àThis€appeal€results€from€the€trial€œcourt's›€judg‚ment€modifying€Ïthe€provisions€of€a€marital€dissolution€agreement€entered€into€byÏthese€parties€at€the€time€of€their€divorce€and€incorporated€intoÏthe€final€judgment.€€Mr.€McMichael€petitioned€the€trial€court€forÏa€modification€because€of€a€substantial€decrease€in€his€salary.€ÏThe€trial€court€granted€him€relief.€€Mrs.€McMichael€sought€reliefÏin€this€court.€€òòSeeóó€òòMcMichael€v.€McMichaelóó,€No.€03A01„9402„CH„00044,€(opinion€of€this€court€filed€May€23,€1994).ÌÌà àAt€that€time€this€court€remanded€the€action€to€the€trialÏcourt€for€the€purpose€of€hearing€further€evidence€regarding€theÏhealth€care€premiums€for€Mrs.€McMichael.€€On€remand,€the€trialÏcourt€modified€the€alimony€award,€forgave€the€arrearage€in€alimo…ny,€ordered€Mr.€McMichael€to€pay€for€Mrs.€McMichael's€TennCareÏcoverage,€modified€the€life€insurance€provision€of€their€originalÏagreement€and€awarded€attorney€fees.€€Mrs.€McMichael€has€appealedÏclaiming€the€trial€court€erred€in€its€modification.€€We€affirm€theÏtrial€court.ÌÌà àThese€parties€were€divorced€in€January,€1985.€€At€that€timeÏMr.€McMichael€was€ordered€to€pay€Mrs.€McMichael€$1,000.00€perÏmonth€in€alimony,€to€pay€her€health€insurance€premiums,€and€toÏmaintain€a€life€insurance€policy€on€his€life€in€the€amount€ofÏ$30,000.00€with€Mrs.€McMichael€being€the€beneficiary.ÌÌà àIn€January,€1993,€Mr.€McMichael€petitioned€the€court€seekingÏa€reduction€in€the€alimony€and€relief€from€the€high€premiums€heÏwas€paying€to€maintain€health€insurance€for€Mrs.€McMichael.€€AsÏgrounds€for€relief,€he€asserted€that,€essential‚ly,€he€had€beenÏconstructively€discharged€from€the€place€where€he€was€employed€atÏthe€time€of€the€divorce.€€The€evidence€indicates€that€Mr.ÏMcMichael€was€working,€at€that€time,€as€a€senior€engineer€makingÏover€$70,000.00€annually.€€His€employer€informed€him€that€he€œwasÏto›€be€demoted€to€a€junior€position€with€an€income€of€$25,000.00Ïannually.€€Mr.€McMichael€left€this€employment€and€sought€a€higherÏpaying€position€more€commensurate€with€his€abilities€and€experi…ence.€€However,€when€he€left€his€original€position,€he€lost€theÏbenefit€of€a€life€insurance€policy€on€his€life€on€which€Mrs.ÏMcMichael€was€the€beneficiary.ÌÌà àThe€trial€court€ordered€Mr.€McMichael€to€continue€paying€forÏMrs.€McMichael's€health€insurance,€reduced€the€life€insuranceÏrequirements€to€$20,000.00,€reduced€his€monthly€alimony€obligationÏfrom€$1,000.00€per€month€to€$500.00€per€month,€forgave€all€arrear…age,€and€awarded€Mrs.€McMichael€$500.00€in€attorney€fees.ÌÌà àIn€Mrs.€McMichael's€original€appeal,€she€challenged€theÏjudgment€of€the€trial€court€modifying€the€original€agreement€ofÏthe€parties€which€was€incorporated€in€the€final€decree€of€theÏcourt.€€She€further€sought€to€bring€to€this€court's€attention,€inÏthe€form€of€a€post€judgment€fact,€that€her€health€care€insuranceÏwas€now€through€TennCare€and€the€premiums€were€much€lower€than€Mr.ÏMcMichael€was€paying€at€the€time€of€the€first€hearing.€€This€courtÏremanded€the€cause€œfor€the›€œtaking€of›€further€evidence€on€the€issueÏof€the€amount€of€the€premium€for€the€health€care€coverage€and€itsÏimpact€on€the€amount€of€alimony.ÌÌà àUpon€remand,€the€trial€court€in€addition€to€considering€theÏimpact€of€the€reduced€insurance€premium,€also€considered€theÏfinancial€circum‚stances€and€other€conditions€of€both€parties€atÏthat€time.€€At€the€conclusion€of€the€hearing,€the€trial€courtÏordered€Mr.