TheplaintifffiledhisNoticeofAppeal39dayslater,onSeptember26,1994whichprecipitatedaMotiontoDismisstheAppealasnothavingbeenfiledwithinthirtydaysafterentryoftheJudgmentappealedfrom,Rule4,RulesofAppellateProcedure,arequirementwhichisjurisdictionalincivilcasesandcannotbewaived.Jeffersonv.PneumoServicesCorp.,699S.W.2d181(Tenn.App.1985). Thecrucialissuehereiswhethertheplaintiff's"MotiontoMakeAdditionalFinding,"filedSeptember12,1990,effectivelyextendedthetimewithinwhichtofiletheNoticeofAppealasprovidedbySection(b)ofRule4. S    WenoteatthisjuncturethatjudgmentwasenteredpursuanttoRule56,whichrelievedthetrialjudgeofthenecessityoffindingthefactsormakingconclusionsoflaw.Rule52.01,Tenn.R.Civ.Pro.Evenso,findingsoffactarenotappropriateunderRule56becausethereisnopresumptionofcorrectnessofsummaryjudgmentssincetheyinvolvequestionsoflawonly.Theplaintiff,forreasonsnotentirelyclear,wantedthetrialjudgespecificallytofindthattheplaintiffwasofunsoundmind, (   ׀anexerciseinfutilitysincethecontraryfindingwasinherentinthegrantingofsummaryjudgment.Themotion,ifgranted,wouldnecessarilyhavehadtheeffectofthetrialcourtreversingitself.TheOrdergrantingsummaryjudgmentmadenofindingoffactsubjecttoaRule52.02challenge;asheldinBrewerv.Brewer,14TAM3412(Tenn.App.W.S.,July14,1989): `  r "ImplicitinRule52.02istheobviousfactthatinthejudgmentheretoforeenteredthecourthadmadefindingsoffactwhichwerebeingchallengedbytheRule52.02motion.TheobviousconclusionisthatRule52.02doesnotapplytothecaseatbarfornofindingsoffactwereevermadebythetrialcourtinthefirstplace."
