TheTrialCourtenteredasummaryjudgmentinfavoroftheDefendantsandthePlaintiffappeals,raisingthefollowingthreeissues:    I.WHETHERTHELOWERCOURTERREDINFINDINGTHATITISNOTAGAINSTTHELAWFORAPLACEOFPUBLICACCOMMODATIONTOFORCEANEMPLOYEETOBEAPARTOFANOVERALLPATTERNANDSCHEMEOFDISCOURAGINGBLACKPATRONAGE.II.WHETHERTHELOWERCOURTERREDINFAILINGTORECOGNIZETHATTHEPRECLUSIONSOFTENN.CODEANN.421501AREACTSMADEDISCRIMINATORYBYCHAPTER21OFTHETENNESSEEHUMANRIGHTSACT.III.WHETHERTHECOURTERREDINDETERMINING,ASAMATTEROFLAW,THATANINDIVIDUAL'SBEINGREQUIREDTOPARTICIPATEINANOVERALLSCHEMETODISCRIMINATEAGAINSTBLACKCUSTOMERSCANNOTBESOINTOLERABLEASTOFORCEAREASONABLEPERSONTORESIGNHISPOSITION.      Priortobringingthissuit,thePlaintiffwasanemployeeofWorldWideEntertainment,anentitywhichcontractedoutitsemployeestoperformentertainmentrelatedservices.Throughthisemployment,hewasassignedasadiscjockeytotheKicksLoungeintheMarriottHotelinChattanooga.TheKicksLoungeandtheMarriottareownedandoperatedbyInterstateCorporation#L07,aDelawarecorporation.ThePlaintiffworkedasKicksdiscjockeyfromMay1991untilFebruary1992.  InFebruary1993,thePlaintiffbroughtsuitagainsttheDefendants,allegingconstructivedischargeandviolationsoftheTennesseeHumanRightsAct.ThePlaintiffallegesthathewasforcedtoparticipateinaplantopreventblackpatronsfromfrequentingthebar.Inhisaffidavit,thePlaintiffallegesthatBobbyJohnson,managerofKicks,instructedthePlaintifftoplaymusicthatwoulddiscourageblackpatronsfromremaininginthebar.ThePlaintifffurtherallegesthatMr.JohnsonthrewnapkinswithmessagesonthemorshoneaflashlightinthePlaintiffseyesinordertoforcethePlaintifftochangethemusicselection.WhenthePlaintiffexpressedhisdispleasurewithMr.Johnsonsactions,thePlaintiffallegeshereceivedthe"coldshoulder"treatment.  ThePlaintiffcitesotherincidentsofallegeddiscrimination.Heclaimsthatblackpatronswererefusedseatingeventhoughseatingwasavailable;thatan"adhoc"dresscodewasenforcedonblackpatronsonly;thatMr.Johnsonwouldclosetheloungeearlyifthecrowdweremainlyblackpatrons;thatMr.Johnsonrefusedtorunbartabsforblackpatrons;thatadrinkminimumwasimposedonblackcustomers;thatMr.Johnsonremovedadraftbeerthatwasthemostpopularbeeramongblackpatronsandthatacoverchargewasimposedinordertodiscourageblackpatronage.̜  Becauseoftheseallegedincidents,thePlaintifftenderedhisresignation.HegaveKicksonemonthsnoticeandthenstayedonasthediscjockeyanextrasevento10daysatWorldWideEntertainmentsrequest.HefinallyterminatedhisemploymentinmidFebruary1992.However,thePlaintiffreturnedtoKicksontwosubsequentoccasionsto"fillin"asthediscjockey.AfterleavingKicks,thePlaintifffoundemploymentinMarch1992withLifestylesCarpets.  Inhiscomplaint,thePlaintiffallegedthattheDefendantsviolatedtheTennesseeHumanRightsActbydenyingblackpatronsthefullandequalenjoymentofthebarsgoods,services,facilitiesandaccommodations.HefurtherallegedthattheDefendantsdemandedthatheengageinsuchdiscriminatingtacticsandthattheDefendantsinterferencewithhisabilitytocomplywiththeprovisionsoftheTennesseeHumanRightsActamountedtoaconstructivedischarge.Finally,thePlaintiffallegedthattheDefendantsengagedinmaliciousharassmentintryingtoforcethePlaintifftodiscourageblackpatronage.  UponentryofsummaryjudgmentfortheDefendants,thePlaintiffperfectedthisappeal.Heappealstheentryofsummaryjudgmentastothefirsttwoallegationsoutlinedabove.Hedoesnotappealdismissalofthemaliciousharassmentclaim.  