€McMichael€to€pay€alimony€in€the€amount€of€$750.00€perÏmonth;€to€pay€directly€to€Mrs.€McMichael€the€sum€$123.31€eachÏmonth€for€TennCare€premiums,€her€deductible€and€out„of„pocketÏexpense;€awarded€Mrs.€McMichael€an€attorney€fee€of€$500.00€for€theÏhearing€on€remand;€ordered€Mr.€McMichael€to€maintain€a€life€insur…ance€policy€in€the€amount€of€$20,000.00€payable€to€Mrs.€McMichael;Ïforgave€all€arrearage;€and€awarded€an€additional€$500.00€in€attor…ney€fees€to€Mrs.€McMichael.ÌÌà àMrs.€McMichael€has€appealed€raising€the€following€issues€forÏour€review:€ÌÌÓÓà8 àà0 àà à1.à àThe€trial€court€erred€in€reducing€Mr.€McMichael'sÏalimony€obligation€to€Mrs.€McMichael.ÌÌà8 àà0 àà à2.à àThe€trial€court€erred€in€forgiving€all€of€Mr.ÏMcMichael's€alimony€arrearage€and€failing€to€holdÏhim€in€contempt€for€his€wilful€failure€to€pay€hisÏalimony€obligation€accrued€prior€to€trial.ÌÌà8 àà0 àà à3.à àThe€trial€court€erred€in€modifying€that€part€of€theÏproperty€settlement€agreement€of€the€parties€whichÏrequired€Mr.€McMichael€to€maintain€a€$30,000€lifeÏinsurance€policy€for€the€benefit€of€Mrs.€McMichael.ÌÌà8 àà0 àà à4.à àThe€trial€court€erred€in€arbitrarily€awarding€Mrs.ÏMcMichael's€attorney€a€$500.00€attorney€fee€at€bothÏthe€October€1993€hearing€and€the€March€1995€hearingÏwithout€any€further€consideration€of€time€spent€inÏthis€cause.ÌÓÓÌà àOn€application€of€either€party€for€spousal€support€the€courtÏmay€decree€an€increase€or€decrease€of€such€allowance€only€upon€aÏshowing€of€a€substantial€and€material€change€of€circumstances.ÏT.C.A.€ðð€36„5„101(a)(1).€€The€party€seeking€relief€on€the€groundsÏof€changed€circumstances€has€the€burden€of€proving€the€changedÍcircumstances,€which€must€be€shown€to€have€occurred€after€theÏentry€of€the€divorce€decree,€and€must€not€have€been€foreseeableÏwhen€the€decree€was€entered€into€or€in€the€contemplation€of€theÏparties€when€they€entered€into€the€support€and€alimony€agreement.ÏòòSeeóó€òòElliot€v.€Elliotóó,€825€S.W.2d€87€(Tenn.€App.€1991),€and€òòMcCartyÏv€McCartyóó,€863€S.W.2d€716€(Tenn.€App.€1992).ÌÌà àOur€review€is€de€novo,€however,€and€the€record€developedÏbelow€comes€to€us€accompanied€by€a€presumption€of€correctnessÏwhich€we€must€honor€unless€we€find€that€the€evidence€preponderatesÏagainst€the€trial€court's€findings€of€fact.€T.R.A.P.€13(d);€òòUnionÏCarbide€œCorp.›€v.€œHuddleston›óó,€854€S.W.2d€87,€91€(Tenn.€1993).€€WeÏare€also€mindful€that€a€trial€court€has€wide€discretion€in€theÏmatters€under€review,€i.e.,€division€of€marital€property€andÏalimony.€€òòMarmino€v.€Marminoóó,€34€Tenn.€App.€352,€238€S.W.2d€105,Ï107€(Tenn.€App.€1950);€òòHarrington€v.€Harringtonóó,€798€S.W.2d€244,Í245€(Tenn.€App.€1990).€We€give€a€trial€court's€decision€on€theseÏmatters€great€weight€and€will€only€interfere€with€such€a€decisionÏwhen€we€find€an€abuse€of€discretion.€òòKelly€v.€Kellyóó,€679€S.W.2dÏ458,€460€(Tenn.€App.€1984).€ÌÌà àWe€shall€address€the€first€three€issues€together.€€As€theÏbasis€for€his€petition€to€modify€his€support€obligation€to€Mrs.ÏMcMichael,€Mr.€McMichael€alleged€that€his€employment€was€about€toÏbe€terminated€and€upon€termination€he€would€lose€the€life€insur…ance€policy€payable€to€Mrs.€McMichael€and€the€health€insuranceÏthat€he€carried€for€her.€€The€trial€judge€implicitly€found€thatÏthese€changes€were€substantial€enough€to€warrant€a€modifica‚tion€inÏMr.€Mc‚Michael's€support€obligation€to€Mrs.€McMichael.€€The€trialÏcourt€then€examined€the€circumstances€of€the€parties.