àIn€this€divorce€action,€the€appellant,€Ms.€Lay,€by€choice,Ïdid€not€make€an€appearance€in€the€trial€court.€€A€default€judgmentÏwas€granted€awarding€a€divorce€to€the€appellee,€Mr.€Lay.€€SomeÏthirteen€months€later,€the€appellant€filed€a€Rule€60.02€motionÏasking€for€relief€from€the€judgment€regarding€the€division€ofÏmarital€property.€€The€trial€court€denied€the€motion.€€This€appealÏresulted.€€We€affirm€the€judgment€of€the€trial€court.̛̜à àThe€parties€were€married€in€1975.€€Two€children€were€born€toÏthe€marriage€and€neither€had€reached€majority€at€the€time€of€theÏdivorce.€ÌÌà àBoth€parties€worked€during€the€marriage€œbut,›€nevertheless€œÏthey›€were€experiencing€financial€difficulties.€€They€entered€intoÍa€Chapter€13€bankruptcy€plan€at€some€point€prior€to€the€divorceÏproceedings.€€It€is€apparent€from€Ms.€Lay's€testimony€at€trialÏthat€she€was€aware€of€the€Chapter€13€proceedings€and€had€partici…pated€at€least€in€some€small€degree€in€the€proceedings.€€Mr.€LayÏtestified€that€the€parties€had€an€outstanding€indebtedness€ofÏabout€$40,000.00.€€The€partiesðð€income€at€the€time€of€the€institu…tion€of€the€bank‚ruptcy€proceeding€is€not€a€part€of€the€recordÏbefore€us.€€Mr.€Lay€also€testified€that€he€informed€the€attorneyÏwho€filed€their€bankruptcy€petition€that€he€had€a€pension€planÏthat€would€more€than€cover€the€debt€and€asked€if€he€should€justÏcash€out€the€œpension€plan.›€€He€further€testified€that€his€attorneyÏinformed€him€that€would€not€be€necessary.€€It€appears€that€theÏissue€of€the€pension€plan€was€not€before€the€bankruptcy€court.€ÏœApparently›€the€œbankruptcy€plan›€was€in€existence€for€some€timeÏprior€to€the€divorce,€with€œMr.€Lay›€making€a€weekly€payment€pursu…ant€to€the€plan.Ì€€Ìà àBoth€parties€testified€that€it€was€the€appellant€who€wantedÏthe€divorce€and€that€the€appellee€simply€went€out€and€obtainedÍone.€€A€Marital€Dissolution€Agreement€was€drawn€up€for€the€partiesÏby€an€attorney€employed€by€husband.€€The€agreement€provided€forÏthe€granting€of€a€divorce€to€the€œhusband,€awarding€custody›€of€theÏtwo€minor€œchildren€to€him,›€and€œobligating›€him€to€pay€all€maritalÏdebt.€€Additionally,€the€judgment€awarded€œMr.€Lay›€all€"rights,Ïtitle€and€interest€in€the€partiesðð€marital€Chapter€13€assets...€."€€€ÏWe€note€again€that€the€pension€plan€was€never€mentioned€in€theÏChapter€13€proceedings€as€far€as€we€can€discern€from€the€record.ÌÌà àApproximately€thirteen€months€after€the€entry€of€Final€Judg…ment€of€Divorce,€Mr.€Lay€called€Ms.€Lay€to€inform€her€that€he€wasÏabout€to€enjoy€a€new€home,€new€car,€etc.€€When€asked€by€Ms.€LayÏhow€he€could€afford€such€things,€he€responded€that€he€had€quit€hisÏprevious€employment€and€received€his€retirement€funds.ÌÌà àAs€a€result€of€that€conversation,€Ms.€Lay€obtained€an€attor…ney€and€filed€a€motion€pursuant€to€Rule€60.02,€T.R.C.P.,€askingÏthe€court€to€reopen€the€original€divorce€proceedings€and€allow€herÏto€litigate€the€issue€œof€her€former›€husbandððs€pension€plan€funds.