ThePlaintiffinthiscaseseekstomodifyanagreeddivorcedecreerelativetothesupportandcustodyofahandicappedchild,whohasnowreachedhermajority.  I.FACTS    Thepartiestothisappealareparentsofahandicappedadult,ShannonKilby.Shannonhadastokewhenshewaslessthanayearold,isblind,mentallyretarded,andrequiresconstantcare.Shereachedher18thbirthdayonAugust26,1995,approximately15monthsafterherparentsweredivorcedinMay1994.Theiragreedfinaldecreeprovidedasfollows:     Thatthepartiesshallbeawardedjointcustodyofthepartiesminorchild,ShannonKilby.ThattheDefendantshallbeentitledtohavethechildeveryotherweek. ThattheDefendantshallpayuntothePlaintiffthesumofTwoHundredDollars($200.00)perweekaschildsupportforeachweekthatthePlaintiffhasthesaidchild.ThatthesupportobligationoftheDefendantshallbereducedorterminatedwhenthechildqualifiesfordisabilityorsocialsecuritybenefits. ThattheDefendantshallprovidehospitalizationinsurancecoverageforthepartieschildandeachpartyshallpayonehalf(1/2)ofallmedicalanddentalexpensesincurredonbehalfofsaidchildnotcoveredbyinsurance.      Followingthedivorce,thepartiesneverstrictlyadheredtothevisitationsetforthinthedivorcedecree.Atfirst,theyeachassumedphysicalcustodyofShannonfortwoweeksatatime;thenthetimeincreasedtofourweeksforeach.Later,MotherrequestedFatherkeepShannonforsixweeksatatime.TestimonyintherecordindicatesthatShannonwouldgetupsetaboutbeingmovedandthatinfrequentchangeswerebeneficialtoherandtohercaregivers.  ShortlyafterShannonbecame18yearsofage,FathertookhertohisfarminLiberty,Tennessee,whereshewasmainlycaredforbyheroldersister,April.AprilhascaredforShannonsinceShannonwasbornandthesistersareveryclose.ShannonstayedatthefarmfromAugust25,1995,untilNovember21,1995,whenMothercametopickherup.   FatherhadtoldAprilthatMotherwasnottopickupShannonwithouthisconsent.WhenMothercametopickupShannoninNovember1995,MotherhadnotifiedneitherFathernorAprilthatMotherintendedtopickupShannon.MotherjustappearedandplacedShannoninhercar.AprilsliveinboyfriendthenremovedShannonfromthecarandtookherbackintothehouse.Atthatpoint,aphysicalconfrontationoccurredbetweenMotherandAprilsboyfriendwiththeresultthatMotherreturnedatmidnightwithpoliceandhadShannonremovedfromthehouse.TherecordindicatesthatMotherandAprilwerenotcloseandthatAprillivedwithherFatherduringtheparties'separationandsubsequentdivorce.  WhenShannonbecame18,FathermadeappointmentswiththeSocialSecurityofficeforMothertoapplyonbehalfofShannonforSocialSecuritybenefits.Motherdidnotkeepthoseappointments.WhileFatherhadcustodyofShannon,hesuccessfullyobtainedSocialSecuritydisabilitybenefitsforShannon.CommencingonNovember8,1995,ShannonbeganreceivingSSIbenefitsof$313monthly.FatheropenedajointaccountforhimselfandShannonanddepositedShannonsSSIchecksintotheaccount.Testimonyintherecordindicatesthattheamountintheaccountcannotexceed$1800.FatherwithdrewmoneyfromtheaccounttopurchaseShannonsclothes,haveherhairstyled,payforhermedicineandtopurchaseothergoodsandservicesforShannonsbenefit.FathergaveMotherandAprilmoneyforkeepingShannon.   TherecordisunclearastoFathersexactworkschedule.FatherwouldcometothefarmtospendtimewithAprilandShannononthedayshewasnotworking.Healsowouldspendallhisvacationtime(fiveweeksduring1995)atthefarmwhileShannonwasthere.   