Inthisaction,plaintiffseeksuninsuredmotoristcoveragefromherinsurancecompany,andtheTrialCourt,respondingtomotionforsummaryjudgment,grantedjudgmenttodefendantAllstateInsuranceCompany(Allstate).Plaintiffhasappealed.   Plaintiffhasraisedtwoissuesonappeal:0 0 1.0 WhethertheTrialCourterredingrantingsummaryjudgmentholdingthattheinsureddidnotcomplywiththetermsofherinsurancepolicythatshe promptlysend(Allstate)copiesofthelegalpapersifasuitisbrought. 0 0 2.0 WhethertheTrialCourterredingrantingsummaryjudgmentbyitsrulingthattheoneyearstatuteoflimitationshadrunastoAllstate.  TheautomobileaccidentgivingrisetothiscaseoccurredonJune16,1993,andplaintifffiledsuitagainsttheotherdriveronJune2,1994,withprocessservedonthosedefendantsonJune6,1994.OnOctober6,1994,plaintiffobtainedanorderfromtheTrialJudgeforprocesstoissueandbeserveduponAllstateInsuranceCompany,whichprocesswasservedupontheDepartmentofCommerceandInsuranceonOctober12,1994,andsubsequentlyfurnishedtoAllstatebytheDepartment.Allstatemovedforsummaryjudgmentonthegroundsthatplaintiffhadfailedtocomplywiththepolicyprovisionsandthatthestatuteoflimitationshadrunonanactionagainstit.  Thepertinentpolicyprovisionis:0 0 Apersonseekinguninsuredmotoristcoveragemustalso:...2.Promptlysenduscopiesofthelegalpapers,ifasuitisbrought.TherecordrevealsthattheinsurancecompanywasfirstfurnishedcopiesofthesuitpapersbytheStateofTennesseesDepartmentofInsurance.Inresponsetothemotionforsummaryjudgment,theplaintifffiledheraffidavitwhichstates:0 0 VeryshortlyaftermyaccidentwhichoccurredonJune16,1993,Iadvisedmyinsuranceagent,HowardYates,agentforAllstateInsuranceCompany,andcompliedwitheveryrequestmadebyAllstateInsuranceCompany.Inaddition,theinsurancecarrierpaidmedicalexpensesonmybehalfincidenttotheaccident.AftersuitwasfiledandservicewashadontheDefendants,IwasadvisedbymyattorneythatapparentlytheDefendantsVancehadnoinsuranceandupontheadvise[sic]ofmyattorneyAllstateInsuranceCompanywasmadeapartytomycase.  Plaintiffoffersnoexcuseforfailuretosendcopiesofthesuitpaperstoherinsurancecompany,andonappeal,arguesthatsincenoprejudicehasbeendemonstratebytheinsurancecompany,thatcoverageshouldbeafforded.  Thisjurisdictionhaslongheldthatconditionstobeperformedbytheinsuredareconditionsprecedenttoactivatingcoverageunderthepolicy.See,e.g.,HartfordAccidentandIndemnityCo.,v.Creasy,530S.W.2d778(Tenn.1975).Thisrulehasbeenappliedtovariousconditionsinpoliciesofinsurance,andourcourtshaveuniformlyheldthatthelackofprejudiceonthefailuretocomplywiththepolicyprovisionisnotgroundstoexcusenoncompliancewiththepolicyprovision.ThisCourthascriticizedthisrule.SeeNorthRiverIns.Co.,v.Johnson,757S.W.2d334(Tenn.App.1988).ThisCourthadoccasiontoconsidertheconditioncontainedinthispolicyinWhaleyv.Underwood,922S.W.2d110(Tenn.App.1995),wherethedelayinfurnishingcopiesofthe legalpapers wasdelayedsome27months.Again,theCourtappliedtheruleasrequiredundertheholdingsoftheTennesseeSupremeCourt.AstheWhaleycourtnoted,wehaveadoptedthedefinitionofpromptasdiscussedin44Am.Jur.2dInsurance1330,whichsimplymeansthat noticemustbegivenwithinareasonabletimeunderthecircumstancesofthecase. Withnoothercircumstancesappearinginthecasebeforeus,itcannotbesaidthatadelayof41/2monthsinfurnishingthelegalpapersisprompt.Accordingly,weareconstrainedtoaffirmtheTrialJudgesgrantofsummaryjudgmentuponthefailureoftheplaintifftocomplywiththetermsofherpolicywiththedefendantinsurancecompany.  Wefinditunnecessarytoaddresstheremainingissues,sincethisissueisdeterminativeoftheappeal.
