àOn€April€30,€1993,€Ms.€Parris€filed€a€complaint€alleging€that€in€November€1991,Ïshe€underwent€surgery€by€Dr.€Land€for€the€extraction€of€four€wisdom€teeth.€€She€alleged€that€Dr.ÏLand€was€negligent€in€performing€the€procedure€which€proximately€caused€the€severing€of€the€rightÏlingual€nerve€in€her€mouth.€€It€was€alleged€that€Dr.€Land€also€ð ðsplit€or€otherwise€injured€[her]€jawÏboneðð€during€the€procedure.€€Parris€alleged€that€following€the€procedure,€the€entire€right€side€of€herÏmouth€and€jaw€ð ðremained€numb€and€without€any€feeling€or€sensationðð€and€that€ð ðsince€the€date€ofÏthe€surgery€.€.€.€up€to€the€present€day,€[she]€continues€to€have€no€feeling€or€sensation€on€the€rightÏside€of€her€mouth€and€jaw.ðð€€Parris€alleged€that€during€the€time€period€between€the€surgicalÏprocedure€and€January€1993,€Dr.€Land€told€her€the€numbness€ð ðwould€eventually€wear€off,€and€thatÏshe€need€not€be€concerned€with€it.ðð€€It€was€alleged€that€in€January€1993,€Dr.€Land€suggested€thatÏParris€see€an€oral€surgeon€for€treatment€of€the€numbness.€€Parris€alleged€that€Dr.€Land€fraudulentlyÏconcealed€her€true€condition€and€injuries€from€the€time€of€the€surgery€until€January€1993.€€ÌÌà àDr.€Land€answered€the€complaint,€denying€all€material€allegations€therein€andÏaffirmatively€asserting€that€the€action€was€barred€by€the€applicable€statute€of€limitations.€€Dr.€LandÏmoved€for€summary€judgment€relying€upon€the€depositions€of€the€parties€and€his€own€affidavit.€InÏresponse,€Ms.€Parris€submitted€the€affidavit€of€€Dr.€Richard€Dixon€and€also€relied€upon€the€partiesððÏdepositions.€€ÌÌà àAppellant€frames€the€issues€on€appeal€as€follows:ÌÌÓÓà8 àà à1.€€Whether€material€disputed€facts€prevented€the€grant€of€aÏsummary€judgment.ÌÌà8 àà à2.€€Whether€the€discovery€rule€tolled€the€one„year€statute€ofÏlimitations€in€a€dental€malpractice€action.à àÌÌÌÌÓÓà àSummary€judgment€is€to€be€granted€only€when€it€is€shown€that€there€is€no€genuineÏissue€as€to€any€material€fact€and€that€the€moving€party€is€entitled€to€a€judgment€as€a€matter€of€law.€Ïòòò òE.g.€Gray€v.€Amosóóó ó,€869€S.W.2d€925,€926€(Tenn.€App.€1993);€Rule€56.03€T.R.C.P.€€It€isÏincumbent€upon€the€party€seeking€summary€judgment€to€persuade€the€court€that€no€genuine€andÏmaterial€factual€issues€exist.€òòò ò€Byrd€v.€Hallóóó ó,€847€S.W.2d€208,€211€(Tenn.€1993).€€Once€theÏmoving€party€does€so,€the€nonmoving€party€must€then€demonstrate,€by€affidavits€or€otherÏdiscovery€materials,€that€a€genuine€material€factual€dispute€exists€warranting€a€trial.€€òòò òByrdóóó ó,€847ÏS.W.2d€at€211.€€The€nonmoving€party€cannot€rely€upon€his€pleadings€but€must€set€forth€specificÏfacts€showing€that€there€is€a€genuine€issue€of€material€fact€for€trial.€€òòò òIdóóó ó.ÌÌà àThe€affidavit€of€Dr.€Land€states,€in€pertinent€part,€as€follows:ÌÌÓÓà8 àà àI€first€saw€[Parris]€as€a€patient€on€September€23,€1991Ïduring€which€time€I,€.€.€.€evaluated€her€third€molars€(also€known€asÏwisdom€teeth).€€I€again€saw€Ms.€Parris€on€October€1,€1991€duringÏwhich€time€we,€.€.€.€discussed€the€subject€of€her€wisdom€teeth.€€OnÏNovember€13,€1991€I€extracted€Ms.€Parrisðð€wisdom€teeth.€.€.€.