ThepartiesweredivorcedbytheProbateCourtofDavidsonCountyinMarchof1991.Inanagreedorder,custodyofthethreeminorchildrenwasawardedtothemother,withveryliberalvisitationprivilegesawardedtothefather.Inadditiontoallthemajorholidaysinalternateyears,fourconsecutiveweeksinthesummer,andanotherweekduringtheschoolyear,thefatherwasallowedtohavethechildrenvisithimtwoweeknights,oneweekendnightanddayeachweekandSundaysforthreehours.Mr.Loftusagreedtopay$778permonthinchildsupport.  Afterthedivorcethemotherwentbacktoworkatamodestsalary,andthefathersearningsgrewsubstantially.InDecemberof1991Ms.LoftuswasofferedajobthatrequiredhertotravelfromMondaymorningtoThursdayafternooneachweek.ThepartiesagreedtomodifythevisitationschedulesothatMr.LoftuswouldhavecustodyfromMondaymorningwhenMs.Loftusdroppedthechildrenoffatschool,untilThursdayafternoonwhenshegotbacktotown.ThepartiesalsoagreedthatMr.LoftuswouldhavethechildrenonSaturdaysfrom9:00a.m.to5:00p.m.  Bytheendof1995Mr.Loftuswasearning$8,443.00permonthandMs.Loftusearned$9,049.54permonth.OnDecember19ofthatyearMs.Loftusfiledapetitiontoincreasethechildsupportpayments.Mr.Loftusfiledacounterclaimforcustodyofthechildren.Afterahearing,thepartiesagreedthatthepreviouscustodyordershouldbemodifiedtoawardcustodytothepartiesjointly,butthepreviousvisitationscheduleremainedthesame.Thecourtsettheamountofchildsupportat$1600permonthtobepaidbyMr.Loftus.TheamountcalledforbytheTennesseeChildSupportGuidelineswouldhavebeen$2400permonth.@ II.   Thereisarebuttablepresumptionthatthechildsupportguidelinesprovidethecorrectamountofchildsupporttobepaidbytheobligorparent.Tenn.CodeAnn.365101.TheamountslistedintheguidelinesassumethatoneparentwillhaveprimaryphysicalcustodyandthattheotherparentwillhavethechildrenforovernightvisitationfromFridaytoSundayeveryotherweek,twoweeksinthesummer,andtwoweeksduringtheholidaysthroughouttheyear.Tenn.Comp.R.&Regs.124024.02(6).Thecourtsareallowedtodeviatefromtheguidelineswhereovernighttimeismoreevenlydividedbetweentheparents.Tenn.Comp.R.&Regs.124024.04(2)(b).SeeGrayv.Gray,885S.W.2d353(Tenn.App.1994);Kochv.Koch,874S.W.2d571(Tenn.App.1993).Wherethetimeismoreevenlydividedthecourtsmustmakeacasebycasedeterminationastotheappropriateamountofsupport.Tenn.Comp.R.&Regs.124024.02(6).Anupwarddeviationisallowedwheretheobligorparentisnotprovidinghealthinsuranceforthechildren.Tenn.Comp.R.&Reg.124024.04(1)(a).  Weareoftheopinionthatthetrialjudgesdeterminationoftheappropriateamountofsupportshouldbeaffirmed.WhileMr.Loftusarguesthathehasthechildrenamajorityofthetime,thefactsdonotsupportthatconclusion.Underthemostextremecase,whichexistedforatimeafter1991,hehadthechildrenthreenightsaweekandduringthedayonSaturdays.Inaddition,thesummerandholidayschedulesremainedthesame.Hisovernightvisitsamounttosubstantiallymorethantheguidelinescontemplate,butMs.Loftusisstilltheprimarycustodialparent.Shebuysmostofthechildrensclothes;providesthemwithhealthinsurance;andsince1991,shehasbeenincreasinglyabletocurtailhertravelschedulesothatshespendsmoretimeathome.WealsonotethatthenumberofdaysthechildrenspendwithMr.Loftusisonlyslightlyhigherthanthenumberprovidedinthefinaldecree.  Based,inpart,onMr.Loftusincreasedcustody,thetrialjudgeϜorderedathirtythreepercentdeviationdownwardfromthechildsupportguidelines.TakingintoaccountthehealthinsuranceprovidedbyMs.Loftus,thedeviationamountstomorethanonethird.Wethinktheproperamountofchildsupportunderthesecircumstancesaddressesitselftothetrialjudgesdiscretionandwefindnoabuseofthatdiscretioninthiscase.@ III.
