Thisisthesecondmarriageforbothparties.AftermeetingoneanotherinHouston,Texas,theyweremarriedinMay,1992followingashort,longdistancecourtship.ThepartieslivedapartsomesixmonthsfollowingthemarriagewhileHusbandcontinuedtoworkinHouston.HethenmovedtoMemphiswherehemovedintoWifeshomewithhertwoteenagechildren. Wifehadbeenpreviouslymarriedandhadbeenawardedover$600,000.00inseparatepropertyatthetimeofherdivorce.Husbandbroughtlittleassetsintothemarriage,otherthanapersonalpropertynetworthofsome$8,000.00.TherecordreflectsthatHusbandwasunabletofindasteadyfulltimejobandsupplementedhisincomewithvariousparttimeconsultingprojects.Wifeisaspeechpathologist.Duringthe7XXdXXd7threeyearsofmarriageWifesannualearningswere$13,000.00,$18,000.00and$40,000.00respectively.Thepartiesweremarriedforlittlemorethanthreeyears,butresidedtogetherforonlytwentythreeϜmonths. Tocharacterizethepartiesrelationshipduringthecourseofthedivorceproceedingsashostilewouldbeanunderstatement.Atleastthirteenmotionsorpetitionsandmanyposttrialpetitionswerefiledduringthecourseofthedivorce.InadditiontoawardingWifethedivorce,Ϝthetrialcourtawardedherthemaritalresidence,allthecouplespersonalproperty,thepartiesmaritaldebtandalimonyintheformofattorneyfeesandexpensesintheamountof$15,007.50.HusbandwasenjoinedfromanyphysicalcontactwithWifeorherproperty.@ I.SubjectMatterJurisdiction  HusbandcontendsthatthetrialcourtneverhadsubjectmatterjurisdictionduetofailureofWifetofileasworncomplaintfordivorce,inviolationofT.C.A.364107.WhileWifeadmitsthatshedidnotsigntheoriginalpetitionfordivorce,therecordreflectsthatshedidsubsequentlyfileaMotiontoAmendComplaintwhichhadattachedanaffidavitsignedbyWife.ThetrialcourtgrantedWifesmotiontoamend.HusbandspositionisfurtherweakenedbythefactthathehimselffiledacountercomplaintagainstWifeaskingthecourttogranthimadivorce.Thisissueiswithoutmerit.@ II.LackofGroundsforDivorce.  ItisHusbandscontentionthatWifefailedtoprovegroundsuponwhichadivorcecouldbegranted.TherecordreflectsthatHusbandadmittedthathetoldhisWifethathehatedher.InadditionitisfilledwithevidencefromvariouswitnessesestablishingthenegativeanddestructivebehaviorthatHusbandexhibitedtowardWifeandherchildren.Thetrialcourtobservedthetestimonyofthepartiesatthehearingbelow.Thisissueisalsowithoutmerit.@ III.AttorneyFees.  HusbandcontendsthatthetrialcourtwasinerrorinawardingWifeattorneyfeesintheamountof$15,000.00.Withoutashowingofanabuseofdiscretion,thiscourtwillnotinterferewiththetrialcourtsdecisiontoawardattorneyfees.Threadgillv.Threadgill,740S.W.2d419,426(Tenn.App.1987). Inmakingtheaward,thetrialcourtclearlystatedthatthereasoningbehindtheawardofattorneyfeescenteredonϜHusbandsdilatorytacticswhichincreasedthecostsofthedivorceproceedings.Therecordbearsthisout.Thisissueisalsowithoutmerit.Thecourtwishestomakeitclearthattheattorneyfeeissueembracesboththeawardingofattorneyfeesthemselvesaswellastheamountofattorneyfeesawarded.ThetrialcourtinthatconnectionfoundthatHusbandpossessedtheabilitytopayanalimonyawardsuchasthisandfoundhimtobeinessenceunderemployed.Thisissueiswithoutmerit.@ IV.TheTrialCourtsLimitationsonHusbandsCrossexamination. Lastly,HusbandcontendsthatthetrialcourtdidnotgivehimampleopportunitytoattackWifescredibilitybycrossexaminationtotheextentthathe"Husband"feltnecessary.Therecordreflectsthatthetrialcourtdidseektobalancethetimeoncrossexamination.TherewereseveralexchangeswiththecourtwhereinitappearedthatHusbandscounselwasabitcontentious.Nonetheless,evenifthepresentationofproofhadbeenlimited,andwedonotsaythatitwas,Husbandhasfailedtopreservetherecordforthiscourttoconsiderwhathadbeenpreventedfromcomingintoevidencebymakingatenderofproof,therebycreatingatranscriptoftheallegedlyomittedtestimony.Withoutthisofferofproofthiscourtshandsaretiedinconsideringthisissueonitsmerits. Lastly,Wiferequeststhatthiscourtfindtheappealtobefrivolous,andawardheradditionalattorneyfeesandcoststocompensateherattorneyforrepresentationonappeal.WedofindthisappealtobefrivolousandareoftheopinionthatWifeisentitledtoadditionalattorneyfeesinconnectionwiththeappeal.Todeterminetheamountsthatshouldbeawarded,thiscauseisremandedtotheCircuitCourtofShelbyCountyforfurtherproceedingspursuanttotheprovisionsofT.C.A.271122.
