TheTennesseeRehabilitativeInitiativeinCorrectionBoard(TRICOR)isthestateagencychargedwiththeresponsibilitytomanageandoperateTennesseesprisonindustryprogram.ItisaffiliatedwiththeDepartmentofCorrectionforadministrativepurposes.OnSeptember1,1994,TRICORhiredCharlesJ.McKeonasitsexecutivedirector.Mr.McKeonservedatϢTRICORspleasure.Tenn.CodeAnn.4122407(b)(Supp.1996). Mr.McKeonstenurewasrelativelybrief.OnJune1,1994,heinformedTRICORschairperson,DouglasE.Jones,thathehaddecidedtoresign.Threedayslater,heconfirmedthisconversationwithamemorandumtoMr.Jonesconceding"thatweasateamandasindividualshavefailed."Healsorequesteda severancepackageofthreemonthsbecauseheandhisfamilywouldhavevirtuallynoincomeduringthetransitionperioduntilhefoundanewposition.Mr.JonesrespondedtothismemorandumonJune12,1995,acceptingMr.McKeonsresignationanddecliningtoprovidehimwithanysortofseverancebenefits.TheDepartmentofPersonnelsrecordsreflectthatMr.McKeonhad resignednotingoodstanding. Mr.McKeonthereafterfiledaclaimwiththeDivisionofClaimsAdministrationallegingthathehadbeenwrongfullyterminatedandthathewasentitledtobackpayinaccordancewithTenn.CodeAnn.98307(a)(1)(L)(Supp.1996)(breachofwrittencontract)andTenn.CodeAnn.98307(a)(1)(N)(Supp.1996)(negligentdeprivationofstatutoryrights).TheStaterepliedbymovingtodismisstheclaimonseveralgroundsincludingMr.McKeonsstatusasanatwillemployeeandthefactthathehadresigned.TheclaimscommissionerdismissedtheclaimonthegroundthatMr.ϢMcKeons dischargewasbroughtaboutbyhisownresignationbeforethemeetinginquestionandwasnoteffectedbythatmeeting.@ II.  Weturnfirsttotheapplicablestandardofreview.TheclaimscommissionsproceduralrulesaresimilartotheTennesseeRulesofCivilProcedure. ,   כAccordingly,exceptincircumstanceswhenthesetwobodiesofrulesdiffer,theprecedentsconstruingtheTennesseeRulesofCivilProcedureprovidehelpfulguidanceforconstruingthecommissionsproceduralrules.Hembreev.State,App.No.01A019306BC00279,1995WL50066,at*1(Tenn.Ct.App.Feb.8,1995),affd,925S.W.2d513(Tenn.1996). TheStatesmotionwithregardtothisclaimtrackedTenn.R.Civ.P.12and56.Sincetheresolutionofthemotionrequiredtheclaimscommissionertoconsidermaterialsbeyondthepartiespleadings,boththeclaimscommissionerandthiscourtmusttreatitasoneseekingasummaryjudgment.Kanev.State,App.No.8975II,1989WL13963at*12(Tenn.Ct.App.Nov.15,1989)(NoTenn.R.App.P.11app.filed).Thus,ourtaskistoreviewtherecordtodeterminewhethertherequirementsforgrantingasummaryjudgmenthavebeenmet.Paynev.Breuer,891S.W.2d200,201(Tenn.1994);Cowdenv.SovranBank/CentralSouth,816S.W.2d741,744(Tenn.1991).Asummaryjudgmentiswarrantedonlywhenthereexistsnomaterialfactualdisputeconcerningtheclaimordefenseassertedinthemotion,Byrdv.Hall,847S.W.2d208,210(Tenn.1993),andwhenthemovingpartyisentitledtoajudgmentinitsfavorasamatteroflaw.Andersonv.StandardRegisterCo.,857S.W.2d555,559(Tenn.1993). Decisionstograntasummaryjudgmentdonotenjoyapresumptionofcorrectnessonappeal.Carvellv.Bottoms,900S.W.2d23,26(Tenn.1995).Thereviewingcourtsmustviewtheevidenceinthelightmostfavorabletothenonmovingparty,Haynesv.HamiltonCounty,883S.W.2d606,613(Tenn.1994),andwemustdrawallreasonableinferencesinthenonmovingpartysfavor.Pittmanv.UpjohnCo.,890S.W.2d425,428(Tenn.1994).Weshouldaffirmasummaryjudgmentonlyiftheundisputedfactsandtheconclusionsreasonablydrawnfromthefactssupporttheconclusionthatthemovingpartyisentitledtoajudgmentasamatteroflaw.McCallv.Wilder,913S.W.2d150,153(Tenn.1995);Carvellv.Bottoms,900S.W.2dat26.@ III.  TheevidenceofferedbytheStatetosupportitsmotiondemonstratesthatMr.McKeonresignedfromhispositionasTRICORsexecutivedirectoronJune1,1995.Whenconfrontedwiththisuncontradictedevidence,Mr.ϜMcKeonshouldnothavereliedontheallegationsanddenialsinhispleadingstostaveofftheStatesmotion.Byrdv.Hall,847S.W.2dat211;Tenn.R.Civ.P.56.05.HeshouldhaveofferedevidenceofhisowndemonstratingthatthematerialfactsareindisputeorthattheState,forsomeotherreason,isnotentitledtoajudgmentasamatteroflaw.Mr.McKeonprovidednosuchϜevidence.Thus,theundisputedevidenceisthatMr.McKeonresignedfromstateservice.Sinceheresigned,hehasnobasistoassertthathewasϜwrongfullyterminatedorthatTRICORsomehownegligentlydeprivedhimofastatutoryrightatitsmeetingheldafterhehadresigned.̛̜@ IV.
