àThe€record€in€this€case€consists€of€the€statement€of€the€evidence,€whichÏis€very€meager€at€best,€and€the€technical€record.€€œThe›€facts€gleaned€from€thisÏrecord€are€as€follows.Ìà àThe€parties€were€divorced€by€a€decree€entered€on€September€1,€1993.€ÏThey€entered€into€a€Marital€Dissolution€Agreement€(MDA),€which€wasÍapproved€and€ratified€by€the€trial€court€in€the€final€decree€of€divorce.€€TheÏparties€have€three€children€together:€€Drew€McCollum,€born€August€22,€1979;ÏZada€McCollum,€born€November€9,€1981;€and€Rachel€McCollum,€born€May€6,Ï1990.€€Pursuant€to€the€MDA,€the€trial€court€awarded€the€parties€joint€legalÏcustody€of€the€three€children,€with€primary€physical€custody€to€Wife€andÏreasonable€and€liberal€visitation€rights€to€Husband.€€The€MDA€provided€thatÏHusband€would€pay€41%€of€his€net€income€or€$150.00€per€week,€whichever€wasÏgreater,€as€support€for€the€three€children.€€The€MDA€further€provided€that€WifeÏwould€maintain€medical€insurance€on€all€three€children.€€à àÌà àOn€June€30,€1995,€Husband€filed€a€petition€to€change€child€custody€andÏmodify€the€child€support€award.€€He€requested€that€the€court€grant€himÏprimary€custody€of€Drew€McCollum.€€Husband€further€requested€that€the€courtÏreduce€his€child€support€obligation€and€set€child€support€as€to€both€partiesÏaccording€to€the€Child€Support€Guidelines€promulgated€by€the€TennesseeÏDepartment€of€Human€Services.€€Tenn.€Comp.€R.€&€Regs.€tit.€10,€ch.€1240„2„4„.01€òòet€seq.óó€(1989,€revised€1994)€(Guidelines).€€Ìà àAfter€a€hearing,€the€trial€court€granted€Husbandððs€petition€and€awardedÏhim€Ñ , ÑÑ   ÑÑ  ÑÑ€( u` Ñphysical€custody€of€Drew€McCollum.€€The€trial€court€also€modifiedÏHusbandððs€child€support€obligation€according€to€the€Guidelines.€€The€partiesÍagree€that€the€trial€court€apparently€determined€that€Husband€should€pay€32%Ïof€his€net€income€to€Wife€as€support€for€the€two€children€living€with€her€andÏthat€Wife€should€pay€21%€of€her€net€income€to€Husband€for€the€one€childÏliving€with€him.€€Instead€of€requiring€each€party€to€pay€the€other,€the€courtÏordered€Husband€to€pay€Wife€the€difference€between€the€two€amounts,€whichÏis€$375.00€per€month.× ƒ4 ××  ×Ìà àWife€perfected€this€appeal€and€presents€the€following€issue,€as€stated€inÏher€brief,€for€our€review:€ÌÓÓà8 àà8 àWhether€the€trial€court€properly€applied€the€ChildÏSupport€Guidelines€when€the€mother€has€physicalÏcustody€of€two€children€and€the€father€has€physicalÏcustody€of€one€child.€€ÌÌœ›ÓÓà àSince€this€case€was€tried€by€the€court€sitting€without€a€jury,€we€reviewÏthe€case€ò òòòde€novoó óóó€upon€the€record€with€a€presumption€of€correctness€of€theÏfindings€of€fact€by€the€trial€court.€€Unless€the€evidence€preponderates€againstÏthe€findings,€we€must€affirm,€absent€error€of€law.€€T.R.A.P.€13(d).Ìà àWife€argues€that€the€trial€court€erred€in€applying€the€Guidelines€to€the€Ïsituation€in€the€present€case€in€which€she€has€exclusive€physical€custody€of€twoÍchildren€and€Husband€has€exclusive€physical€custody€of€one€child.