Bothpartiesagreedtocontinuethecase;eachsoughtaschedulingorderforthe ,| sequenceofdiscovery.ThepartieswereorderedtoattendmediationonFebruary   23,1998.OnMay18,1998,Husbandmovedtochange_pendente_Ԁlitecustodyand t tocompeldiscovery.ThismotionwastobeheardonJune3,1998.AttheJune h 3,hearing,inanadmittedlyunorthodoxproceeding,thepartiesstipulatedunder  ! oaththateachhadgroundsfordivorce.Atthispointinthehearing,bothparties `"# weresentintoanantechambertoprovideforthedivisionofthemaritalestateand $T% custodyofthechild.Thesenegotiationsaredocumentedinhandwrittennotes, % ' signedbythepartiesandtheircounsel,andappearingintherecord. !
