D<    0 OnMay11,1990,JamesR.Millerpledguiltytochargesofrape,incestandaggravatedrape,andwassentencedtoeighteenyearsimprisonment.Thevictimwashisdaughter,whowaslessthanthirteenyearsofageatthetime.Mr.Millerfirstbecameeligibleforparoleconsiderationin1993.TheParoleBoarddeclinedtoparolehimbecauseoftheseriousnessofhisoffensesandtheneedtocompleteasexoffendertreatmentprogram.Afterthenextparolehearingin1995,hewasagaindeniedparole.TheBoardcitedastheirreasonstheseriousnessoftheoffenseandnegativedisciplinaryreports.OnMarch12,1997,Mr.Millercameupforahearingagain,andtheBoardagainvotedtodenyparolebecauseoftheseriousnessofhisoffenses.  0 OnOctober15,1997,Mr.MillerfiledapetitionforwritofcertioraritoreviewtheactionoftheParoleBoard.TheParoleBoardmovedtodismissthepetitiononthegroundthatitfailedtostateaclaimuponwhichreliefcouldbegranted.ThetrialcourtdismissedthepetitiononMarch2,1998.Thisappealfollowed. 2+0 @- II.     0 Apetitionforwritofcertiorarimustbefiledwithinsixtydaysoftheentryoftheorderorjudgmentappealedfrom.Tenn.CodeAnn.279102.Failuretofileapetitionwithinthesixtydaytimelimitresultsinthetrialcourtlosingjurisdictionofthecase.Fairhavenv.TennesseeHealthFacilitiesCommission,566S.W.2d885(Tenn.  App.1976).SinceoversevenmonthselapsedbetweenthedecisionoftheParoleBoardandthefilingofMr.Millerspetition,itappearsthatthepetitionshouldhavebeendismissedforlackofjurisdiction.Wenotehowever,thatevenifMr.Millerspetitionhadbeentimelyfiled,thecourtwiouldstillhavebeencompelledtofindittohavenomerit.  0 LargeportionsofbothMr.Millerspetitionforwritofcertiorariandhisbriefonappealaredevotedtochallengestohisconviction.Mr.Millerclaimsthattheindictmentwasfaulty,andthathepledguiltyontheadviceofacourtappointedattorneywhoassuredhimthatifhedidsohewouldbehomeinfivemonths.OfcoursetheBoardofParoleshadnopartinMr.Millersconvictionandsentencing,andneitherthechancerycourtnorthiscourthasanyjurisdictionoverthosematters.  0 TheremainderofMr.MillersargumentisthattheBoardactedunconstitutionallyorillegallybybasingitsdecisionontheseriousnessofhisoffense.Thecourtsofthisstatehavehadseveralopportunitiestoexaminethequestionofwhetherseriousnessofoffenseisaconstitutionallyvalidbasisfordenialofparole,andhavedeterminedthatitis.Southv.BoardofParoles,946S.W.2d310,312 704 (Tenn.App.1996);Arnoldv.BoardofParoles,956S.W.2d478,482(Tenn.1997). 926 Ї  0 WenotethatthelegislaturehasauthorizedtheBoardofParolestodenyparoleifreleasewoulddepreciatetheseriousnessoftheoffense,Tenn.CodeAnn.435503(b)(2).RuleNo.110011.06(3)(b)oftheBoardofParolesfollowsthelegislativedirective.Certainly,itwoulddepreciatetheseriousnessofMr.Millersconductifhewerenotseverelypunishedforit.WethusfindthattheBoardsactionscannotbeconsideredunconstitutionalorillegal.  0 TheremayhavebeenanadditionalgroundfordismissalofMr.Millerspetition.ThedecisionoftheParoleBoardwasenteredonApril4,1997.Mr.MillerspetitionwasnotfileduntilOctoberofthatyear.Apetitionforwritofcertiorarimustbefiledwithinsixtydaysoftheentryoftheorderorjudgmentappealedfrom.Tenn.CodeAnn.279102.Thus,Mr.Millerspetitionappearstohavebeenuntimelyfiled.