€€In€support€ofÏher€argument,€Wife€points€out€that€she€is€receiving€less€in€support€payments€forÏthe€two€children€living€with€her€than€she€would€be€entitled€to€receive€if€she€hadÏonly€one€child€living€with€her.€Ìà àThe€Guidelines€apply€as€a€rebuttable€presumption€of€the€proper€amountÏof€support€in€all€child€support€cases,€including€actions€to€modify€child€support.€ÏT.C.A.€ðð€36„5„101(e)(1)€(1996);€ò òòòsee€also€óóó óTenn.€Comp.€R.€&€Regs.€tit.€10,€ch.Ï1240„2„4„.02(3),€(7).€€If€the€trial€court€finds€the€evidence€sufficient€to€rebut€theÏpresumption€because€the€application€of€the€Guidelines€would€be€unjust€orÏinappropriate€based€upon€the€best€interest€of€the€children€or€the€ð ðequityÏbetween€the€parties,ðð€the€court€must€make€such€a€finding€in€writing€and€ð ðstateÏthe€amount€of€support€that€would€have€been€ordered€under€the€child€supportÏguidelines€and€a€justification€for€the€variance€from€the€guidelines.ðð€€T.C.A.€ðð€36„5„101(e)(1)€(1996);€ò òòòsee€alsoóóó ó€Tenn.€Comp.€R.€&€Regs.€tit.€10,€ch.€1240„2„4„.02(7).€€As€for€the€situations€to€which€the€Guidelines€apply,€the€GuidelinesÏprovide€the€following:Ìœ›ÓÓà8 àà8 àThe€guidelines€are€designed€to€apply€to€situationsÏwhere€children€are€living€primarily€with€one€parentÏbut€stay€overnight€with€the€other€parent€at€least€asÏoften€as€every€other€weekend€from€Friday€to€Sunday,Ïtwo€weeks€in€the€summer€and€two€weeks€duringÏholidays€throughout€the€year.€€These€guidelines€areÍdesigned€to€consider€the€actual€physical€custody€of€theÏchild(ren),€regardless€of€whether€custody€is€awarded€toÏone€parent€and€visitation€to€the€other€or€such€anÏarrangement€is€ordered€to€be€joint€custody€or€splitÏcustody.€€In€situations€where€overnight€time€isÏdivided€more€equally€between€the€parties,€the€courtsÏwill€have€to€make€a€case„by„case€determination€as€toÏthe€appropriate€amount€of€support€.€.€.€.ÌÌœÓÓTenn.›€Comp.€R.€&€Regs.€tit.€10,€ch.€1240„2„4„.02(6).€Ìà àIt€is€conceded€that€the€trial€court€applied€the€Guidelines€to€determineÏthe€relative€child€support€obligations€of€the€parties€and€we€find€no€error€in€thisÏdetermination.€à àÌà àAlternatively,€Wife€argues€that€the€trial€court€failed€to€consider€severalÏfactors€in€its€application€of€the€Guidelines.€€First,€she€points€out€that€the€trialÏcourt€failed€to€consider€that€she€has€been€providing€medical€insurance€on€all€ofÏthe€children.€€Wife€asserts€that,€under€the€Guidelines,€this€is€a€factor€justifyingÏan€upward€adjustment€in€the€amount€of€Husbandððs€child€support€payments.€ÏTenn.€Comp.€R.€&€Regs.€tit.€10,€ch.€1240„2„4.„04(1)(a).€€Ìà àWife€relies€on€ò òòòCarden€v.€Cardenó óóó,€No.€01„A„01„9502„CH00042,€1996€WLÏ6897298€(Tenn.€App.€Nov.€22,€1995),€in€which€the€trial€court€allowed€a€wifeÏwho€was€paying€child€support€to€deduct€from€her€support€payments€the€amountÏthat€she€was€paying€for€the€childrenððs€medical€coverage.€€ò òòòId.ó óóó€at€*2.€€The€husbandÏappealed,€arguing€that€this€credit€was€contrary€to€the€Guidelines.€€ò òòòId.ó óóó€at€*4.