àFor€purposes€of€Haulersðð€summary€judgment€motion,€the€following€facts€wereÏundisputed.€€Moore€applied€for€the€automobile€insurance€policy€in€question€in€June€1993€throughÏher€family€insurance€agent,€Kenneth€Baker.€€Baker€filled€out€the€insurance€application€for€Moore,Ïand€Moore€signed€the€application.€€The€application€required€Moore,€in€a€section€entitledÏDRIVER/HOUSEHOLD€RESIDENTS,€to€list€ð ðall€residents€of€household€14€years€or€older.ðð€€TheÏapplication,€as€completed€by€Baker€and€signed€by€Moore,€listed€only€Moore€in€this€section.€€ThisÏinformation€was€not€correct€because€the€decedent,€Tracy€Moore,€was€over€the€age€of€14€and€heÏlived€in€Mooreððs€home€at€the€time€she€applied€for€the€policy.€€Although€Tracy€was€not€listed€on€theÏapplication,€Moore€informed€Baker€at€the€time€of€application€that€Tracy€and€some€of€her€otherÏchildren€resided€in€her€home.€€Moore€explained€that€she€did€not€want€Tracy€and€her€other€childrenÏlisted€because€she€would€not€allow€them€to€drive€her€car€and€she€could€not€afford€additionalÏpremiums€for€the€children.ÌÌà àThe€policy€subsequently€issued€by€Haulers€contained€provisions€for€uninsuredÏmotorist€coverage.€€As€pertinent,€these€provisions€afforded€insurance€coverage€to€Moore€and€anyÏð ðfamily€member.ðð€€The€policy€defined€ð ðfamily€memberðð€as€ð ða€person€related€to€[Moore]€by€blood,Ïmarriage€or€adoption€who€is€a€resident€of€[Mooreððs]€household.ðð€€Relative€to€Mooreððs€duty€toÍnotify€Haulers€of€an€accident€or€loss,€the€policy€provided€that:ÌÌÓÓà8 àWe€[Haulers]€have€no€duty€to€provide€coverage€under€this€policyÏunless€there€has€been€full€compliance€with€the€following€duties:ÌÌà8 àA.à0 àWe€must€be€notified€promptly€of€how,€when€and€where€theÏaccident€or€loss€happened.€€Notice€should€also€include€theÏnames€and€addresses€of€any€injured€persons€and€of€anyÏwitnesses.ÌÌÓÓÌà àOn€October8,€1994,€21„year„old€Tracy€was€fatally€injured€in€a€one„car€accident.€ÏTracyððs€friend,€Defendant€JamesA.€Prescott,II,€was€driving€the€car.€€At€the€time€of€the€accident,ÏTracy€was€still€a€resident€of€Mooreððs€home.€€At€the€funeral€home€after€Tracyððs€death,€MooreÏlearned€from€Prescottððs€father€that€Prescott€was€uninsured.€€Within€a€few€weeks€after€the€accident,ÏMoore€consulted€some€attorneys€in€Lexington,€but€they€advised€Moore€that€filing€a€lawsuit€wouldÏbe€pointless€because€Prescott€was€uninsured€and€because€Tracy€was€not€listed€as€an€additionalÏinsured€on€Mooreððs€automobile€insurance€policy.€€ÌÌà àSometime€after€January€1,€1995,€Mooreððs€insurance€agent,€Baker,€learned€thatÏTracy€had€been€killed€in€a€car€accident.€€One€of€Tracyððs€brothers€was€in€Bakerððs€office€paying€aÏpremium,€and€he€showed€Baker€a€newspaper€clipping€about€Tracyððs€death.€€About€four€or€fiveÏmonths€after€the€accident,€Moore€was€in€Bakerððs€office€on€some€unrelated€business.€€When€MooreÏtold€Baker€about€Tracyððs€accident,€Baker€stated€that€he€knew€about€the€accident€because€he€hadÏread€about€it€in€the€newspaper.€€During€this€conversation,€Moore€also€informed€Baker€that€theÏdriver€of€the€car,€Prescott,€was€uninsured.€€Baker€then€made€a€telephone€call€on€Mooreððs€behalf€toÏdetermine€if€Prescottððs€father€could€be€held€liable€for€the€accident.