€InÏmy€opinion€the€technique€I€used€in€the€removal€of€the€teeth€wasÏproper.€.€.€.ÌÌà8 àà àShortly€after€the€extractions€Ms.€Parris€complained€ofÏparesthesia€(numbness)€within€her€mouth,€particularly€part€of€theÏright€side€of€her€tongue€and€gums.€€I€felt€that€her€paresthesia€wouldÏimprove€with€time,€and€so€advised€her.€€On€January€8,€1992,€MarchÏ22,€1992€and€April€9,€1992,€we€had€conversations€about€theÏnumbness,€and€on€each€occasion€I€told€her€that€I€believed€herÏnumbness€was€transient€and€sooner€or€later€the€paresthesia€wouldÏheal€spontaneously.€€In€making€those€remarks€to€her,€I€did€so€in€aÍgood€faith€belief€that€her€feeling€would€return€and€that€her€numbnessÏwas€not€permanent.€€Never,€at€anytime,€did€I€fraudulently€concealÏany€information€from€her,€and,€in€particular,€I€did€not€make€anyÏfraudulent€remarks€to€her€about€her€numbness.€€I€felt€that€her€lingualÏnerve€might€have€been€insulted€during€the€removal€of€tooth€numberÏ32€causing€the€numbness€but,€as€said,€I€did€not€feel€the€numbnessÏwas€permanent,€and€so€advised€her.ÌÌà8 àà àOn€the€occasions€when€I€saw€plaintiff€after€the€extractionsÏand€we€discussed€her€numbness,€I€told€her€that€I€felt€the€numbnessÏwould€be€temporary€and€that€I€believed€that€sooner€or€later€theÏnumbness€would€heal€spontaneously.€€In€making€those€comments,€IÏdid€so€in€good€faith€using€my€best€judgment.€€I€actually€felt€that€theÏnumbness€was€transient€and€was€not€permanent.€€ÌÌÌÌÓÓà àMs.€Parris€states€the€following€in€her€deposition,€as€here€pertinent:€She€experiencedÏnumbness€in€the€bottom€right€side€of€her€jaw€and€tongue€by€the€second€or€third€day€after€Dr.€LandÏperformed€the€surgery.€€She€informed€Dr.€Land€of€the€numbness€within€days€of€the€surgery€andÏð ð[h]e€kept€saying€donððt€worry€about€it.€€It€will€come€back.€€Sometimes€it€takes€a€little€longer€for€theÏfeeling€to€come€back€in€different€areas.ðð€€Dr.€Land€also€told€her€that€the€healing€process€could€takeÏð ðup€to€a€year€to€come€back.€€If€after€a€year€nothing€has€happened€then€we€will€worry€about€it.ðð€ÏParris€saw€Dr.€Land€approximately€every€two€to€three€days€for€the€first€two€weeks€following€theÏsurgery.€€She€was€last€seen€by€Dr.€Land€in€April€1992.× ƒ% ××  ×€€Parris€first€became€concerned€that€herÏcondition€might€be€permanent€three€to€four€months€following€the€procedure.€€Since€firstÏexperiencing€it,€the€numbness€has€never€changed€locations€or€spread€to€more€or€less€parts€of€herÏmouth.€€ÌÌà àParris€was€further€questioned€as€follows:ÌÌÓÓà8 àQ.à àWhen€Dr.€Land€would€tell€you€that€he€felt€the€feeling€wouldÏcome€back,€did€you€gain€the€impression€from€listening€to€him€that€heÏwas€telling€you€a€lie,€or€did€you€gain€the€impression€that€he€in€goodÏfaith€believed€it€would€come€back€whether€it€did€or€not?ÌÌà8 àA.à àI€believed€he€thought€that€it€would.ÌÌà8 àQ.à àCome€back?ÌÌà8 àA.à àCome€back.ÌÌà8 à.€.€.€.ÌÌà8 àQ.à à.€.€.€.€Do€you€think€he€was€being€honest€with€you?ÌÌà8 àA.à àI€donððt€know.ÌÌà8 à.€.€.€.ÌÌà8 àA.à àI€now€know€that€it€hasnððt€come€back€that€his€statement€wasÏincorrect,€but€I€donððt€know€if€he€thought€he€was€being€honest.ÌÌÌà8 à.€.€.€.ÌÌà8 àQ.à à.€.€.€did€Dr.