Thus,asafirstorderofbusiness,itisincumbentonthetrialcourttoclassifytheproperty,togiveeachpartytheirseparateproperty,andthentodividethemaritalestateequitably.Batson,769S.W.2dat856. *#$  4  Inthiscase,thehusbanddisputeswhetherthefarmlandwasmaritalproperty.Thehusbandcontendsthatitbecameseparatepropertyafterheconveyedittohisdaughter.T.C.A.364121(b)(1)(A)definesmaritalproperty:0 4 0 4(#4(# Maritalpropertymeansallrealandpersonalproperty,bothtangibleandintangible,acquiredbyeitherorbothspousesduringthecourseofthemarriageuptothedateofthefinaldivorcehearingandownedbyeitherorbothspousesasofthedateoffilingofacomplaintfordivorce,exceptinthecaseoffraudulentconveyanceinanticipationoffiling,andincludinganypropertytowhicharightwasacquireduptothedateofthefinaldivorcehearing,andvaluedasofadateasnearasreasonablypossibletothefinaldivorcehearingdate.923 (# (# Л 4  Thehusbandhadalreadyconveyedthelandtohisdaughter,however,atthetimethewifefiledfordivorce.  #  1      ׀AlthoughtheTrialCourtdidnotspecificallyfindthatthe   conveyancefromthehusbandtohisdaughterwasfraudulent,thatistheeffecttheholding.Otherwise,thefarmlandcouldnotbeconsideredmaritalproperty. 4  Whetheratransferisfraudulentisdeterminedbythefactsandcircumstancesofeachcase.MaconBank&Trustv.Holland,715S.W.2d347,349 <4  (Tenn.App.1986). Badgesoffraudmayincludeinadequateconsideration,therelationshipofthepartiesandthegivingawayofrelativelyallofapartysproperty.Id.Astrainedmarriagerelationshipdoesnot,byitself,establishfraudulentintent.