EachpartydisputesthequalityofcarethatShannonreceivesfromtheother,althoughMotheradmitsthatFathertakesgoodcareofShannonwhenhehasher.TherecordindicatesthatMother'sopinionofthequalityofcareAprilprovidesforhersisterwhenShannonliveswithheronthefarm,stemsfromtheriftwhichoccurredbetweenAprilandhermotherpriortoherparents'divorce.Itisundisputed,however,thatwhenAprillivedathomewitheitherherMotherorherFather,thatAprilprovidedqualitycareforShannon,thatAprilloveshersisterandthattheygetalongwell.   OnJanuary9,1996,MotherfiledapetitionintheBlountCountyChanceryCourtseekingfullcustodyofShannon.FatherrespondedseekingsolecustodyofShannonandchallengedwhethereitherpartycouldclaimcontinuinglegalcustodyofShannonbeyondher18thbirthdaywithouthavingsoughtadecreeoflegalcustody,guardianshiporconservatorship.  TheCourtdeterminedthatitstillpossessedjurisdictioninthismatterasaresultofthedivorce,foundthatShannonKilbywasdependantuponherparentsandplacedsolecustodyofShannonwithMother.TheCourtawardedFathervisitationonthedayshewasnotworkingprovidedhegaveadvancenotice;however,ifthepartiescouldnotagreeuponavisitationschedule,thenFatherwouldhavestandardvisitation.Fatherwastopay$800permonthchildsupportandprovidehospitalizationinsuranceforShannon.Anymedicalexpensesnotcoveredbyinsuranceweretobesplitevenly.ThematterofarrearageinchildsupportwasreferredtotheClerk&Masteras  5  m u` SpecialMaster. r     Afterthedecisionwasrendered,FatherfiledamotionfortheCourttoreconsideritsordertopaychildsupportforahandicappedchild.ThemotionwasoverruledbytheCourtandthisappealensued.  II.ISSUES    TheAppellantpresentstwoissuesforourreview,whichweshallrephraseasfollows:    DidtheChancellorerrinmodifyingprovisionofthefinaldecreeprovidingforjointcustodyofShannon,whoisnowahandicappedadult,fixingsolecustodyinthemotherandawardingMotherchildsupportwithouthavinganyevidenceastothepresentneedsofthehandicappedadult?  III.THELAWANDDISCUSSION    PursuanttoRule13(d)oftheTennesseeRulesofAppellateProcedure,ourreviewoffindingsoffactisdenovoupontherecordoftheChanceryCourt,accompaniedbyapresumptionofthecorrectnessoftheChancellor'sfindings,unlessthepreponderanceoftheevidenceisotherwise.However,thepresumptiondoesnotattachinacase,wherethefactsareundisputed,andonlyaquestionoflawispresented.UnionCarbideCorp.v.Huddleston,854S.W.2d87(Tenn.1993).    Additionally,theconstructionofastatuteisaquestionoflawwhichwereviewdenovo,withnopresumptionofcorrectness.Ourroleinconstruingstatutesistoascertainandgiveeffecttothelegislativeintentwithoutundulyrestrictingorexpandingastatute'scoveragebeyonditsintendedscope.Rosemanv.Roseman,890S.W.2d27(Tenn.1994).Thelegislativeintentistobeascertainedwheneverpossiblefromthenaturalandordinarymeaningofthelanguageused,withoutforcedorsubtleconstructionthatwouldlimitorextendthemeaningofthelanguage.CarsonCreekVacationResorts,Inc.v.StateDepartmentofRevenue,865S.W.2d1(Tenn.1993).Wewillconsiderthestatutoryissuesinthisappealwiththesestandardsinmindininterpretingthestatuteswhichhavebeenbroughttoourattention.  ApparentlytheChancellordeterminedthatheretainedtheauthoritytomodifyoralterthepriordecreeandordersofthecourt,inregardtocustodyofShannon,pursuanttoT.C.A.366101which,aspertinenthere,readsasfollows:     366101.DecreeforcustodyandsupportofchildτEnforcementJuvenilecourtjurisdictionτPresumptionofparentalfitnessEducationalseminars.  (a)(1)Inasuitforannulment,divorceorseparatemaintenance,wherethecustodyofaminorchildorminorchildrenisaquestion,thecourtmay,notwithstandingadecreeforannulment,divorceorseparatemaintenanceisdenied,awardthecare,custodyandcontrolofsuchchildorchildrentoeitherofthepartiestothesuitortobothpartiesintheinstanceofjointcustodyorsharedparenting,ortosomesuitableperson,asthewelfareandinterestofthechildorchildrenmaydemand....Suchdecreeshallremainwithinthecontrolofthecourtandbesubjecttosuchchangesormodificationastheexigenciesofthecasemayrequire.... (b)Notwithstandinganyprovisionofthissectiontothecontrary,theparty,orparties,orotherpersonawardedcustodyandcontrolofsuchchildorchildrenshallbeentitledtoenforcetheprovisionsofthecourt'sdecreeconcerningthesuitablesupportofsuchchildorchildrenintheappropriatecourtofanycountyinthisstateinwhichsuchchildorchildrenreside;provided,thatsuchcourtshallhavedivorcejurisdiction,ifserviceofprocessiseffectuatedupontheobligorwithinthisstate.Jurisdictiontomodifyoraltersuchdecreeshallremainintheexclusivecontrolofthecourtwhichissuedsuchdecree.      WedisagreewiththeChancellor'sdetermination.T.C.A.366101(a)(1)byitsownlanguageappliesonlytocustodyofa minor childor minor children.Ininquiringintothemeaningof  minor, andifitcouldmeanahandicappedchildage18orover,wehaveexaminedanumberofusesoftheword minor throughouttheTennesseeCode.Withonlytwoexceptions,wehavefoundthat minormeansanypersonwhohasnotattainedtheageof18years. {   18Tenn.Juris.,Minors,2.ThetwoexceptionsareT.C.A.13113(b),wheretheageofmajorityforpurposesofpurchasing,consumingorpossessingalcoholicbeverageis21years,andT.C.A.357202,whichistheTennesseeUniformTransferstoMinorsAct.Moreover,wehavefoundinT.C.A.13105,whichsetsforththedefinitionoftermsusedasawholeintheTennesseeCodeprovidesfora minor beinganypersonwhohasnotattained18yearsofage.     T.C.A.13105.  Asusedinthiscode,unlessthecontextotherwiserequires: (1)"Ageofmajority"meanseighteen(18)yearsofageorolder;exceptthatwhenpurchasing,consumingorpossessingalcoholicbeverages,wineorbeerasthosetermsaredefinedintitle57,"ageofmajority"meanstwentyone(21)yearsofage."Minor"meansanypersonwhohasnotattainedeighteen(18)yearsofage;exceptthatwhereusedintitle57withrespecttopurchasing,consumingorpossessingalcoholicbeverages,wineorbeer,"minor"meansanypersonwhohasnotattainedtwentyone(21)yearsofage.Thissubdivisionshallnotbeconstruedasprohibitinganypersoneighteen(18)yearsofageorolderfromselling,transporting,possessingordispensingalcoholicbeverages,wineorbeerinthecourseofemployment; (2)"Code"includestheTennesseeCodeandallamendmentsandrevisionsthereofandalladditionsandsupplementsthereto.      Itisblackletterlawthatemancipationofaminormayoccurbyoperationoflaw,fortheLegislaturepossessesthepowertofixtheageatwhichthedisabilitiesofinfancyareremoved.Campbellv.BonAirCoal&IronCorp.,151Tenn.132,268S.W.377(1925).ThisoccurredinTennesseewhentheLegislatureenactedtheLegalResponsibilityAct,Chapter162,PublicActsof1971.AsourSupremeCourthasstatedinGareyv.Garey,482S.W.2d133,135(Tenn.1972):     Itisfundamentalthatonceachildreachestheageofmajoritythereisacompleteemancipationoftheminorfromtheprotectivebondsofparentalcontrol.MemphisSteelConst.Co.v.Lister(1917)138Tenn.307,197S.W.902.Atthetimeofcompleteemancipationtheparents'legaldutytosupportthechildisterminated.Wallacev.Cox(1916)136Tenn.69,188S.W.611. InSection3ofChapter162ofthePublicActsof1971theGeneralAssemblyhasconferredthestatusofadulthoodonpersons18yearsofageorolder.Byloweringtheageofmajorityfrom21to18yearsofagetheLegislaturehascompletelyemancipatedtheminorfromthecontroloftheparentsandrelievedtheparentsoftheirattendantlegaldutytosupportthechild.      