Husbandwasawardedseparatepropertyvaluedat$145,200.Themaritalpropertywasequallydistributedwitheachpartyreceivinginexcessof$784,000.Thepartiesmarriedin1959,separatedin1985anddivorcedin1994.Therewerenominorchildrenatthetimeofthedivorce.AtthetimeofthedivorceHusbandwas59yearsofageandWife55.Husbandbecamedisabledin1993andiscurrentlyinpoorhealthandunabletoworkfulltime.Trialcourtsaredirectedtoequitablydividemaritalproperty.T.C.A.364121(a)(1).Anequitabledivisionisnotnecessarilyanequalone.Trialcourtsareaffordedwidediscretionandarepresumedtobecorrectunlessthepreponderanceoftheevidenceisotherwise. Barnhillv.Barnhill ,826S.W.2d443(Tenn.App.1991). HusbandcontendsthatanequaldistributioninthiscaseisinequitablebecauseWifelivedinMemphisfor9ofthe36yearsofthemarriageandduringthattimemadenocontributionstothehousehold.Weareunabletodeterminefromthestatementoftheevidencewhysheleftthemaritalresidencebutdonotethatthetrialcourtawardedherthedivorceonthebasisofinappropriatemaritalconduct.Husbandfurtherassertsthatheshouldhavebeenawardedthehouseandfiveacres.Hetestifiedthatthispropertywasneededbecauseofitsusewiththefarmandbecausehehasnootherplacetolive.However,hedidnotelaborateonwhythehousewasanecessarypartofthefarm. HusbandfurthercontendsthatthedistributionwasinequitablebecauseWifereceivedseveralparcelsofcommercialpropertywhichproducerentalincome.Hearguesthattodeprivehimofthispropertywilldeprivehimofallbut$1,140permonthofhismonthlyincomeandthathisexpensesareapproximately$7,000permonth.Wenotethatagoodbitoftheseexpensesincludecostsassociatedwiththecommercialproperty,$1,000permonthalimonywhichheisnolongerpayingand$2,200permonthdesignatedas livingexpensespaidtoDonaldMottandfamily.Husbandtestifiedhereceivesnoincomefromthefarmingoperation.Hisbrother,HueyMott,managesthefarmandtakesanyprofitsorlosses.NoexplanationisgivenastowhyHusbanddoesnotreceiveanyofthefarmincome.Husbandrequestedofthetrialcourtandwasawardedvariousfarmproperties.Hedoesnotsuggesta quidproquo toWife.Obviously,ifheweretoreceiveboththecommercialpropertyandthefarmpropertythedistributionwouldindeedbeinequitable. Havingreviewedthisrecord denovo ,wedonotfindtheevidencetopreponderateagainstthedistributionofmaritalpropertyasawardedbythetrialcourt.ThejudgmentofthetrialcourtisaffirmedandthecostsofthisappealaretaxedtoDonaldLeeMottforwhichexecutionmayissueifnecessary.` ` X _______________________________ FARMER,J.______________________________CRAWFORD,P.J.,W.S.(Concurs)______________________________LILLARD,J.(Concurs)
