ClaimscommissionproceedingsareconductedpursuanttotheTennesseeRulesofCivilProcedure.T.C.A.98403(a)(1)(1992).Inreviewinganappealfromanorderdismissingasuitforfailuretostateaclaimuponwhichreliefcanbegranted,wearelimitedtotheallegationsinthecomplaintandmustconstruethecomplaintliberallyinfavoroftheplaintiff,takingalloftheallegationsoffactthereinastrue. Huckebyv.Spangler ,521S.W.2d568,571(Tenn.1975).In Fuerstv.MethodistHospitalSouth ,566S.W.2d847(Tenn.1978),theCourtquotedwithapprovaltheUnitedStatesSupremeCourtin Conleyv.Gibson ,355U.S.41,78S.Ct.99,102,2L.Ed.2d80(1957),asfollows: [A]complaintshouldnotbedismissedforfailuretostateaclaimunlessitappearsbeyonddoubtthattheplaintiffcanprovenosetoffactsinsupportofhisclaimthatwouldentitlehimtorelief. Fuerst ,566S.W.2dat848(quoting Conley ,355U.S.at4546,78S.Ct.at10203). Toprevailinasuitfornegligence,aplaintiffmustprovethefollowing:(1)adutyofcareowedbythedefendanttotheplaintiff;(2)conductfallingbelowtheapplicablestandardofcareamountingtoabreachofthatduty;(3)injury;(4)causationinfact;and(5)proximatecausation. Bradshawv.Daniel ,854S.W.2d865,869(Tenn.1993). TheParents,residentsofInlet,NewYork,allegeintheirnoticeofclaimthatonApril8,1996,theywerevacationinginTennesseeandvisitingTimsFordStateParkinFranklinCounty.TheclaimaversthatJeremy,thensevenyearsofage,wasridinghisbicycleonapavedbicycletrailattheparkwhenhecametoasteephillwithasharpcurveatthebottom.Therewasnowarningsignorothernoticeofthesteephillorsharpcurveandbecauseofthedangerousconditionofthepremises,Jeremywasunabletonegotiatetheturnandwasthrownfromhisbicycleintoacreekbedsustainingseriousinjuries.TheclaimallegesthattheStatewasnegligentincreatingandmaintainingadangerouscondition,thattheStatehadactualorconstructiveknowledgeofthecondition,andthattheStatekneworshouldhaveknownoftheforeseeabilityoftherisktopatronsofthepark.TheclaimallegesthattheParentssufferedlosses,injuries,anddamagesintheamountof$125,000.00. OnNovember5,1996,theStatefiledamotiontodismissthecase,pursuanttoTenn.R.Civ.P.12.02(6),forfailuretostateaclaimuponwhichreliefmaybegranted.Initsmotion,theStateassertsthatT.C.A.707101etseq.shieldslandownersfromnegligenceclaimsrelatedtotheirpropertyifthepropertyismadeavailableforfreerecreationaluse,suchasinthiscase.OnNovember20,1996,theParentsfiledtheirresponsetotheStatesmotiontodismiss.Intheirresponse,theParentsassertthatT.C.A.707101etseq.hasnoapplicationtothiscaseanddoesnotrequireadismissaloftheaction.OnDecember4,1996,theStatefiledareplytotheParentsresponsetoitsmotiontodismiss.InanorderdatedDecember12,1996,theCommissionergrantedtheStatesmotionanddismissedtheParentsclaim. TheParentsappealthejudgmentoftheCommissionerandpresentthefollowingissuesforreview,asstatedintheirbrief:8 8 (1)DidtheCommissionererringrantingtheMotiontoDismissfiledbytheStateofTennesseewhereissuesoffactexistedwhichmightaffectapplicationofT.C.A.707101,etseq.?8 8 (2)DidtheCommissionererrinhisinterpretationoftheapplicationofT.C.A.707101,etseq.,tothefactsallegedintheComplaint? ThisisadirectappealfromtheTennesseeClaimsCommissionandisgovernedbytheTennesseeRulesofAppellateProcedure.T.C.A.98401(a)(1)(1992). FromourreviewoftheParentsnoticeofclaim,wefindthattheParentshavestatedaclaimforreliefasprovidedforinT.C.A.98307(a)(1)(C).TheState,whilerelyingontheprovisionsofT.C.A.707101etseq.asanabsoluteϜdefense,haspresentednoproofthatthestatuteshouldapplyinlightofthestatutoryexceptionscontainedtherein.Althoughthefactsmayturnouttowarranttheapplicationoftheexculpatoryprovisionsofthestatute,wecannotonaRule12.02(6)motionassumethatnoneoftheexceptionsapply.