€Land€ever€tell€you€anything€that€would€makeÏyou€think€he€would€tell€you€a€falsehood?ÌÌà8 àA.à àNo.ÌÌà8 àQ.à àSo€insofar€as€you€know,€and€you€donððt€know€for€certain,Ïbut€insofar€as€you€know€he€may€have€been€telling€you€with€a€goodÏfaith€belief€that€the€numbness€would€eventually€wear€off?ÌÌà8 àA.à àHe€may€have€been.€€I€would€have€no€way€of€knowing.ÌÌà8 àQ.à àIf€I€understand€what€youððre€telling€me,€you€knew€that€theÏnumbness€resulted€from€the€extraction€of€the€teeth€and€you€knewÏyou€had€the€numbness€within€two€or€three€days€after€the€extractionÏof€the€teeth,€but€you€thought€it€would€be€temporary€based€on€whatÏDr.€Land€told€you?ÌÌà8 àA.à àYes,€sir.€€ÌÌÌÌÓÓà àParris€consulted€a€Dr.€Bernstein€in€November€1992€regarding€her€condition.€€AfterÏan€examination,€Bernstein€informed€her€that€he€did€not€believe€any€sensation€would€returnÏconsidering€the€amount€of€time€that€had€passed€since€the€surgery€and€that€she€should€not€haveÏwaited€a€year€to€correct€the€problem.€€She€was€referred€to€various€other€oral€surgeons€whoÏbasically€relayed€the€same€information.€€She€was€ultimately€referred€to€a€Dr.€Meyer€in€Atlanta€whoÏagreed€to€attempt€corrective€surgery.€€Dr.€Meyer€informed€her€that€something€should€have€beenÍdone€within€the€first€three€to€six€months€and€that€her€chances€of€the€surgery€being€a€success€wereÏ50/50.€€Parris€underwent€corrective€surgery€for€her€condition€in€June€1993€which€wasÏunsuccessful.× ƒ& ××  ×€€ÌÌà àIn€ruling€on€motions€for€summary€judgment,€the€trial€court€and€this€Court€mustÏconsider€the€matter€in€the€same€manner€as€a€motion€for€a€directed€verdict€made€at€the€close€of€theÏplaintiffððs€proof,€i.e.,€all€evidence€must€be€viewed€in€a€light€most€favorable€to€the€motionððsÏopponent€and€all€legitimate€conclusions€of€fact€must€be€drawn€in€that€partyððs€favor.€€òòò òGrayóóó ó,€869ÏS.W.2d€at€926.€It€is€Appelleeððs€position€that€the€present€claim€is€time€barred€under€the€provisionsÏof€T.C.A.€ðð€29„26„116,€which€provide€as€follows:ÌÌÓÓà8 àà à(a)€(1)€The€statute€of€limitations€in€malpractice€actions€shallÏbe€one€(1)€year€as€set€forth€in€ðð€28„3„104.ÌÌà8 àà à(2)€In€the€event€the€alleged€injury€is€not€discovered€withinÏthe€said€one€(1)€year€period,€the€period€of€limitation€shall€be€one€(1)Ïyear€from€the€date€of€such€discovery.ÌÌà8 àà à(3)€In€no€event€shall€any€such€action€be€brought€more€thanÏthree€(3)€years€after€the€date€on€which€the€negligent€act€or€omissionÏoccurred€except€where€there€is€fraudulent€concealment€on€the€part€ofÏthe€defendant€in€which€case€the€action€shall€be€commenced€withinÏone€(1)€year€after€discovery€that€the€cause€of€action€exists.ÌÌÌÌÓÓAppellant€counters€that€the€discovery€rule€applies€in€this€case€to€toll€the€running€of€the€statute.€€SheÏargues€that€Dr.€Land€ð ðpersistentlyðð€informed€her€that€her€numbness€was€temporary€and€that€sheÏshould€wait€a€year€before€being€concerned.€€Thus,€she€did€not€know€her€condition€was€permanentÏuntil€after€the€year€had€passed€and€she€sought€a€second€opinion,€whereupon€she€discovered€theÏpermanency€of€her€condition€and€filed€suit€ð ðapproximately€four€monthsðð€later€on€April€30,€1993.€€ÌÌà àAppellee€relies€primarily€upon€òòò òBennett€v.