àThis€appeal€involves€a€dispute€arising€from€a€lease€agreement€Ìbetween€the€parties.€€Mr.€Meadows,€the€lessor,€filed€suit€againstÏMr.€Greene,€the€lessee,€claiming€breach€of€the€lease€agreement.€ÏThe€trial€court€found€in€favor€of€Mr.€Meadows€and€awarded€judg…ment.€€Mr.€Greene€has€appealed€claiming€that€the€trial€court€erredÏin€so€doing.€€We€affirm€the€judgment€of€the€trial€court.ÌÌà àThese€parties€entered€into€a€lease€agreement€on€February€1,Ï1990.€€The€lease€term€was€for€a€period€of€five€years€and€involvedÏa€commercial€building€and€certain€specified€equipment.€€ThisÏparticular€location€was€used€as€a€convenient€market/deli/gasÏstation.€Pat€Dixon€managed€the€day„to„day€operation€of€the€busi…ness.€ÌÌà àApproximately€one€year€before€the€lease€agreement€was€to€haveÏexpired,€Mr.€Greene€wrote€Mr.€Meadows€a€letter€complaining€of€Mr.ÏMeadows'€behavior€while€on€the€leased€premises€and€stating€thatÏdue€to€such€behavior,€he€was€vacating€the€premises.€€Between€theÏtime€that€Mr.€Greene€mailed€the€letter€and€the€time€that€Mr.ÏMeadows€received€the€letter,€Ms.€Dixon€vacated€the€premises.€ÏShortly€thereafter,€Mr.€Greene€sent€Mr.€Meadows€another€letterÏessentially€recanting€some€of€the€complaints€set€out€in€the€firstÏletter.ÌÌà àOn€February€4,€1994,€the€parties€inspected€the€premises€andÏsubsequently€signed€a€document€stating€that€all€pertinent€equip…ment€was€in€the€building.€€This€document€did€not€mention€theÏcondition€of€the€equipment.ÌÌà àThe€record€reflects€that€Mr.€Meadows€performed€a€number€ofÏrepairs€on€the€building€and€on€the€equipment.€€In€March,€1994,€heÏrelet€the€premises.€€The€new€lease€was€for€a€lesser€amount€of€rentÍthan€that€with€Mr.€Greene.€€In€July€or€August€of€1994,€the€newÏtenants€also€vacated€the€premises,€leaving€behind€equipment€theyÏhad€purchased€as€payment€towards€future€rent€owed.€ÌÌà àMr.€Meadows€filed€a€complaint€against€Mr.€Greene€allegingÏthat€Mr.€Greene€had€wrongfully€vacated€the€premises,€had€not€givenÏproper€notice,€and€had€failed€to€pay€proper€rents€as€required€byÏthe€lease€terms.€€Additionally,€Mr.€Meadows€alleged€that€Mr.ÏGreene€had€failed€to€pay€the€appropriate€amount€of€property€taxesÏand€had€left€the€premises€in€such€a€state€of€disrepair€that€heÏ(Mr.€Meadows)€had€to€spend€substantial€sums€of€money€to€return€theÏpremises€to€a€reasonable€level€of€repair€for€occupancy€by€a€newÏtenant.ÌÌà àMr.€Greene€answered€denying€all€the€allega‚tions€of€the€com…plaint.€He€alleged€as€affirmative€defenses€that€Mr.€Meadows€hadÏbreached€the€lease€by€failing€to€properly€maintain€the€premisesÏand€by€appearing€on€the€premises€in€a€drunken€or€disorderly€mannerÍand€thus€interfering€with€Mr.€Greene's€"peaceable€and€quiet€enjoy…ment€of€the€building€...€."ÌÌà àAfter€receiving€extensive€evidence€the€chancellor€rendered€aÏmemorandum€opinion€in€which€she€made€extensive€findings€of€fact€Ïand€conclusions€of€law.€€She€found€in€favor€of€the€plaintiff,€Mr.ÏMeadows,€on€most€issues€before€the€court.€€Judgment€was€entered€inÏaccordance€with€the€chancellor's€opinion€awarding€Mr.€MeadowsÏrental€in€the€amount€of€$1,750.00;€unpaid€taxes€in€the€amount€ofÏ$600.00;€$8,641.22€for€repairs€to€the€premises€including€labor€andÏmaterials;€and€for€attorney's€fees€in€the€amount€of€$4,677.50.