TheTennesseeSupremeCourt,inByrdv.Hall,847S.W.2d208(Tenn.1993),setforththepropersummaryjudgmentanalysistobeappliedinTennessee.There,theCourtsaidinevaluatingasummaryjudgmentmotion,thesequestionsmustberesolved:(1)whetherafactualdisputeexists;(2)whetherthedisputeismaterialtotheoutcomeofthecase;and(3)whetherthedisputedfactcreatesagenuineissuefortrial.  Byrdfurtherexplainsthatsummaryjudgmentshouldbeemployedwherethereisnodisputeovertheevidenceandthereisnoissueforajurytodecide.Forapartytoavoidsummaryjudgment,itmustshowthatthefactindisputeismaterial.Ifsuchadisputed,materialfactdoesexist,thenthecourtmustdeterminewhetherthedisputedfactcreatesagenuineissue.Thetestforagenuineissueiswhetherareasonablejurycouldlegitimatelyresolvethatfactinfavorofonesideortheother.Iftheanswerisyes,thensummaryjudgmentisinappropriate;iftheanswerisno,summaryjudgmentisproperbecauseatrialwouldbepointless.Whenapplyingthistest,allevidencemustbeviewedinalightfavorabletothenonmovingpartyandallowallreasonableinferencesinhisfavor.Thepartyseekingsummaryjudgmenthastheburdentodemonstratethattherearenodisputed,materialfactscreatingagenuineissuefortrialandthatsummaryjudgmentisappropriate.̀    ThePlaintiffpresentstwomainissuesonappeal:(1)theTrialCourterredwhenitfoundnoviolationoftheTennesseeHumanRightsAct,and(2)theTrialCourterredbyconcludingthatthePlaintiffhadnotbeenconstructivelydischargedfromhisposition.  Inhisfirstargument,thePlaintiffallegesthattheDefendantsviolatedT.C.A.421301oftheTennesseeHumanRightsActwhichstates:    Itisadiscriminatorypracticeforapersonorfortwo(2)ormorepersonsto:....(2)Aid,abet,incite,compelorcommandapersontoengageinanyoftheactsorpracticesdeclareddiscriminatorybythischapter;....(4)Willfullyobstructorpreventapersonfromcomplyingwiththeprovisionsofthischapteroranorderissuedthereunder.    T.C.A.421501furtherstatesthatitisa    discriminatorypracticeforapersontodenyanindividualthefullandequalenjoymentofthegoods,services,facilities,privileges,advantagesandaccommodationsofaplaceofpublicaccommodation,resortoramusement,asdefinedinthischapter,onthegroundsofrace,creed,color,religion,sex,ageornationalorigin.      ThePlaintiffassertsthathisbeinginstructedtochangethemusicselectionwasforcinghimtoparticipateinapracticedeclareddiscriminatoryin421501andthus,prohibitedby421301.ThePlaintiffallegesthatthechangeinmusicwasanattempttodiscourageblackpatronageandassuchfitswithinthestatutorydefinitionofprohibiteddiscriminatorypractices.Quiteobviously,thePlaintiffcannotmaintainadirectclaimunder421501sincehemakesnoallegationthatanydiscriminationwasdirectedathim.Instead,thePlaintiffbaseshisclaimonanallegationofforcedparticipationinadiscriminatorypractice.   Wecannotagreethatsuchisthecase.WeagreewiththeTrialCourtthatthePlaintifffailedtodemonstratethatchangingthemusicselectioninaloungeisadiscriminatorypracticeasoutlinedintheabovestatute.AstheTrialCourtnoted,thechangeofmusicaffectedalloftheloungespatrons.Allpatronswereequallysubjectedtothechangeandallcouldthenassesshowthechangeaffectedtheirdesirestoremaininthelounge.WecannotacceptthePlaintiffsassertionthatchangingthemusicselectionamountstoadenialofthefullandequalenjoymentofthelounge.Thus,therebeingnodiscriminatorypractice,thePlaintiffcannotmaintainaclaimunder421301.BybeinginstructedtochangethemusicselectionthePlaintiffhasnotbeenforcedtoparticipateinadiscriminatorypracticethatisprohibitedby421301.  