DavidK.HinchyandPearlineHinchy,whoareresidentsofIndiana,appealjudgmentsoftheChanceryCourtforCockeCounty.TheChancellor,first,grantedadefaultjudgmentagainsttheminfavorofRonaldD.MackieandBrendaL.Mackie,whoareresidentsofFlorida.TheCourtalsoorderedthesaleofcertainrealestate,theproceedsofwhichwouldbeappliedtothesatisfactionoftheindebtednesssecuredbytherealestateand,preliminarily,apersonaljudgmentintheamountof$18,200,plusinterestattherateof8.65percentperannumfromOctober1,1989.Second,aftersaleofthepropertyandgivingcreditforpaymentspreviouslymade,heawardedadeficiencyjudgmentintheamountof$15,719.97,whichincludedcourtcostsandexpensesofϜthesale.  TheHinchysappeal,contendingtheTrialCourtwasinerrorinnotsustainingtheirRule60motiontosetasidethatportionoftheJune1,1992,defaultjudgmentawardingtheMackiesapersonaljudgmentagainstthem.  AlthoughtherewereothermotionsbythepartiesandordersoftheCourt,wewilldetailthosewedeemnecessaryforproperdispositionofthisappeal.1. February19,1991,complaintbyMackiesstyled,"COMPLAINTTOFORECLOSEONMORTGAGEDEED,"lateramendedbyorderenteredMay6,1991,allegingtheHinchyshadexecutedamortgagetothemsecuringanindebtednessof$22,000that,afterpayingeightpaymentsthereonintheamountof$475,theindebtednessbecameindefaultandsought(1)process,(2)appointmentofaSpecialMaster,(3)saleofthemortgagedproperty,and(4)generalrelief.2. June1,1992,ordergrantingdefaultjudgmentawardingarecoveryintheamountof$18,200,plusinterestattherateof8.65percentperannumfromOctober1989,andorderingsaleoftheproperty.3. September21,1992,Master'sreportdisclosingsalewasaccomplishedandthetotalpurchasepricewas$8500.4. October16,1992,decreeconfirmingsale,fixingattorney'sandMaster'sfees,andorderingdisbursementofsaleproceeds.5. December11,1992,petitionbyMackiesseekingadeficiencyjudgment.6. November6,1995,motionbyHinchystodismissMackies'supplementalpleadingseekingadeficiencyjudgment. 16. January9,1996,judgmentfindingthattheCourthadexercisedproperinpersonamandinremjurisdictionovertheHinchys,thatthedecreeconfirmingthesaleenteredOctober16,1992, o   ׀isresjudicatatoallpleadingsfiledthereafter,andthattheCourtimproperlyoverruledHinchys'motiontodismissthepetitionfordeficiencyjudgment.  BasedupontheforegoingfindingstheTrialCourtgrantedtheHinchys'motiontodismisstheMackies'petitionfordeficiencyjudgment,dismissedthemotionseekingtosetasidethedefaultjudgment,dismissedthecountercomplaint,andreaffirmeditsawardofadeficiencyjudgment.  WefirstnotethatthecomplaintasamendeddoesnotseekanypersonaljudgmentagainsttheHinchys,butonlythesaleofthepropertytosatisfytheMackies'indebtedness.  WehaveitofoldFootnote14,648,Gibson'sSuitsinϜChancery,4thEd.(1937),whenaddressingexecutionsthatadecreemustbecircumscribedbytheevidence,theevidencecircumscribedbythepleadings, p   ׀andthepleadingscircumscribedbytheprocedureofthechancerycourt.(Seeappendix.)  Inthepresentpostureofthiscase,itisobviousthattherearenopleadingsseekingapersonaljudgmentagainsttheHinchys.ItistruethatapetitionwasfiledbytheMackieswhichdidseeksuchrelief,buttheorderoftheTrialCourtonJanuary9,1996,grantedthemotionoftheHinchystostrikethatpetition,andthisactionbytheChancellorisnotappealed.  WeaccordinglyfindthatatthetimeoftheentryofthepersonaljudgmentonJanuary9,1996,therewerenopleadingswhichwouldauthorizetheChancellortograntsuchajudgment,andsomuchofhisorderthatpurportstodosoisreversed.  Inourresolutionofthecase,wehavenotoverlookedthefactthatthecomplaintasamendeddidseekgeneralrelief.Weare,however,disinclinedtofindthatthispleadingissufficientlybroadtoplacetheHinchysonnoticethattheywouldbecastinjudgmentshouldthesaleofthepropertynotgeneratesufficientfundstopaytheindebtedness.  Gibson'sSuitsinChancery,7thEd.,addressedthequestionthusly:      220.ReliefUndertheGeneralPrayer. 󀄄Asarule,noreliefcanbegrantedifnoneisdemanded;andnoreliefwillbegrantedinconsistentwiththatdemanded.Thedecreeordinarilyfollowsthespecialreliefsoughtbythecomplaint,ifthepleadingsandproofwillwarrantit. Iftheplaintiffisnotentitledtothespecificreliefheprays,hemayunderthegeneralprayerhavesuchotherreliefasthepleadingsandproofwilljustify,provideditisnotofacharactertotakethedefendantbysurprise.Thereliefunderthegeneralprayermustfollow,ordinarilyandlogically,thepleadingsandtheproof.Ifthecomplaintpraysforgeneralreliefonly,theplaintiffcanbyamendmentdemandthespecificreliefheisentitledtoonthecasemadeoutbythepleadingsandproof.      Beforeconcluding,wepointoutthatnothingcontainedinthisopinionwouldinanywayaffectthevalidityofthecourtorderedsaleofthemortgagedproperty.