€€Upon€concluding€the€call,€BakerÏtold€Moore€that€Prescottððs€father€could€not€be€held€liable€because€Prescott€was€over€18€years€ofÏage.€€ÌÌà àIn€September€1995,€Moore€made€one€last€attempt€to€consult€an€attorney€aboutÍTracyððs€accident.€€The€attorney€with€whom€Moore€met€this€time€agreed€to€represent€Moore€on€herÏclaim€for€Tracyððs€death.€€On€September28,€1995,€Mooreððs€new€attorney€notified€Baker€that€MooreÏwould€be€filing€a€claim€under€the€uninsured€motorist€provisions€of€Mooreððs€policy€with€Haulers.ÌÌà àIn€October€1995,€Moore€filed€this€lawsuit€against€Prescott.€€Haulers,€as€MooreððsÏuninsured€motorist€carrier,€was€served€with€a€copy€of€the€complaint.€€In€its€answer,€Haulers€raisedÏas€defenses,€ò òòòinter€aliaó óóó,€(1)that€Moore€failed€to€give€prompt€notice€of€the€claim€for€Tracyððs€deathÏas€required€by€the€provisions€of€Mooreððs€insurance€policy€and€(2)that€Moore€made€a€materialÏmisrepresentation€on€her€application€for€insurance€by€failing€to€identify€Tracy€as€an€individual€overÏthe€age€of€14€residing€in€Mooreððs€home.€€Based€on€these€defenses,€Haulers€subsequently€movedÏfor€summary€judgment€on€the€issue€of€coverage.€€By€consent€order,€the€parties€agreed€to€sever€theÏcoverage€issue€from€the€remaining€issues€in€the€lawsuit.ÌÌà àIn€granting€Haulersðð€motion€for€summary€judgment,€the€trial€court€cited€theÏfollowing€reasons:ÌÌÓÓà8 àà à1.à à[Moore]€failed€to€give€prompt€notice€of€the€claim€inÏquestion€to€[Haulers];ÌÌà8 àà à2.à àThe€policy€in€question€did€not€afford€coverage€for€theÏclaim€as€asserted.€€ÌÌÓÓÌThis€appeal€followed.ÌÌà àIn€ò òòòLeev.€Leeó óóó,€732€S.W.2d€275€(Tenn.€1987),€our€supreme€court,€in€construingÏan€identical€policy€provision€requiring€prompt€notification€of€loss,€concluded€that€such€noticeÏprovisions€impose€upon€the€insuredÌÌÓÓà8 à[The]€duty...€to€give€notice€when€[the€insured]€becomes,€orÏshould€become€aware€of,€facts€which€would€suggest€to€a€reasonablyÍprudent€person€that€the€event€for€which€coverage€is€sought€mightÏreasonably€be€expected€to€produce€a€claim€against€the€insurer.ÌÌÓÓÌò òòòLeeó óóó,€732€S.W.2d€at€276.€€This€Court€subsequently€has€made€clear€that€the€duty€to€give€notice€doesÏnot€arise€until€an€ordinarily€or€reasonably€prudent€person€would€have€known€(1)that€an€event€hadÏoccurred,€and€(2)that€such€event€might€reasonably€be€expected€to€produce€a€claim€against€theÏinsurer.€€ò òòòAllstate€Ins.€Co.v.€Wilsonó óóó,€856€S.W.2d€706,€709€(Tenn.€App.€1992).ÌÌà àIn€ò òòòAllstate€Insurance€Co.v.€Wilsonó óóó,€856€S.W.2d€706,€709€(Tenn.€App.Ï1992),€the€event€in€question,€an€accidental€shooting,€occurred€on€May23,€1988,€but€the€insuredsÏdid€not€notify€their€insurance€company€of€the€accident€until€October24,€1988.€€The€court€held€that,Ïunder€these€circumstances,€the€insureds€failed€to€comply€with€the€notice€provisions€of€theirÏhomeownerððs€policy.€€ò òòòId.ó óóó€€The€court€reasoned€that,€although€the€insureds€had€reasonable€groundsÏto€believe€that€a€claim€would€arise€against€them,€ð ð[t]hey€gave€no€notice€to€the€insurance€companyÏuntil€approximately€five€months€after€the€incident€occurred.ðð€€ò òòòId.