ÍAs€a€basis€for€this€motion,€œMs.€Lay€filed›€her€own€affidavit€stat…ing,€essentially,€that€she€did€not€make€an€appearance€in€theÏoriginal€action,€that€she€was€unaware€of€husbandððs€pension€plan,Ïand€that,€additionally,€she€was€unaware€that€there€were€any€mari…tal€assets€of€any€value€because€of€the€bankruptcy€proceedings.ÌÌà àThe€trial€court€heard€rather€extensive€testimony€includingÏboth€parties,€both€children,€an€officer€from€the€trust€company€whoÏhandles€the€pension€plan,€and€an€employee€of€husbandððs€formerÏemployer€who€had€knowledge€of€the€pension€plan.€€The€court€tookÏthe€case€under€advisement€and€sometime€later€issued€an€orderÏdenying€the€motion.€€This€appeal€resulted.ÌÌà àMs.€Lay€has€raised€a€single€issue€for€our€review:€"[œt]he›Ïtrial€court€erred€in€denying€appellant's€motion€to€re„open€theÏfinal€judgment€pursuant€to€T.R.C.P.€60.02(5)."ÌÌà àRule€60.02€reads€in€pertinent€part€as€follows:ÌÓÓà8 àà àOn€motion€and€upon€such€terms€as€are€just,€theÏcourt€may€relieve€a€party€or€his€legal€representativeÏfrom€a€final€judgment,€order€or€proceeding€for€theÏfollowing€reasons€...€(5)€any€other€reason€justifyingÏrelief€from€the€operation€of€the€judgment.ÌÌÓÓÌà àThe€final€judgment€here€was€a€default€judgment.€Ms.€LayÏtestified€at€the€hearing€on€the€Rule€60€motion€that€she€wanted€theÏdivorce,€that€she€knew€about€it€and€that€she€chose€not€to€make€anÏappearance€because€she€did€not€think€that€there€was€anything€ofÏvalue€to€be€obtained.€€She€also€testified€that€she€knew€of€theÏexistence€of€a€œpension€plan›€and€life€insurance.ÌÌà àOur€review€of€the€record€as€a€whole€does€not€persuade€us€thatÏthere€was€a€failure€on€the€part€of€Mr.€Lay€to€disclose€a€maritalÏasset.€€Ms.€Lay€was€aware€that€there€was€a€pension€and€insuranceÏplan.€She€made€a€deliberate,€calculated€choice€to€allow€a€defaultÏjudgment€to€be€taken€against€her€and€expressly€accepted€the€termsÏof€the€property€settlement€agreement.ÌÌà àFurther,€it€has€not€been€satisfactorily€œdemonstrated›€that€theÏdivision€of€marital€property€was€inequitable.€€It€is€well„settledÏlaw€in€this€state€that€the€trial€court€has€wide€discretion€inÏadjudicating€the€parties'€rights€and€interests€in€the€maritalÏestate,€and€that€the€trial€court's€findings€are€entitled€to€greatÍweight€on€appeal.€òòSee€e.góó.,€òòBatson€v.€Batsonóó,€769€S.W.2d€849Ï(Tenn.€App.€1988).€€It€is€also€well„settled€law€that€the€divisionÏof€marital€property€must€merely€be€an€equitable€one€and€not€neces…sarily€an€equal€division.€òòSeeóó€T.C.A.€ðð€36„4„121€(c).€€While€œMr.ÏLay€retained›€his€pension€plan€in€its€entirety,€he€also€retainedÏ100€percent€of€the€marital€debt,€including€an€indebtedness€owed€onÏan€automobile€awarded€to€Ms.€œLay›€and€the€Chapter€13€plan.€He€alsoÏreceived€custody€of€both€children€with€œMs.€Lay›€having€no€childÏsupport€obligation€being€established.×