€€ÌÌà àMr.€Greene€has€appealed€from€this€judgment€listing€numerousÏissues€for€our€review.€€In€sum€and€substance,€the€issues€presentedÏby€the€appellant,€Mr.€Greene,€are€simply€a€challenge€to€the€suffi…ciency€of€the€evidence.ÌÌà àOur€standard€of€review€of€findings€of€fact€by€the€trial€courtÏis€de€novo€upon€the€record€of€the€trial€court,€accompanied€by€aÍpresumption€of€the€correctness€of€the€finding,€unless€the€prepon…derance€of€the€evidence€is€other‚wise.€€T.R.A.P.€13(d).ÌÌà àThe€record€fails€to€establish€that€the€evidence€preponderatesÏagainst€the€findings€of€the€chancellor.€€Further,€we€find€no€errorÏin€her€conclusions€of€law.€€We€find€the€appellant's€issues€to€beÏwithout€merit.ÌÌà àIn€addition€to€the€issues€presented€by€the€appellant,€theÏappellee€has€presented€two€issues€for€our€review:ÌÌÓÓà8 àà0 àà à1.à àDid€the€trial€court€err€in€failing€to€award€plain…tiff€one€third€of€the€total€property€taxes€due€onÏthe€entire€tract€of€land€in€accordance€with€theirÏprevious€custom€and€usage€between€the€parties€asÏopposed€to€the€$600.00€alleged€to€be€the€agreementÏbetween€the€parties€but€never€consummated€by€theÏcashing€of€the€alleged€tender.ÌÌà8 àà0 àà à2.à àDid€the€trial€court€err€in€the€application€of€theÏlaw€by€denying€plaintiff€the€$250.00€per€month€forÏfive€months€rental€reduction€granted€to€the€subse…quent€tenant€for€the€five€months€in€which€theÏreduction€is€granted€to€the€tenant.ÌÌÓÓÌà àMr.€Meadows€first€takes€issue€with€the€amount€of€propertyÏtaxes€that€Mr.€Greene€was€found€to€have€owed.€€The€court€stated€inÏits€opinion€that€it€believed€that€Mr.€Meadows€agreed€to€theÏ$600.00€payment€as€payment€in€full.€€Since€the€evidence€on€thisÏissue€was€con‚flicting,€the€credibility€of€the€witnesses€becomes€anÏimportant€factor.€Findings€of€the€trial€court€which€are€dependentÏon€determining€the€credibility€of€witnesses€are€entitled€to€greatÏweight€on€appeal€because€the€trial€judge€had€the€opportunity€toÏobserve€the€manner€and€demeanor€of€the€witnesses€while€testifying.ÏòòGalbreath€v.€Harrisóó,€811€S.W.2d€88€(Tenn.€App.€1990)€citing€òòTownÏof€Alamo€v.€Forcum„James€Coóó.,€327€S.W.2d€47€(Tenn.€1959).€€...Ï[O]n€an€issue€which€hinges€on€witness€credibility,€the€trial€courtÏwill€not€be€reversed€unless€there€is€found€in€the€record€clear,Ïconcrete,€and€convincing€evidence€other€than€the€oral€testimony€ofÏwitnesses€which€contradict€the€trial€court's€findings.€€òòSeeóó€ÏòòTennessee€Valley€Kaolin€Corp.€v.€Perryóó,€526€S.W.2d€488€(Tenn.€App.Ï1974).ÌÌà àLastly,€Mr.€Meadows€takes€issue€with€the€allowance€of€a€rentÏdeduction€afforded€subsequent€tenants€of€the€premises.€€The€trialÏcourt€found€that€this€was€a€mere€accomm‚odation€made€in€an€effortÏto€entice€new€tenants€into€the€building.€€Additionally,€the€trialÏcourt€found€that€there€was€no€evidence€that€the€rental€value€ofÏthe€building€was€any€less€than€$1750.00€charged€to€the€lesseeÏafter€repairs€were€made.€Since€the€evidence€does€not€preponderateÏagainst€these€findings,€we€are€of€the€opinion€that€there€was€noÏerror€of€law€in€the€conclusions€reached€by€the€chancellor.ÌÌà
