DraperfiledacomplaintintheSecondCircuitCourtforDavidsonCountyon7November1995.HenamedReaverandTraceyasdefendants.Reaverfiledamotionforsummaryjudgment,andDraperfiledamotiontoamendhiscomplainttoaddPigImprovementasaplaintiff.TheSecondCircuitgrantedReaver'smotionon8April1996.Thereafter,Traceyfiledamotionforsummaryjudgment.TheSecondCircuitgrantedTraceyssummaryjudgmentmotionanddeniedDrapersmotiontoamendon5June1996.Draperfiledatimelynoticeofappealastoeachorder. PigImprovementfiledacomplaintintheSixthCircuitCourtforDavidsonCountyon17April1996.PigImprovementnamedReaverandTraceyasdefendants.Reaverfiledamotiontodismissforfailuretostateaclaimuponwhichreliefcouldbegranted.Hearguedthedoctrineof priorsuitpendingprohibitedprosecutionofthecase.TheSixthCircuitagreedandgrantedthemotiontodismisson23August1996.PigImprovementfileditsnoticeofappealon20September1996. UponthemotionofPigImprovementandDraper,thiscourtconsolidatedthetwoappealsfromtheSecondCircuitsdecisionsandrefusedtoconsolidatetheappealfromtheSixthCircuitsdecision.Thiscourtheardtheconsolidatedappealon6January1997anddeterminedtheSecondCircuiterredwhenitdeniedDrapersmotiontoamend.Specifically,thiscourtconcludedthetrialcourtshouldhaveconsideredsubstanceoverformandtreatedthemotionasifitwereamotiontointervene.Finally,thiscourtremandedthecasetotheSecondCircuitwithdirectionstoenteranorderpermittingPigImprovementtointervene. Reaverfiledamotiontodismisstheappealon18October1996basedonPigImprovementsfailuretotimelyservethenoticeofappealontheclerkofthiscourt.Inresponse,PigImprovementfileda motiontoallowlatefiledfilingofnoticeofappeal.ThiscourtreservedjudgmentonthemotionsuntiltheTennesseeSupremeCourtdecided Cobbv.Beier .Thesupremecourtfileditsdecisionon28April1997andheld: Wearethereforeoftheopinionthatthiscase,andallcasespresentlyonappealinwhichtheclerkoftheappellatecourtwasnottimelyservedacopyofthenoticeofappeal,shouldnotbedismissedforfailuretocomplywithRule5(a),T.R.A.P. Cobbv.Beier ,No.03S019610CV00106,slipop.at7(Tenn.28April1997).Thus,ReaversmotionisherebydeniedandPigImprovementsmotionisherebygranted. TheissuespresentedbythisappealweredependantontheoutcomeoftheappealfromtheSecondCircuitsjudgments.Givenourdecisioninthatappeal,theissuespresentedbythisappealarenowmoot. Thecentralquestioninamootnessinquiryiswhetherchangesinthecircumstancesatthebeginningofthelitigationhaveforestalledtheneedformeaningfulrelief. McIntyrev.Traughber ,884S.W.2d134,137(Tenn.App.1994).Withoutquestion,thiscourtsrulingorderingtheSecondCircuittoenteranorderpermittingPigImprovementtointerveneprovidedPigImprovementwiththereliefitsoughtinthiscase.ThereisnodoubtthatPigImprovementfiledthepresentactiontoavoidthestatuteoflimitationsintheeventthiscourtupheldtheSecondCircuitsrulingdenyingDrapersmotiontoamend. See Tenn.CodeAnn.506112(c),(d)(1991). Therefore,itfollowsthatReaversmotiontodismissisdeniedandPigImprovementsmotiontoallowlatefilingofnoticeofappealisgranted.Thetrialcourtsjudgmentisvacated,andthecaseisremandedtoSixthCircuitCourtwithdirectionstoenteranorderdismissingthecase.