WedonotreachthequestionofwhethertheotherallegeddiscriminatorybehaviorbyMr.JohnsonamountstoactsprohibitedbythestatutebecauseitappearsthatthePlaintiffhadnoroleinfurtheringtheallegeddiscriminationtactics.Theadhocdresscode,thecovercharge,thechangeofbeers,andtheotherallegationsofdiscriminationwerenotpracticesthatthePlaintiffwasforcedtocarryout.ThePlaintiffmayhavebeenforcedtochangethemusicselection,butthisisnotsufficienttobringaclaimunder421301.  ThePlaintiffssecondbasisforappealistheTrialCourtsconclusionthatthePlaintiffwasnotconstructivelydischargedfromhisjob.ThePlaintiffallegesthattheDefendantsbehaviorandallegedviolationsofT.H.R.A.causedhimtobeconstructivelydischarged.Constructivedischargeexistswhereworkingconditionsweresodifficultorsounpleasantthatareasonablepersonintheemployeesshoeswouldhavefeltcompelledtoresign.Campbellv.FloridaSteelCorp.919S.W.2d26(Tenn.1996),quotingBruhwilerv.UniversityofTennessee,859F.2d419(6thCir.1988).Inorderforanemployeetoprevail,hemustshowthat"areasonableemployerwouldhaveforeseentheemployeesresignation,giventheintolerableconditionsofemployment."Campbell,supra.Inotherwords,theemployeeneedonlydemonstratethattheemployerknowinglypermittedconditionsofdiscriminationinemploymentsointolerablethatareasonablepersonsubjectedtothemwouldresign.Thequestionofconstructivedischargerequiresanapplicationoflawtofactsandthus,thestandardofreviewisthatinRule13(d)oftheTennesseeRulesofAppellateProcedure,wherefindingsoflawshallbedenovoupontherecordandfindingsoffactshallbeaffordedapresumptionofcorrectness.  BecausethiscasecomestothisCourtafteranawardofsummaryjudgment,therewerenofindingsoffact.However,asdidtheTrialCourt,wemustlookatthefactsinthelightmostfavorabletothePlaintiff.WemustacceptastruethatBobbyJohnson,managerofKicks,toldthePlaintifftochangethemusicselectioninordertodiscourageblackpatronsfromfrequentingtheestablishment.WemustalsoacceptthePlaintiffsallegationsthatMr.Johnsonmadeotherattemptstofurtherdiscriminateagainstblackpatrons.Evenso,wecannotfindaclaimforconstructivedischarge.First,thePlaintifffailedtoshowthatMr.JohnsoncouldhavereasonablyforeseenthePlaintiffsresignation.Mr.Johnsonsallegeddiscriminatorybehaviorhadaforeseeableconsequenceofdiscouragingblackpatronage,butitwasnotforeseeablethatMr.JohnsonsbehaviorwouldresultinthePlaintiffsresignation.Second,thePlaintiffdoesnotallegeanydiscriminationdirectedathimbyMr.Johnson.Theexistenceofdiscriminationtowardtheemployeeisanintegralelementofaconstructivedischargeclaim.SeeCampbell.Third,thePlaintifffailedtoshowhowhisemploymentwassointolerablethatareasonablepersonwouldresign.ThePlaintiffremainedthediscjockeyatKicksforonemonthandsevendaysafterhetenderedhisresignation.Additionally,hereturnedtoKicksasasubstitutediscjockeyonanoccasioninAprilandinMayof1992.  Applyingthesefactstothelaw,therecanbenoclaimforconstructivedischarge.ThePlaintiffdidnotmeettheminimumrequirementsforsuchaclaim.ThePlaintifffailedtoshowthathisresigninghisjobwasthereasonablyforeseeableresultofMr.Johnsonsdiscriminatingbehaviortowardblackpatrons.ThePlaintifffurtherfailedtoshowtheconditionsofhisemploymentweresointolerablethatareasonablepersonwouldfeelcompelledtoresign. Thus,weagreewiththeTrialCourtthatsummaryjudgmentisappropriateinthiscase.IntheDefendantsbrief,itisarguedthattheTrialCourtwasincorrectinfindingthatthestatuteoflimitationshadnotrunonthismatter.Becauseourconclusionisthatsummaryjudgmentwasproperlyawarded,thematterofthestatuteoflimitationsispretermitted.  Inconclusion,weemphasizethatwedonotcondonetheactsalleged,whichwefindtobereprehensible,butfindthattheϜPlaintiff'stheoriesofrecoverymaynotbesustainedunderthefactsdivulged.
