Ms.ProffittwasinjuredinanautomobileaccidentpriortoherincarcerationintheBradleyCountyJusticeCenterinFebruary1994.Twomonthslateraphysicianrecommendedtheremovalofthepinsandscrewusedtorepairafractureofherleftleg,butMs.ProffittwastransferredtotheTennesseePrisonforWomenbeforethesurgerycouldbeperformed.OnMay27,1994,PrisonHealthServicesinformedDr.DonaldBoatwright,themedicaldirectoroftheTennesseePrisonforWomen,thatthesurgeryhadbeenapprovedandrequestedthatitbeperformedwithinthreeweeksunlessMs.Proffittssymptomsbecamemoresevereorherconditionchanged. TheprisonofficialsarrangedanappointmentforMs.ProffittwithDr.PatrickLeCorps.Dr.LeCorpsinsistedontakingxraysofhisowntodeterminewhethersurgerywaswarranted.AccordingtoMs.Proffitt,Dr.LeCorpsinformedheronAugust12,1994thatherecommendedthesurgerytoremovethepinsandscrew.Ms.ProffittalsoassertedthatDr.BoatwrightconfirmedDr.LeCorpsrecommendationonAugust19,1994andtoldherthatthesurgerywouldbescheduled.ThesurgerywasneverperformedandMs.ProffittwasreleasedfromprisoninNovember1994.ShelaterunderwenttheneededsurgeryatVanderbiltUniversityMedicalCenterinJanuary1995.@ II.  Basedonthepresentrecord,IcannotascribethedelayinperformingMs.ProffittssurgeryfromApriltoAugust1994toeitherPrisonHealthServicesnegligenceoritsdeliberateindifferencetoMs.Proffittsmedicalneeds.ThisdelaywascausedbyMs.ProffittstransferfromoneinstitutiontoanotherandbyDr.LeCorpsdecisiontoconducthisownexaminationofMs.Proffittratherthantorelyontheconclusionsandrecommendationsofanotherphysician.Thus,atleastinmymind,thematerialdelayinthiscaseisthedelayfromAugusttoNovember1994. ThechiefexplanationforthisdelayisthattheprisonofficialswereunawarethatDr.LeCorpshadrecommendedthesurgicalremovalofthepinsandscrewinMs.Proffittsleftleg.Dr.BoatwrightinsistedinhisdepositionthathewasneverinformedofDr.LeCorpsrecommendation.ThistestimonyiscontradictedbothbyDr.LeCorpswhostatedthatheinformedtheprisonofficialsofhisrecommendationsandbyMs.ProffittherselfwhostatedthatDr.BoatwrightinformedheronAugust19,1994thathersurgerywouldbescheduled. TherecordcontainsamaterialfactualdisputeconcerningtheprisonofficialsknowledgeinAugust1994ofDr.LeCorpsrecommendations.Inlightofthisdispute,wecannotholdasamatteroflawthatthedelayinprovidingMs.Proffitttheneededsurgerywasnottheresultofeithernegligenceordeliberateindifferencetohermedicalcondition.TherecordcontainssomeindicationthatthedelaymighthavebeencausedbythelossofMs.Proffittsmedicalrecordsorbyherpendingrequestforparole.ThelossofMs.Proffittsmedicalrecords,ifproven,couldprovidethebasisforhernegligenceclaim;whileadecisiontodelayperformingthesurgerybecauseofMs.Proffittspendingparole,ifproven,couldsubstantiateherdeliberateindifferenceclaim. PrisonHealthServicesalsoassertsthatthefailuretoperformMs.ProffittssurgeryfromAugust1994untilherreleaseinNovember1994wasappropriatebecausethesurgerywasnotahighpriorityprocedure.Itneverexplainedthebasisforitsprioritydeterminationor,asthemajoritypointsout,whatotherhigherpriorityproceduresforcedadelayinMs.Proffittsprocedure.InlightofitsowndeterminationonMay27,1994thattheprocedureshouldbeperformedwithinthreeweeks,therecordcontainsamaterialfactualdisputewithregardtothebasisforPrisonHealthServicesprioritydetermination.      ________________________________      WILLIAMC.KOCH,JR.,JUDGE