€Hardisonóóó ó,€746€S.W.2d€713€(Tenn.ÏApp.€1987).€€In€almost€identical€facts€to€our€own,€the€plaintiff€in€òòò òBennettóóó ó€underwent€surgery€forÏthe€removal€of€a€wisdom€tooth€by€the€defendant€dentist€on€February€24,€1984.€€After€theÏextraction,€the€defendant€informed€the€plaintiffððs€companion€that€plaintiff€would€experience€aÏð ðtemporaryðð€numbness.€€The€numbness,€however,€was€permanent.€€The€plaintiff€filed€suit€onÏOctober€3,€1985€alleging€that€the€defendant€failed€to€inform€plaintiff€of€the€risks€of€dental€surgery.€ÏIn€response€to€the€defendantððs€argument€that€the€action€was€time€barred,€the€plaintiff€relied€uponÏthe€discovery€rule€to€argue€that€he€did€not€learn€his€condition€was€permanent€until€October€1984Ïwhen€another€doctor€told€him€the€numbness€was€permanent.€€òòò òBennettóóó ó,€746€S.W.2d€at€713.€€TheÏtrial€court€held€the€action€time€barred€and€entered€summary€judgment€for€the€defendant.€€òòò òIdóóó ó.ÌÌà àIn€affirming€the€trial€court,€the€court€of€appeals,€middle€section,€held:ÌÌÓÓà8 àà àIt€is€uncontroverted€that€plaintiff€experienced€the€numbnessÏimmediately€after€the€surgery€and€that€the€extent€or€effect€of€theÏnumbness€did€not€change€from€the€date€of€inception€until€the€date€ofÏsuit.€.€.€.€€Plaintiff€did€not€see€defendant€after€the€surgery,€but€Dr.ÏDraper€removed€the€stitches€a€week€later€and€told€plaintiff€that€nerveÏnumbness€was€not€an€unusual€result€of€the€extraction€performed€byÏdefendant.€.€.€.€ÌÌà8 àà àPlaintiffððs€reliance€upon€the€discovery€rule€is€based€upon€theÏassumption€that€temporary€numbness€and€permanent€numbness€areÏtwo€entirely€separate€injuries€or€results,€and€that€knowledge€ofÏtemporary€numbness€is€not€knowledge€of€permanent€numbness.ÌÌà8 àà àIn€òòò òSecurity€Bank€&€Trust€Co.€v.€Fabricating,€Inc.ó óóó,ÏTenn.€1983,€673€S.W.2d€860,€in€discussing€the€one€year€statute€ofÏlimitations€on€legal€malpractice€suits,€the€Supreme€Court€said:ÌÌà8 àà8 àà à.€.€.€.€€A€plaintiff€cannot€be€permitted€to€waitÏuntil€he€knows€all€of€the€injurious€effects€asÏconsequences€of€an€actionable€wrong.€€òòò òTaylor€v.ÏClayton€Mobile€Homes,€Inc.óóó ó,€Tenn.€1974,€516ÏS.W.2d€72.€€(673€S.W.2d€at€864,€865).ÌÌà8 àà àIn€òòò òHoffman€v.€Hospital€Affiliates,€Inc.óóó ó,€Tenn.€1983,Ï652€S.W.2d€341,€the€Supreme€Court€reversed€a€dismissal€of€aÏmedical€malpractice€case€based€upon€the€statute€of€limitations€andÏsaid:ÌÌà8 àà8 àà àThe€ð ðdiscovery€ruleðð€would€apply€only€inÏcases€where€the€plaintiff€does€not€discover€andÏreasonably€could€not€be€expected€to€discover€that€heÏhad€a€right€of€action.€€Furthermore,€the€statute€isÏtolled€only€during€the€period€when€the€plaintiff€hadÏno€knowledge€at€all€that€a€wrong€had€occurred,€and,Ïas€a€reasonable€person€is€not€put€on€inquiry.€€(652ÏS.W.2d€341€at€344.)ÌÌà8 àà à.€.€.€.€ÌÌà8 àà àEven€though€plaintiff€may€have€been€justified€in€accepting€aÏbrief€period€of€numbness€as€a€necessary€incident€of€the€surgery,Ïabsent€evidence€of€some€unusual€cause€for€the€delay,€the€defendantÏwas€not€justified€in€delaying€the€ð ðdiscoveryðð€of€the€permanence€ofÏhis€injury€from€February€24,€1984,€until€ð ðaround€October,€1984",€aÏperiod€of€some€8€months.