ó óóóÌÌà àIn€an€unreported€decision,€the€middle€section€of€this€Court€has€concluded€that€evenÏa€three„month€delay€in€reporting€the€accident€may€constitute€a€breach€of€the€insuredsðð€duty€toÏprovide€prompt€notice.€€In€ò óóó,€No.Ï01A01„9006„CH„00221,€1990€WL€165071,€at€*2€(Tenn.€App.€Oct.31,€1990),€the€incidentÏoccurred€on€July3,€1988,€when€the€insuredsðð€dog€bit€a€child€on€the€ear.€€The€insureds€were€notÏaware€that€their€homeownerððs€policy€provided€liability€coverage€for€such€incidents,€so€they€did€notÏnotify€their€insurer€of€the€incident€until€October13,€1988,€three€months€and€ten€days€later.€€InÏconcluding€that€the€insureds€had€breached€their€duty€of€prompt€notice,€the€court€focused€on€whatÏthe€insureds€knew,€or€should€have€known,€at€the€time€the€incident€occurred.€€ò òòòId.ó óóó,€at€*3.€€First,€itÏwas€uncontradicted€that€the€insureds€knew€they€had€a€homeownerððs€policy€with€the€insurer.€ÏFurther,€the€court€concluded€that€the€insureds€were€charged€with€knowledge€of€the€policyððsÏprovisions,€including€the€liability€provision€which€would€have€covered€the€event€in€question.€ÍFinally,€the€court€noted€that€the€insureds€should€have€been€aware€of€the€seriousness€of€the€incidentÏbecause€the€injured€child€bled€a€great€deal€and€the€police€were€called€to€investigate.€€ò óóó,€No.€03A01„9512„CV„00426,€1996€WLÏ149383€(Tenn.€App.€Apr.3,€1996),€the€court€held€that€the€insured€breached€the€duty€to€provideÏprompt€notice€where€the€insured€waited€over€six€months€before€reporting€a€car€accident€in€which€heÏwas€involved.€€In€determining€when€the€insured€should€have€provided€notice€of€the€accident,€theÏcourt€again€focused€on€the€knowledge€in€the€insuredððs€possession.€€Initially,€the€insured€did€notÏconsider€the€car€accident€to€be€serious€enough€to€report€because€he€only€ð ðbumpedðð€the€rear€ofÏanother€vehicle€and,€upon€questioning,€the€vehicleððs€occupants€indicated€that€they€were€unhurt.€Ïò òòòId.ó óóó,€at€*1.€€Two€to€six€weeks€after€the€accident,€however,€the€insured€was€informed€by€the€ownerÏof€the€other€vehicle€that€the€car€had€been€ð ðtotaled.ðð€€ò òòòId.ó óóó€€The€court€concluded€that,€under€theseÏundisputed€facts,€the€insured€ð ðhad€a€duty€to€give€notice€to€his€insurance€company€of€the€accident,Ïcertainly€no€later€than€the€time€the€owner€of€the€other€vehicle€advised€him€that€the€vehicle€had€beenÏððtotaledðð.ðð€€ò òòòId.ó óóó,€at€*2.ÌÌà àIn€the€present€appeal,€Moore€contends€that€she€complied€with€the€automobileÏinsurance€policyððs€prompt€notification€provision€when€she€discussed€Tracyððs€death€with€her€agent,ÏBaker,€four€or€five€months€after€the€accident.€€During€this€conversation,€Baker€was€notified€thatÏTracy€had€been€fatally€injured€in€a€car€accident€and€that€the€carððs€driver€was€uninsured.€€Baker€alsoÏhad€been€told€at€the€time€the€policy€was€issued€that€Tracy€still€lived€at€home.ÌÌà àFor€purposes€of€this€appeal,€we€need€not€decide€the€issue€of€whether€theÏinformation€learned€by€Baker€during€this€conversation€constituted€sufficient€notice€of€the€accidentÏunder€the€terms€of€Haulersðð€policy.€€Even€assuming€that€the€information€provided€was€sufficient,Ïwe€conclude,€as€a€matter€of€law,€that€Mooreððs€four„€to€five„month€delay€in€notifying€Baker€of€theÏaccident€constituted€a€breach€of€Mooreððs€duty€to€provide€prompt€notice€of€the€accident€under€theÍpolicy.