PlaintiffwasemployedasamanagerofanEmpireOilstorefrom1982to1991.HerlastdayofemploymentwasJanuary18,1991.OnApril8,1991,shefiledchargeswiththeTennesseeHumanRightsCommission(THRC)allegingsexualharassmentanddiscriminationinviolationoftheTennesseeHumanRightsAct(THRA).OnAugust21,1992,sherequestedaRighttoSueletterfromtheCommission,andreceivedsuchletteronOctober2,1992.ShefiledthisactiononDecember30,1992.  TheTrialCourtfoundthatinappropriatesexualadvancesweremadetowardsplaintiffandthattheadvancesinferredorexpressedthatshecouldbenefiteconomicallyifshecooperated.TheCourtconcludedplaintiffterminatedheremploymentbecauseshewasofferedfewerhoursandnotofferedamanagementpositionthatwasavailable.However,theCourtdidnotawarddamagesbecausehedeterminedtheactionwasnotfiledwithintherequisitestatuteoflimitations.  TheActwasamendedin1992toprovideastatuteoflimitationsperiod,runningoneyearfromthetimethediscriminatorypracticeceased.T.C.A.421311 ,   .TheamendedlimitationsperiodbecameeffectiveonMay22,1992,anditisarguedthatitdoesapplyretroactivelytohercaseontheauthorityofShellv.StateofTennessee,893S.W.2d416(Tenn.1995).Assumingthestatutewasapplicablebyitsterms,thestatutebeganrunningatthetimetheallegeddiscriminatorypracticesceased,andfurtherassuming,withoutdeciding,plaintiffsactiondidnotaccrueuntilherhourswerecutandshewaspassedoverforapositioninJanuaryof1991,heractionwasnottimelyfiled.Sheurges,however,thatthelimitationsperiodshouldbeequitablytolledbecauseshetimelyfiledwiththeTHRC,andtheCommissionitselfdidnotcomplywiththetimeconstraintssetforthintheAct,throughnofaultofherown.Shearguesthatsincetheclaimwasoutofhercontrolformorethaneighteenmonths,thelimitationsperiodshouldbesuspended,relyingonBrownv.Crowe,963F.2d895(6thCir.1992).  Plaintiffsargumentfails,becauseherclaimwasnotbeyondhercontrol. .   כTheTHRAprovidesforhersituation,stating:0 0 Ifthecommissionhasfailedtoscheduleahearinginaccordancewith421304orhasfailedtoissueanorderwithinonehundredeighty(180)daysafterthecomplaintisfiled,thecomplainant,respondentoranintervenormaypetitionthechancerycourtinacountyinwhichtheallegeddiscriminatorypracticesetforthinthecomplaintoccursorinwhichthepetitionerresidesorhasthepetitionersprincipalplaceofbusinessforanorderdirectingthecommissiontotakesuchaction....T.C.A.421307(c).̛  Accordingly,astheActmakesprovisionsforthecircumstancessurroundingplaintiffsclaim,equitabletollingisnotappropriate.