€€The€trialÏcourt,€in€his€opinion,€announced€from€the€œbench,€transcribed›€andÏincorporated€into€the€final€judgment€by€reference,€found€that€theÍoriginal€agreement€was€based€upon€Mr.€McMichael's€salary€ofÏ$70,000.00.€€He€further€found€that€his€salary€was€now€reduced€toÏ$53,000.00.€€We€agree€with€the€trial€court€that€this€change€inÏcircumstances€is€substantial€and€sufficient€to€warrant€a€modifica…tion€of€the€original€decree.ÌÌà àWith€regard€to€the€reduction€in€life€insurance€benefits,€theÏappellant€argues€that€the€$30,000.00€policy€was€a€part€of€theÏdivision€of€the€marital€estate€and€is€not€subject€to€modification.€ÏIn€support€of€her€position,€she€relies€on€òòJones€v.€Jonesóó,€784ÏS.W.2d€349€(Tenn.€App.€1989).€€òòJonesóó€is€clearly€distinguishableÏfrom€the€case€at€hand.€€In€òòJonesóó,€the€court€found€that€the€trialÏcourt€in€a€prior€decree€found€that€"the€life€insurance€benefitsÏawarded€to€[the€wife]€in€the€final€decree€was€a€division€of€mari…tal€property€and€not€subject€to€modification."€€No€appeal€wasÏtaken€from€this€decree.€€This€court€held€that€because€there€was€noÍappeal,€the€decree€had€become€final€and€the€findings€of€the€trialÏcourt€became€the€"law€of€the€case"€as€distinguished€from€theÏgeneral€law.€€In€this€case,€we€view€the€required€insurance,€not€asÏa€division€of€œproperty,›€but€as€a€part€of€alimony€in€futuro€whichÏis€subject€to€modification.ÌÌà àIn€conclusion,€we€note€that€there€are€other€reasons€appearingÏin€the€record€which€would€allow€the€trial€court€to€modify€theÏaward€of€alimony€payable€to€the€appellant.€€The€appellant€had€aÏmale€live„in€friend€who€admittedly€shares€the€expenses€incurredÏfor€rent,€utilities,€automobile€expenses,€food€and€other€costs.€ÏT.C.A.€ðð€36„5„101(a)(3)€provides€as€follows:ÌÌÓÓà8 àà àà àà à(3)€€In€all€cases€where€a€person€is€receivingÏalimony€in€futuro€and€the€alimony€recipient€lives€with€aÏthird€person,€a€rebuttable€presumption€is€thereby€raisedÏthat:ÌÌà8 àà0 à(A)à àThe€third€person€is€contributing€to€the€sup…port€of€the€alimony€recipient€and€the€alimonyÏrecipient€therefore€does€not€need€the€amount€ofÏsupport€previously€awarded€and€the€court€thereforeÏshould€suspend€all€or€part€of€the€alimony€obliga…tion€of€the€former€spouse;€orÌÌà8 àà0 à(B)€The€third€person€is€receiving€support€from€theÏalimony€recipient€and€the€alimony€recipient€doesÏnot€need€the€amount€of€alimony€previously€awardedÏand€the€court€therefore€should€suspend€all€or€partÏof€the€alimony€obligation€of€the€former€spouse.ÌÌà@ à*€€€€€*€€€€€*€€€€€*ÌÌÌÓÓà àIn€this€case€it€is€admitted€that€the€third€person€living€withÏMrs.€McMichael€is€contributing€to€her€support.€€Further,€it€hasÏbeen€demonstrated€that€from€the€time€of€the€divorce€in€1985€untilÏthe€hearing€in€this€case,€the€appellant€has€been€somewhat€of€aÏspendthrift€while€the€appellee€has€preserved€the€assets€which€heÏreceived€as€a€part€of€the€marital€property€division€and€has€man…aged€to€accumulate€additional€assets€since€the€divorce.€€TheÍappellee€should€not€be€penalized€for€the€spending€habits€of€hisÏformer€spouse€nor€his€frugality.ÌÌà àWith€regard€to€the€forgiveness€of€the€alimony€arrearage,€Mrs.ÏMcMichael€testified€that€Mr.€McMichael€paid€the€required€alimonyÏpayments€faithfully€every€month€from€1985€until€his€employmentÏproblems.€€He€further€paid€œall€other›€sums€required€of€him€duringÏthat€time.€€We€also€conclude€that,€under€the€circumstances,€for…giveness€of€the€arrearage€was€reasonable.