P726   @837 7XXdXXd7    @55' OPINION   @*  Thisisadivorcecaseinvolvingthedivisionofmaritalproperty.Duringtheirmarriage,thehusbandandwifebuiltahouseonpropertyownedbythehusbandsparents.Thetrialcourtgrantedalienagainstthepropertyinfavorofthewifeforhalfthevalueofthemaritalhome.Thehusbandsparentsappeal.Weaffirm.  ThomasOwens( Husband)andAngeliaOwens( Wife)weremarriedinMay,1986.Thereweretwochildrenborntothemarriage.In1988,HusbandandWifeconstructedahouselocatedonpropertyownedbyHusbandsparents,JamesandFernOwens( Mr.andMrs.Owens).OnSeptember21,1995,Husbandfiledacomplaintfordivorcealleginginappropriatemaritalconductor,inthealternative,irreconcilabledifferences.Wifeansweredthecomplaintandfiledacountercomplaintfordivorceallegingidenticalgrounds.Subsequently,WifefiledanamendedcountercomplaintimpleadingMr.andMrs.Owensallegingthattheywereunjustlyenrichedbytheconstructionof    the  houseontheirproperty.Wifealsoallegedalternativetheoriesofrecoveryincludingquasicontractandquantummeruit. `   Duringthetrial,bothHusbandandWifeaccusedeachotherofinappropriatemaritalconduct.WifetestifiedthatHusbandhadabusedherphysicallyinthepast.ShesaidthatsheleftsuddenlywiththepartiestwochildreninSeptember  1995  becauseHusbandstruckherinfrontofthechildrenandthatonechildwas  injured  duringthe  altercation.  The  trialcourtalsoheardevidenceconcerningtheconstructionofthemaritalhomeonthepropertyofMr.andMrs.Owens.Wifetestifiedthatsheselectedandboughtmostofthebuildingmaterials,andthatsheassistedintheconstructionofthehouse.Wifeintroducedintoevidencereceiptsforbuildingmaterialsthatshe  bought,  intheamountof$4,785.98.WifestatedthatshesavedallofhercancelledchecksbutcouldnotprovidethemtothetrialcourtbecausethecheckswereleftatthehousewhenshehadtoleavequicklybecauseofHusbandsabuse.WifetestifiedshecouldobtaincancelledchecksfromthebankonlydatingbacksixyearstoApril1990.WifeassertedthatthehousewasnearlycompletedinApril1990.Wifealsotestifiedthatsheborrowed$5,000fromhermothertoassistwithconstructioncosts.  Wifetestifiedthatherworkonthehouse,herpaymentforbuildingmaterials,andthemonetaryassistancefromhermotherwerebecauseofher understandingthatthepropertywouldbedeededto  Husband    andherupon  completionofthehouse.SheassertedthatHusbandrepresented ;`6:( toherthatthehousewouldbedeededtothemwhenitwascompleted.ShealsonotedMr.Owensreferencestothehouseas youallsandinterpretedthesereferencestomeanthatthehousebelongedto  Husbandandher.      HusbanddeniedattrialthatMr.Owens,hisfather,everpromisedtoconveythepropertyatanytime.HusbandwasemployedbyMr.Owensandworkedonthehouseattimeswhenhewasworkingforhisfather.Husbandwaspaidbyhisfatherincashandacknowledgedfailingtoreportthisincomeonthejointtaxreturns.  Mr.Owensassertedthatheneverhadanyintentionofdeedingthepropertytohissonanddaughterinlawandnevermaderepresentationstothateffect.Itisundisputedthatthehousewasconstructedfromtimbercutfromhisland,andthatsomeoftheequipmentusedinconstructingthehousewasownedbyMr.Owens.Mr.Owensclaimedthatheboughtpartofthematerialsforthehouseforcashandpaidbillsconcerningtheconstructionofthehouseincash.Mr.Owensproducednoreceiptsforthepurchaseofbuildingmaterials.Mr.OwensalsotestifiedthatHusbandandWifepaidhimnorentforfiveyears,theperiodoftimeinwhichtheyresidedinthehouse.  Afterlisteningtothetestimony,thetrialcourtfoundthetestimonyofHusbandandMr.Owenstobenotcredible.ThetrialjudgenotedtheincometaxreturnsinwhichHusbandscashincomewasnotreported,Husbandsevasivenessandclaimedignoranceaboutnumerousbasicissues,andMr.Owenspropensitytodealincashtransactions:Mr.ThomasOwens[Husband]appearstobeeithertryingtoactignorantorisignorant;andIdontbelieveheisignorant.Heknowsnothing.Heanswersnoquestiondealingevenwiththedateofhismarriagewithastraightforwardanswer.Itsgenerally Idontknow.Thesepeopledealwithcash.Mr.JimOwens  [Mr.Owens]is    acashdealer;cash,cash,cash.Helikewiseknowsnothing.+  ThetrialcourtheldthatMr.andMrs.Owenswouldbeunjustlyenrichedbyretainingtheentirevalueofthehouseontheirproperty.Thetrialcourtvaluedtheproperty,includingthevalueofthelandandthehouse,at$45,000.ThetrialcourtawardedWifehalfofthevalueoftheresidence,$22,500,less$5,000,thevalueofoneacreoflandownedbyMr.andMrs.Owens.Consequently,thetrialcourtgrantedalieninfavorofWifeinthesumof$17,500againstthepropertyofMr.andMrs.Owens.Fromthisorder,Mr.andMrs.Owensnowappeal.  