ$25,000.00€as€a€cash€down€payment€on€the€property€and€signed€a€$5,000.00Ïpromissory€note.€€With€the€exception€of€$2,000.00€to€$3,000.00€which€came€from€theÏWifeððs€separate€property,€Husband€paid€the€entire€€$25,000.00€cash€down€paymentÏwith€his€own€separate€property.€€Thus,€because€the€œmajority›€of€the€equity€in€theÏLimewood€residence€came€from€the€Husbandððs€separate€property,€the€trial€court€didÏnot€err€in€awarding€the€Limewood€estate€to€the€Husband.€€ÌÌà àœWe›€œdisagree,€however,›€with€the€trial€courtððs€award€of€the€Clayphil€and€HadleyÏproperties.€€The€parties€purchased€the€two€duplexes€on€Hadley€Street€during€theÏmarriage€in€September€1992.€€€At€trial,€the€parties€had€accrued€$52,000.00€in€equity€inÏthe€two€Hadley€duplexes.€€€A€total€of€$46,500.00€of€the€equity€in€the€Hadley€propertiesÏcame€from€the€sale€of€Husbandððs€separate€property€on€Finley€Street.€€Moreover,ÏHusband€purchased€the€Clayphil€property€seven€months€before€the€marriage€inÍNovember€1988.€€Since€the€partiesðð€marriage€in€June€1989,€all€mortgage€payments€onÏthe€Clayphil€property€have€been€œpaid€with›€joint€marital€funds.€€At€the€time€of€trial,€theÏparties€had€accrued€$13,000.00€in€equity€in€the€Clayphil€property.€€Because€of€theÏshort€duration€of€the€partiesðð€marriage,€because€the€majority€of€the€equity€in€the€HadleyÏproperties€came€from€the€sale€of€Husbandððs€separate€property€on€Finley€Street,€andÏbecause€most€of€the€equity€in€the€Clayphil€property€came€from€the€partiesðð€maritalÏproperty,€we€hold€that€an€award€of€the€two€Hadley€duplexes€to€the€Husband€and€anÏaward€of€the€Clayphil€property€to€the€Wife€would€provide€for€a€more€equitableÏdistribution€of€the€partiesðð€marital€property.€€We,€therefore,€reverse€the€order€of€the€trialÏcourt€as€to€the€awards€of€the€Clayphil€and€Hadley€properties.ÌÌà àAccording€to€the€testimony€adduced€at€trial,€$30,488.50€of€Wifeððs€separateÏpersonal€property€was€destroyed€by€the€fire€of€the€partiesðð€Limewood€residence,€andÏWife€has€received€$30,820.50€in€fire€insurance€proceeds.€€A€total€of€$33,097.50€ofÏHusbandððs€separate€personal€property€was€destroyed€by€the€Limewood€fire,€andÏHusband€has€received€$9,160.50€in€fire€insurance€proceeds.€€€Based€on€the€foregoingÏtestimony,€we€hold€that€the€trial€court€erred€in€equally€dividing€the€partiesðð€account€atÏBoatmanððs€Bank€which€contained€the€partiesðð€remaining€fire€insurance€proceeds€fromÏthe€Limewood€fire.€€We€hold€that€all€remaining€fire€insurance€proceeds€shall€go€to€theÏHusband.€€ÌÌœà àT.C.A.€ðð€36„5„101(d)(1)€provides€as€follows:ÌÓÓà8 àà8 àIt›€is€the€intent€of€the€general€assembly€that€a€spouse€who€isÍeconomically€disadvantaged,€relative€to€the€other€spouse,Ïbe€rehabilitated€whenever€possible€by€the€granting€of€anÏorder€for€payment€of€rehabilitative,€temporary€support€andÏmaintenance.€€Where€there€is€such€relative€economicÏdisadvantage€and€rehabilitation€is€not€feasible€inÏconsideration€of€all€relevant€factors,€including€those€set€outÏin€this€subsection,€then€the€court€may€grant€an€order€forÏpayment€of€support€and€maintenance€on€a€long„term€basisÏor€until€the€death€or€remarriage€of€the€recipient€.ÌÌÓÓAs€noted€by€the€supreme€court€in€òòSelf€v.€Selfóó,€861€S.W.2d€360,€361€(Tenn.€1993),ÏT.C.A.€ðð€36„5„101(d)(1)€reflects€a€clear€legislative€intent€to€allow€an€award€forÏpermanent€alimony€only€ð ðwhen€the€court€granting€the€divorce€finds€that€the€economicÏrehabilitation€is€not€feasible€and€long„term€support€is€necessary.ðð€€€ÌÌà àœIn›€determining€whether€the€granting€of€an€order€for€payment€of€support€andÏmaintenance€to€a€party€is€proper,€the€court€shall€consider€all€relevant€factors,€including:ÌÓÓœà8 àà8 à(A)›€The€relative€earning€capacity,€obligations,€needs,€andÏfinancial€resources€of€each€party,€including€income€fromÏpension,€profit€sharing€or€retirement€plans€and€all€otherÏsources;Ìœà8 àà8 à(B)›€The€relative€education€and€training€of€each€party,€theÏability€and€opportunity€of€each€party€to€secure€suchÏeducation€and€training,€and€the€necessity€of€a€party€toÏsecure€further€education€and€training€to€improve€suchÏparty's€earning€capacity€to€a€reasonable€level;Ìœà8 àà8 à(C)›€The€duration€of€the€marriage;Ìœà8 àà8 à(D)›€The€age€and€mental€condition€of€each€party;Ìœà8 àà8 àBecause€Wife€œwas€forty€years€old›€at€the€time€of€trial€and€capable€ofÏrehabilitation,€we€hold€that€the€trial€court€did€not€err€in€awarding€Wife€$800.00€perÏmonth€in€rehabilitative€alimony€so€that€she€could€attain€a€bachelor€of€science€degree€inÏarchitectural€technologies€and€acquire€an€architectððs€license.€€ÌÌà àThe€judgment€of€the€trial€court€is€hereby€reversed€as€to€the€trial€courtððs€award€ofÏthe€Clayphil€and€Hadley€properties€and€as€to€the€trial€courtððs€award€of€fire€insuranceÏproceeds€œand€the€judgment€of€the€trial€court›€is€hereby€affirmed€in€all€other€respects.€ÏCosts€on€appeal€shall€be€divided€equally€œbetween€parties.ÌÓÓà