€€ò àIn€reaching€this€conclusion,€we€have€considered€the€knowledge€in€MooreððsÏpossession€shortly€after€the€death€of€her€son.€€Moore€knew€that€Tracy€had€been€involved€in€aÏserious€car€accident€which€had€resulted€in€his€death.€€At€the€funeral€home€shortly€thereafter,€MooreÏlearned€from€the€father€of€the€carððs€driver€that€the€driver€was€an€uninsured€motorist.€€Moreover,€asÏthe€insured€under€the€subject€policy,€Moore€was€charged€with€knowledge€of€the€policyððsÏprovisions,€including€the€uninsured€motorist€provisions.€€ò óóó,Ï1990€WL€165071,€at€*3.€€Based€on€the€undisputed€facts,€Mooreððs€duty€to€give€the€insurer€promptÏnotification€of€Tracyððs€accident€arose€no€later€than€the€time€Moore€was€informed€that€the€onlyÏdriver€involved€in€the€single„car€accident€was€uninsured.€€ò àAlternatively,€Moore€argues€that€Baker€received€sufficient€notification€of€theÏaccident€as€early€as€January€1995€when€Baker€was€shown€the€newspaper€article€about€TracyððsÏdeath€by€one€of€Mooreððs€other€sons.€€We€note,€however,€that€even€this€earlier€notification€involvedÏa€delay€of€three€months,€which€this€court€has€concluded€constituted€a€breach€of€the€duty€of€promptÏnotice.€€ò òòòSeeó óóó€ò òòòAllstate€Ins.€Co.v.€Hamiltonó óóó,€1990€WL€165071,€at€*3.€€Moreover,€weÍquestion€whether€the€information€provided€to€Baker€at€this€time€was€specific€enough€to€complyÏwith€the€policyððs€notification€provision.€€€The€eastern€section€of€this€Court€recently€stressed€theÏimportance€of€this€type€of€notice€provision:ÌÌÓÓà8 àà àThe€type€of€notice€at€issue€in€this€case€has€been€labeled€byÏthe€courts€of€this€state€as€ð ða€vital€and€indispensable€conditionÏprecedent€to€recovery€under€the€policy.ðð€€ò ðThe€general€purpose€of€a€notice€provision€is€to€make€the€insurerÏaware€that€a€claim€may€be€forthcoming€and€provide€an€adequateÏopportunity€for€investigation.ðð€€ò òòòAllstate€Insurance€Co.v.ÏFitzgeraldó óóó,€743€F.€Supp.€539,€542€(W.D.€Tenn.€1990).ÌÌÓÓÌò òòòPoseyv.€Williamsó óóó,€No.€03A01„9603„CV„00080,€1996€WL€673995,€at€*3€(Tenn.€App.ÏNov.22,€1996).ÌÌà àWe€conclude€that€the€information€provided€by€Tracyððs€brother€in€January€1995Ïfailed€to€satisfy€Mooreððs€obligation€to€provide€prompt€notice€of€the€accident€because€theÏinformation€was€insufficient€to€put€Baker€on€notice€that€a€claim€under€Mooreððs€automobileÏinsurance€policy€might€be€forthcoming.€€At€this€time,€Tracyððs€brother€merely€informed€Baker€thatÏTracy€had€been€killed€in€a€car€accident.€€Tracy€was€not€a€named€insured€on€Mooreððs€policy,€and€atÏthat€time€Baker€had€no€knowledge€that€the€driver€of€the€car€was€uninsured€or€that€a€claim€might€beÏforthcoming€pursuant€to€the€uninsured€motorist€provisions€of€Mooreððs€policy.ÌÌà àWe€hold€that,€under€the€circumstances€of€this€case,€the€trial€court€properly€ruled€thatÏMoore€failed€to€give€prompt€notice€of€the€claim€as€required€by€the€provisions€of€the€automobileÏinsurance€policy€issued€by€Haulers€and,€thus,€that€Mooreððs€claim€was€not€covered€by€the€policyððsÏuninsured€motorist€provisions.€€In€light€of€our€holding,€we€need€not€address€the€merits€of€Haulersðð€Ímisrepresentation€defense.×