€€At€some€time€during€that€8€months,€anyÏreasonable€person€would€have€concluded€that€the€brief,€temporaryÏnumbness€normally€incident€to€oral€surgery€had€outlasted€itsÏwelcome€and€had€become€an€unacceptable€incident€to€the€surgery.€ÏThis€is€especially€true€because€there€is€no€evidence€of€anyÏimprovement€in€the€numbness€during€the€period.€€An€improvementÏmight€have€justified€a€wait€for€further€improvement,€.€.€.€.ÌÌÌÌÓÓòòò òId.óóó ó€at€714.ÌÌà àThe€similarities€between€òòò òBennettóóó ó€and€our€own€case€are€quite€apparent.€€As€inÏòòò òBennettóóó ó,€Parris€experienced€numbness€in€a€relatively€short€time€following€the€surgery€(two€toÏthree€days)€and€at€no€time€since€the€surgery€has€she€experienced€any€signs€of€improvement.€€EvenÏaccepting€as€true€Dr.€Landððs€statement€to€her€that€she€should€not€be€concerned€for€one€year,€sheÏconcedes€that€she€began€worrying€that€her€condition€was€permanent€well€before€that€yearððs€endÏ(three€to€four€months€following€the€surgery),€in€February€or€March€of€1992.€€Yet€suit€was€not€filedÏuntil€over€a€year€later€on€April€30,€1993.€€In€light€of€òòò òBennettóóó ó,€we€conclude€that€Parris,€in€theÏexercise€of€reasonable€care€and€diligence,€should€have€discovered€her€cause€of€action€prior€to€AprilÏ30,€1992,€(more€than€five€months€after€the€surgery)€and€that€the€statute€of€limitations€beganÏrunning€prior€to€this€time.ÌÌà àWe€further€do€not€find€the€record€to€support€Appellantððs€claim€that€AppelleeÍfraudulently€concealed€her€cause€of€action.€€Fraudulent€concealment€is€shown€when€the€physicianÏhas€knowledge€of€the€wrong€done€and€conceals€such€information€from€the€patient.€€òòò òHoush€v.ÏMorrisóóó ó,€818€S.W.2d€39,€43€(Tenn.€App.€1991).€€Honest€mistakes€on€the€part€of€the€physician,Ïstanding€alone,€are€not€sufficient€evidence€to€establish€fraudulent€concealment.€€òòò òHoushóóó ó,€818ÏS.W.2d€at€43.€€The€record€before€us€does€not€suggest€that€Dr.€Land€was€dishonest€in€hisÏstatements€to€Ms.€Parris€that€her€condition€was€temporary€and€that€she€should€not€be€concernedÏuntil€one€year€had€passed.€€However€mistaken€Dr.€Land€may€have€been,€the€record€does€notÏsuggest€that€he€actually€knew€otherwise.€€Ms.€Parris€testified€that€she€thought€Dr.€Land€believedÏher€condition€was€transient€and€she€had€no€way€of€knowing€whether€or€not€he€was€conveying€aÏfalsehood.€€Moreover,€we€liken€the€present€action€to€the€situation€in€òòò òHoushóóó ó€wherein€this€courtÏheld€that€the€physicianððs€statements€to€his€patient,€who€was€rendered€permanently€disabled€afterÏundergoing€surgery€at€his€hands,€that€she€would€walk€again€merely€concealed€the€ð ðextentðð€of€herÏinjuries.€€òòò òHoushóóó ó€held€that€ð ð[t]his€simply€will€not€operate€to€toll€the€statute€of€limitations.ðð€Ïòòò òHoushóóó ó,€818€S.W.2d€at€43.ÌÌà àViewing€the€evidence€in€a€light€most€favorable€to€Ms.€Parris,€we€are€compelled€toÏconclude€that€the€one€year€statute€of€limitations€applies€to€bar€her€suit.€€The€judgment€of€the€trialÏcourt€entering€summary€judgment€in€favor€of€Appellee€is,€accordingly,€affirmed.€€Costs€areÏassessed€against€Deborah€Parris,€for€which€execution€may€issue€if€necessary.ÌÌÓÓÓ`