ÌÌà àœWe€find›€no€abuse€of€discretion€by€the€trial€court€in€makingÏthe€modifications€to€the€decree€complained€of€in€the€first€threeÏissues€presented€by€the€appellant.ÌÌà àLastly,€Mrs.€McMichael€argues€that€the€trial€court€erred€inÏits€award€of€attorney€fees.€€Mrs.€McMichael€complains€that€theÍaward,€at€both€hearings,€was€arbitrary€and€not€based€upon€anyÏconsideration€of€time€expended€on€her€behalf€by€her€attorney.€€WeÏmust€be€mindful€that€attorney€fee€awards€are€treated€as€alimony.ÏòòGilliam€v.€Gilliamóó,€776€S.W.2d€81,€86€(Tenn.€App.€1988).€€TheseÏawards€are€within€the€sound€discretion€of€the€trial€court,€andÏunless€the€evidence€preponderates€against€that€award,€it€will€notÏbe€disturbed€on€appeal.€òòStorey€v.€Storeyóó,€835€S.W.2d€593,€599Ï(Tenn.€App.€1992).€€In€determining€the€amount€of€attorney€fees€asÏthey€relate€to€alimony,€the€court€may€but€is€not€required€to€lookÏto€the€time€expended€by€a€party's€attorney€in€the€preparation€andÏtrial€of€a€case.€€As€with€any€alimony€award,€in€deciding€whetherÏto€award€attorney's€fees€as€alimony,€the€trial€court€should€con…sider€the€relevant€factors€enumerated€in€T.C.A.€ðð€36„5„101(d).ÏòòStoryóó,€supra.ÌÌà àIn€our€consideration€of€the€award€of€attorney€fees,€we€pointÏout€that€the€award€is€not€made€to€the€attorney€nor€does€it€haveÏany€bearing€on€the€contractual€relationship€between€the€attorneyÏand€client.€€The€court€is€not€bound€to€award€attorney€fees€inÏaccordance€with€the€contract€between€the€attorney€and€client.€€TheÏcourt€may€make€an€award€solely€for€the€purpose€of€helping€toÏdefray€the€expenses€of€hiring€an€attorney.€€"Trial€courts€areÏpermitted€to€make€additional€awards€to€defray€the€legal€expensesÏresulting€from€a€divorce€proceeding.€€òòPalmer€v.€Palmeróó,€562€S.W.2dÏ833€(Tenn.€App.€œ1977).›€These€decisions,€like€those€involvingÏsupport€and€maintenance,€are€within€the€trial€court's€dis‚cretion.€ÏòòFox€v.€Foxóó,€657€S.W.2d€747€(Tenn.€1983);€òòHardin€v.€Hardinóó,€689ÏS.W.2d€152,€154€(Tenn.€App.€1983).€This€Court€is€not€inclined€toÏsecond„guess€the€trial€court€unless€the€evidence€preponderatesÏagainst€its€decision."€€òòBatson€v.€Batsonóó,€769€S.W.2d€849€(Tenn.ÏApp.€1988).ÌÌà àCounsel€for€the€appellant€filed€an€affidavit€with€the€trialÏcourt€itemizing€expenses€incurred€and€fees€charged€for€representa…tion€from€March€26,€1993,€through€March€29,€1995.€€We€are€not€atÏliberty€to€presume€as€urged€by€appellant€that€the€court€arbitrari…ly€awarded€attorney€fees€without€consideration€of€time€spent€onÏthe€case.€€A€public€official,€in€the€absence€of€proof€to€theÏcontrary,€is€presumed€to€do€his€duty.€òòSeeóó€òòState€ex€rel.€œBiggs›€v.ÏBarclayóó,€216€S.W.2d€711€(Tenn.€1948).€€Therefore,€in€the€absenceÏof€evidence€showing€otherwise,€we€must€presume€that€the€trialÏjudge€correctly€and€adequately€considered€all€evidence€on€allÏissues€properly€presented.ÌœÌà àWe€find€no€abuse€of€discretion€on€the€part€of€the€trialÏcourt.€€Further,€we€find€that€the€evidence€does€not€preponderateÏagainst€the€judgment€of€the€trial€court.ÌÌà àThe€appellant€has€asked€this€court€to€remand€the€case€to€theÏtrial€court€for€the€purpose€of€awarding€attorney€fees€for€theÏprosecution€of€this€appeal.€€We€do€not€feel€that€this€is€an€appro…priate€case€for€an€award€of€attorney€fees.ÌÌà àThe€trial€court€is€affirmed€in€all€respects.€€Costs€of€thisÏappeal€are€taxed€to€the€appellant€and€this€cause€is€remanded€toÏthe€trial€court€for€the€collection€thereof.ÌÌÌÓÓà€
