Plaintiffpresentsthefollowingissuesforreview:  1. WhethertheChanceryCourtingrantingtheMotion  todismissthePlaintiffsDeclaratoryJudgmentSuit,improperly  decideddisputedfactualissuesbaseduponanaffidavitbythe  Defendantspersonnel,ratherthanbyreachingthemeritsof  thefactualdisputedissues.  2. WhethertheChanceryCourterroredandshouldhave  appointedCounseltorepresentthepro.se.petitionerin  lightofthecomplexityoftheissuesand/orshouldhave  permittedoralargumentsothataclearunderstandingofthe  issuescouldbepresentedbeforetheCourt.  3. WhethertheChanceryCourtsJudgmentinthecase  atbarproperlydenotesaclearfindingoffactandlegal  conclusiontobothissuesthatwerepresentedtotheCourtfor  JudicialReview.i.e.;(1)Propersentencecalculationand(2)  CommencementonserviceofDicksonCountysentences.  TherecordreflectsthattheDefendantsmovedtodismissforfailuretostateaclaimforwhichreliefcanbegrantedandthattheTrialCourtsustainedthemotion. ThecomplaintassertsthattheDepartmentofCorrectionhasincorrectlycomputedthetimeofPlaintiffsincarcerationandpraysthattheTrialCourtissueadeclaratoryorderastopetitionersrights.ExhibitedtothepetitionisapetitiontotheDepartmentofCorrectionrequestingsimilarrelief,butthepetitionfiledintheTrialCourtcontainsnoallegationthatthepetitiontotheDepartmentwaseverpresentedtotheDepartmentorthattheDepartmentfailedorrefusedtoconsiderthepetitionortookanyactionthereon. T.C.A.45223controlsdeclarativeordersbyadministrativeagencies. T.C.A.45223providesjurisdictionofChanceryCourtstoenterdeclaratoryjudgmentsastoadministrativematters,butalsoprovides:  (b)Adeclaratoryjudgmentshallnotberenderedconcerning  thevalidityorapplicabilityofastatute,ruleororderunless  thecomplainanthaspetitionedtheagencyforadeclaratory  orderandtheagencyhasrefusedtoissueadeclaratoryorder. Sincethepetitiondoesnotallegeacompliancewith45224(b),itfailstoshowthattheChanceryCourthasjurisdictiontoentertainthissuitfordeclaratoryjudgment.Thepetitionthereforefailstostateaclaimforwhichreliefcanbegranted. Forthisreasonthepetitionwasproperlydismissed. ThejudgmentoftheTrialCourtisaffirmed.CostsofthisappealaretaxedtothePlaintiff.ThecauseisremandedtotheTrialCourtforanynecessaryfurtherproceedings.