€ÍAfter€reviewing€the€Guidelines,€this€Court€stated€the€following:€€Ìœ›ÓÓà8 àà8 àà àThe€guidelines€contemplate€that€the€obligorÏparent€will€be€responsible€for€providing€medicalÏinsurance€for€the€minor€children.€While€they€do€notÏaffirmatively€place€this€obligation€on€the€obligorÏparent,€the€guidelines€state€explicitly€that€the€courtsÏmust€increase€the€amount€of€child€support€requiredÏby€the€guidelines€if€the€custodial€parent€is€required€toÏmaintain€medical€insurance€for€the€children€becauseÏthe€obligor€parent€has€not€done€so.€€Tenn.€Comp.€R.Ï&€Regs.€r.€1240„2„4„.02(5);€Tenn.€Comp.€R.€&€Regs.€r.Ï1240„2„4„.04(1)(a)€(1994).ÌÌà8 àà8 àà àWe€interpret€the€guidelines€to€require€theÏobligor€parent€to€pay€for€the€childrenððs€medicalÏinsurance€in€addition€to€whatever€other€child€supportÏmight€be€required.€€The€courts€have€little€discretionÏwith€regard€to€this€obligation€and€may€only€departÏfrom€the€guidelinesðð€requirements€if€they€makeÏwritten,€specific€findings€concerning€why€it€would€beÏunjust€or€inappropriate€to€require€a€particular€obligorÏparent€to€pay€for€the€childrenððs€insurance.ÌÌœò òòòÓÓIdóóó ó.›€€Because€the€trial€court€in€that€case€did€not€make€any€written€findings€thatÏit€would€be€unjust€or€inappropriate€for€the€wife€to€pay€the€premiums€for€herÏchildrenððs€medical€insurance,€the€Court€held€that€the€trial€court€should€not€haveÏallowed€her€to€credit€these€amounts€against€her€child€support€obligations.€€ò òòòId.óóó óÌà àUnder€the€Guidelines,€Wife€is€the€obligor€parent€of€Drew€McCollum,€andÍHusband€is€the€obligor€parent€of€Zada€and€Rachel€McCollum.× ƒ5 ××  ×€€In€addition€toÏtheir€respective€child€support€obligations€under€the€Guidelines,€Wife€should€beÏrequired€to€pay€for€medical€insurance€for€one€child,€and€Husband€should€beÏrequired€to€pay€for€medical€insurance€for€two€children.€€The€statement€of€theÏevidence€indicates€that€Husband€ð ðtestified€that€he€[was]€in€the€process€ofÏgetting€[medical]€insurance€on€the€children.ðð€€This,€together€with€the€originalÏdivorce€decree€requiring€Wife€to€provide€medical€insurance€on€all€of€theÏchildren,€leads€us€to€conclude€that€Wife€was,€at€least€at€the€time€of€the€trial€ofÏthis€cause,€still€providing€medical€insurance€on€all€three€children.× ƒ6 ××  ×€€The€trialÏcourt€did€not€make€written€findings€that€the€Guidelines€should€not€apply.€ÏTherefore,€if€they€do€apply,€Husband€should€be€required€to€pay€for€medicalÍinsurance€for€the€two€children€in€Wifeððs€custody€or€the€amount€of€his€childÏsupport€obligations€should€be€increased€to€this€extent.€€We€note€that€Wife€isÏstill€required€to€pay€for€medical€insurance€for€the€one€child€that€is€in€HusbandððsÏcustody.€€€œ›à àSecond,€Wife€asserts€that€the€trial€court€erred€in€failing€toÏconsiderÔ€'Ô€€œÔ€ÔHusbandððs›€failure€to€exercise€standard€visitation€with€Rachel,€theÏpartiesðð€youngest€child.