HeinsiststhattheDepartmentofCorrectionsisactingillegallyandexceedingitsauthoritybyalteringandchanginghiscurrent"holdingstatutestobeabletocontinuetheincarcerationofthepetitioner." Petitionerinsiststhatoncethelegislaturerepealsthestatuteunderwhichhewassentencedanddidnotspecifically"place[sic]aseparatesavingsclauseineffect,thatitactsasapardontothosethatweresentencedundersuchstatutes." TennesseeCodeAnnotatedsection4035117,inpertinentpart,statesasfollows:8 (a)AllpersonwhocommittedcrimesonorafterNovember1,1989,shallbetriedandsentencedundertheprovisionsofthischapter.8 (b)UnlessprohibitedbytheUnitedStatesor8 TennesseeConstitution,anypersonsentencedonorafterNovember1,1989,foroffensescommitted8 betweenJuly1,1982andNovember1,1989shallbesentencedundertheprovisionsofthischapter.8 (c)AllpersonswhocommittedcrimespriortoJuly1,1982,priorlawshallapplyandremaininfullforceandeffectineveryrespect,including,butnotlimitedto,sentencing,paroleandprobation. Aswehavestated,thepetitionerinsiststhattheClassXStatuteunderwhichhewassentencedwasrepealedbythelegislatureandreplacedbythe1989SentencingReformAct. Petitioner'sargumentiswithoutfoundation.TheSentencingReformActof1989specificallyprovidesthattheSentencingReformActsof1989wouldapplyonlytopersonwhohadcommittedcrimesafterJuly1,1982. Thepetitionerinthisinstancewassentencedon16October1981,althoughtheexactdateonwhichhecommittedthemurderisnotcontainedintherecord.ItisclearthatboththecrimeforwhichhewassentencedandthesentencingoccurredpriortotheenactmentoftheSentencingReformActof1989. Thecontentionofpetitionerthatthe1989SentencingReformActreplacedtheClassXStatuteiswithoutmerit.TheChancellorproperlydismissedthePetitionforDeclaratoryJudgment.