Onappeal,Mr.andMrs.OwensassertthatthetrialcourterredbygrantingWifealienagainsttheproperty.Mr.andMrs.Owensarguetheywerenotunjustlyenrichedattheexpenseof  :p59 Wife,thattherecordshowsthattheycontributedtotheconstructionofthehouseandthattheyshouldbecreditedforhavingpermittedHusbandandWifetoresideinthehouserentfree.  OurreviewofthiscaseisgovernedbyTennesseeRuleofAppellateProcedure13(d),whichprovidesthatreviewoffindingsoffactbythetrialcourtshallbe denovo upontherecordofthetrial P  court,accompaniedbyapresumptionofcorrectnessofthefactualfindings,unlesstheevidencepreponderatesotherwise.Tenn.R.App.P.13(d);  seealso       UnionCarbideCorp.v.Huddleston ,854 `  S.W.2d87,91(Tenn.1993).  Insupportoftheirargument,Mr.andMrs.Owenscite OBrienv.OBrien ,734S.W.2d639   (Tenn.App.1987).Thehusbandandwifein OBrien builtahouseonthepropertyofthewifes  parents,Mr.andMrs.Hicklen. OBrien ,734S.W.2dat641.In OBrien ,therewasanagreement  amongthepartiesthatthepropertyandadditionallandwouldbeownedbythewifeuponthedeathofMr.andMrs.Hicklen. Id. at642.The  husbandandwife  laterdivorced. Id. at641. P   TheCourtfoundthatthehusbandhadareasonableexpectationofresidinginthehousewithhiswifeuntilherparentsdied,butthatthisexpectationwaswaivedwhenhelefthiswifeandthemaritalhome. Id. at642.TheCourtnotedthattheterminationofthemarriagewassolelydueto @ thehusbandsmisconduct. Id. at643.Italsoobservedthatthehusbanddidnotexpecttoobtainan   ownershipinterestinthehouse;ratherhisexpectationwas theprivilegeofoccupancyandtheultimateownershipbyhiswife. Id. at644.TheCourtrefusedtograntthehusbandequitablerelief $" underthedoctrineofuncleanhands,reasoningthatthehusbandabandonedhiswifeandthehousetheyshared,andwasthereforeprecludedfromobtainingequitablereliefregardingthehouse. Id.  P(#& at643.  0*%(     Wife,ontheotherhand,  cites Housleyv.Housley ,inwhichthisCourtaddressedtheissue ,`'* ofthegrantingalienonthepropertyofathirdpartywhendividingmaritalpropertybetweenadivorcinghusbandandwife. Housleyv.Housley ,No.03A019509CV00302,1996WL36135 / +. (Tenn.App.Jan.31,1996).In Housley ,thehusbandandwifeownedamodularhomeplacedon 1-0 propertyownedbythehusbandsparents,Mr.andMrs.Housley. Housley ,1996WL36135,at*1. 3.2 TheCourt  orderedthepartiesdivorced,apparentlywithoutattributionoffault,andawarded  thewifehalfofthevalueofthemodularhomeandimposedalienagainstthepropertyofMr.andMrs.Housleyinthesameamounttoprotectthewifesjudgment. Id. *2.Insustainingthelienagainst 0948 theproperty,the Housley Courtobservedthatthetrialcourthadbroaddiscretionintheadjudication  ofpartiesrightsandinterestsinthemaritalestate. Id. (citing Batsonv.Batson ,769S.W.2d849  (Tenn.App.  1988)).    񀀀  Thefactsinthiscaseare  more    analogoustothosein Housley than OBrien .Unlike OBrien , P  thedivorceinthiscaseisnotsolelythefaultofWife. SeeOBrien ,734S.W.2d64243.      Wife     0    assertedinhertestimonythatsheleft    themaritalhomesuddenlybecauseofHusbandsphysicalabuseofherandtheinjurytothepartieschildinthecourseoftheconfrontationbetweenHusbandandWife.  Asin     Housley    ,thetri  l   a  lcourtinthiscasesimplydeclaredthepartiesdivorcedwithout   attributingfault.         In  OBrien ,therewasaclearagreementamongthepartiesthatthewifewould  obtainownershipofthepropertyuponthedeathofherparents. Id. at642.Inthiscase,Wife  assertedthatshehadareasonableexpectationthatthepropertywouldbedeededtobothHusbandandWifeuponcompletionofthehouse,andthetrialcourtfoundthatWifestestimonywascredibleanddiscreditedthetestimonyofbothHusbandandhisfather.Thefactsinthecaseatbarare   quite similar    tothosein Housley ;indeed,theyaremorecompellingthanthefactsin  Housley  ,     inthatthehome ` inthiscaseisnotamodularhomethatcanbemoved,butahomebuiltonMr.andMrs.Owensproperty. SeeHousley ,1996WL36135,at*1. Underallofthesecircumstances,thereliefgranted   bythetrialcourtinthiscaseisbothreasonableandappropriate.