€€The€Guidelines€provide€that€the€percentage€awards€inÏthe€Guidelines€are€the€minimum€amounts€to€be€awarded€and€that€the€courtÏòòshallóó€increase€the€child€support€award€for€the€following€reasons:€€ÌÓÓà8 àà8 àIf€the€child(ren)€is/are€not€staying€overnight€with€theÏobligor€for€the€average€visitation€period€of€every€otherÏweekend€from€Friday€evening€to€Sunday€evening,€twoÏweeks€during€the€summer€and€two€weeks€duringÏholiday€periods€throughout€the€year,€then€an€amountÏshall€be€added€to€the€percentage€calculated€in€theÏabove€rule€to€compensate€the€obligee€for€the€cost€ofÏproviding€care€for€the€child(ren)€for€the€amount€ofÏtime€during€the€average€visitation€period€that€theÏchild(ren)€is/are€not€with€the€obligor€.€.€.€.€€ÌÌÓÓTenn.€Comp.€R.€&€Regs.€tit.€10,€ch.€1240„2„4„.04(1)(b).€Ìà àThe€statement€of€the€evidence€indicates€that€Husband€exercises€regularÏvisitation€with€Zada,€but€that€he€sees€Rachel€ð ðat€his€convenience.ðð€€Under€theÏGuidelines,€courts€must€increase€the€child€support€award€if€the€obligor€parentÏfails€to€exercise€standard€visitation.€€As€stated€previously,€the€trial€court€did€notÏmake€any€written€findings€justifying€deviation€from€the€Guidelines€and€if€theyÍapply,€the€amount€of€Husbandððs€child€support€obligation€should€be€increased.Ìà àFinally,€Wife€asserts€that€the€trial€court€erred€in€failing€to€consider€thatÏHusbandððs€employer€provides€him€with€a€company€truck.€€The€GuidelinesÏrequire€a€court€to€include€ð ðin€kindðð€remuneration€in€its€determination€of€theÏobligorððs€gross€income.€€€Tenn.€Comp.€R.€&€Regs.€tit.€10,€ch.€1240„2„4„.03(3)(a).€ÏThis€ð ðin€kindðð€remuneration€includes€ð ðfringe€benefits€such€as€a€company€car.ðð€Ïò òòòId.€€óóó óÌà àHusband€testified€before€the€trial€court€that€he€ð ðhas€the€use€of€the€truckÏat€all€timesðð€and€that€ð ð[h]is€employer€also€provides€all€gasoline,€insurance,Ïupkeep,€maintenance€and€repair€on€the€vehicle.ðð€€Because€evidence€ofÏHusbandððs€use€of€the€company€truck€was€before€the€trial€court,€the€trial€courtÏshould€have€considered€whether€the€use€of€the€truck€constitutes€ð ðin€kindððÏremuneration€under€the€Guidelines€and€added€the€value€of€this€remuneration,€ifÏany,€to€Husbandððs€gross€income.€€Again,€without€written€findings€justifyingÏdeviation€from€the€Guidelines,€the€dictates€of€the€Guidelines€should€apply€toÏthe€particular€circumstances€of€this€case.€€Ìà àAlthough€the€trial€court€correctly€determined€that€the€Child€SupportÏGuidelines€apply€to€both€obligor€parents,€the€case€should€be€remanded€to€theÏtrial€court€for€further€proceedings.€€Accordingly,€the€case€is€remanded€to€theÍtrial€court€to€consider€Husbandððs€child€support€obligation€in€light€of€his€failureÏto€pay€for€medical€insurance€for€the€two€children€in€Wifeððs€custody,€his€failureÏto€exercise€standard€visitation€with€Rachel,€and€his€use€of€a€company€truck.€ÏThe€trial€court€should€follow€the€dictates€of€the€Guidelines€with€respect€toÏthese€issues€or€make€written€findings€stating€the€justification€for€deviating€fromÏthe€Guidelines.€€The€current€child€support€obligation€of€$375.00€per€month€willÏremain€in€effect€until€a€new€support€obligation€is€entered€by€the€trial€court.€€€Ìà
