InMarch1980,PlaintiffwasindictedonfourcriminalcountsinShelbyCounty,Tennessee.Plaintiffretaineddefendant/appellee,RussellX.Thompson,forhisdefense.Ultimately,Plaintiffenteredguiltypleastoallcharges. In1988,Plaintifffiledaprosepetitionforpostconvictionrelief.Inhispetition,PlaintiffcontendedthatneitherDefendantnorthetrialcourtadvisedhimofhisFifthAmendmentrightagainstselfincriminationpriortoenteringhisguiltypleas.On24February1993,theTennesseeCourtofCriminalAppealssustainedoneofPlaintiff'sclaimsandvacatedoneofhisconvictions. Statev.Mathews ,No.02C019204CR00091(Tenn.Crim.App.24Feb.1993). OnJuly17,1995,PlaintifffiledtheinstantcomplaintalleginglegalmalpracticeonthepartofDefendant.Defendantmovedtodismissthecomplaintastimebarredbytheapplicablestatuteoflimitations.On23October1995,thechancerycourtentereditsmemorandumandorderholding,inpertinentpart,asfollows:#`  <X#8  ThismatterisbeforetheCourtonthedefendant'smotiontodismissthecomplaintwithprejudiceonthegroundsthatthecomplaintisbarredbytheapplicablestatuteoflimitations,TennesseeCodeAnnotatedsection283104.8  Inthismattertheplaintiffcontendsthatthedefendantcommittedlegalmalpracticein1980.Specifically,theplaintiffassertsthathewasindictedinMarchof1980forvariouscriminalmattersandthatheemployedthedefendanttorepresenthiminthosematters.Theplaintiffenteredguiltypleasineachofthecriminalmatters.Thereafter,in1988,theplaintifffiledseveralprosepetitionsforpostconvictionreliefonthegroundsthatthedefendanthadfailedtoproperlyadvisetheplaintiffofhisrightsbeforeenteringtheguiltypleas.OnFebruary24,1993,theTennesseeCourtofCriminalAppealssustainedoneoftheplaintiff'sclaimsandvacatedoneoftheconvictionstowhichtheplaintiffhadearlierenteredaguiltyplea.OnJuly17,1995,theplaintifffiledhiscomplaintforallegedlegalmalpractice.8  UnderTennesseeCodeAnnotatedsection283104actionsandsuitsagainstattorneysformalpracticearerequiredtobecommencedwithinoneyearafterthecauseofactionaccrues.Tennesseelawdoesnotfollowthe"tolling"theorywhichholdsthatlegalmalpracticemustbeirremediablebeforethestatuteoflimitationsaccrues.Instead,Tennesseelawrequiresthatforacauseofactionforlegalmalpracticetoaccruetwoeventsmustoccur:theclientmustbecomeawareoftheallegednegligencebythelawyerandtheclientmustsuffera"legalcognizableinjury."8  Inthecaseatbartheplaintifffirstbecameawareoftheallegednegligencenolaterthan1988whenhefiledhispetitiontovacatethecriminalconvictiononthegroundsthatthedefendanthadnotproperlyadvisedtheplaintiffofhisrights.Additionally,theplaintiffsuffereda"legallycognizableinjury"whenhewasincarceratedafterenteringtheguiltyplea.8  Inthattheplaintiff'slegallycognizableinjuryoccurredandtheplaintiffbecameawareoftheallegednegligenceofthedefendantmorethanayearpriortothefilingofthiscomplaintformalpracticeonJuly17,1995,thiscauseofactionistimebarred.8  ItisthereforeORDEREDthattheabovecaptionedcauseofactionisDISMISSEDwithprejudiceonthegroundsthatitisbarredbytheapplicablestatuteoflimitations.8  Inthattheplaintiffhasqualifiedasapauperinthismatter,onlystatelitigationtaxisassessedtotheplaintiff.Plaintifffiledatimelynoticeofappealandinsistedthathisclaimwasnotbarredbythestatuteoflimitations. Plaintiff'scomplaintisbaseduponanactoflegalmalpracticewhichoccurredin1980.ActionsagainstattorneysformalpracticearesubjecttothetimelimitationsetforthinTennesseeCodeAnnotatedsection283104.Thissectionprovides,inpertinentpart,asfollows:"Thefollowingactionsshallbecommencedwithinone(1)yearafterthecauseofactionaccrued:...(2)Actionsandsuitsagainstattorneys...formalpractice,whethertheactionsaregroundedorbasedincontractortort."Tenn.CodeAnn.283104(a)(2)(Supp.1995). Wemustfirstdeterminewhenalegalmalpracticeactionaccrues.Inorderforlegalmalpracticetoaccrue,twoeventsmustoccur:"1)theplaintiffmustsuffer...an'irremediableinjury'asaresultofthedefendant'snegligence;and(2)theplaintiffmusthaveknownorintheexerciseofreasonablediligenceshouldhaveknownthatthisinjurywascauesdbydefendant'snegligence." Carvellv.Bottoms ,900S.W.2d23,28(Tenn.1995). Here,botheventsoccurredmorethanoneyearbeforethecommencementofthisaction.Toexplain,PlaintiffbecameawareofDefendant'sallegednegligenceonorbefore1988.ThefactthatPlaintifffiledapostconvictionpetitionin1988basedonDefendant'simproperadviceestablishedPlaintiff'sknowledge.ItisbeyondquestionthatPlaintiffknewofDefendant'sallegednegligencein1988.Second,Plaintiffsuffereda"legally,cognizableinjury"in1980whenhewasincarceratedfollowingtheentryofhisguiltypleas.Moreover,Plaintiff'spostconvictionappealconcludedon24February1993,seventeenmonthsbeforePlaintiffcommencedtheinstantaction.Giventhis,thetrialcourtcorrectlydeterminedthatthestatuteoflimitationshadrunandproperlydismissedPlaintiff'scomplaint.