TenyearsaftertheCourtsopinioninSaynev.Sayne,39Tenn.App.422,284S.W.2d309(1955),whichheldtheparentsdutytosupportadisabledchildcontinuedaftermajority,theLegislatureenactedT.C.A.331101,etseq.,dealingwithmentallyillandmentallyretardedpersonsandthefacilitiesprovidedforthem.T.C.A.331101(15)and(19)areparticularlyinformativetothecaseathand:     (15)"Mentallyretardedindividualormentallydeficientindividual"meansanindividualwhohassignificantlysubaveragegeneralintellectualfunctioningexistingconcurrentlywithdeficitsinadaptivebehavior,andmanifestedduringthedevelopmentalperiod; .... (19)"Responsiblerelatives"meansthespouse,iftherebesuch,ofthementallyillpatientsreceivingcareandserviceinmentalhealthprogramsunderthejurisdictionofthedepartmentofmentalhealthandmentalretardation,andtheparentorparentsofunmarriedmentallyillpatientsormentallyretardedresidentswhohavenotattainedtheageofeighteen(18)...      In1992,effectiveJanuary1,1993,theLegislatureenactedourpresentT.C.A.3411101,etseq.,andT.C.A.3413101,etseq.,dealingwith% X %X[Ԝconservatorships. |   ׀Aspertinentinthismatter,T.C.A.3411101containsthefollowingdefinitions:     Asusedinthischapterandchapters12and13ofthistitle,unlessthecontextotherwiserequires: .... (7)"Disabledperson"meansanypersoneighteen(18)yearsofageorolderdeterminedbythecourttobeinneedofpartialorfullsupervision,protectionandassistancebyreasonofmentalillness,physicalillnessorinjury,developmentaldisabilityorothermentalorphysicalincapacity; .... (12)"Minor"meansanypersonwhohasnotattainedeighteen(18)yearsofageandwhohasnototherwisebeenemancipated. Powerwithrespecttothecareandcustodyofpersonsofunsoundmindandthepossessionandcontroloftheirestatesarethusvestedinthestate,orthepeoplethereof,theexerciseofwhichpowerthepeoplemaydelegatetothecourtsbyconstitutionalorstatutoryprovision....Thecourtisalwaystheultimateguardianofpersonsunderdisability,suchasthosewhoareinsane,whocomeunderitscareandprotection.Jurisdictionoverlimitedguardianshipproceedingswasvestedinchancerycourt,circuitcourt,lawandequitycourt,orprobatecourtincountieshavingsuchcourt;jurisdictionoverappointmentofconservatorswasvestedconcurrentlyinthechancerycourtandtheprobatecourt.Chancerycourts,actinginlocoparentis,andasgeneralguardiansforminors,idiots,lunaticsandpersonsofunsoundmind,willdoforthemandtheirpropertywhattheythemselveswouldinallprobabilityhavedoneifpossessedofgoodreasonandgoodconscience.      ItisclearthatthemeaningofthewordminorintheTennesseeCodedesignatesapersonundertheageof18and,therefore,theTrialCourthadnojurisdictiontohearthismatterandtomodifythephysicalcustodyofShannonundertheagreeddivorcedecree.Rather,theprocedurescontainedinT.C.A.3413101,etseq.,whichaddressconservatorship,shouldhavebeenfollowed.  Beforeconcluding,weobservethatifinthefuturethefundsavailableareinsufficientforhersupport,aconservatorwouldhavetheauthoritytoseekadecreerequiringtheparentstocontributethereto.
