ðthe€three€œRaytheon›€accounts€known€as€the€œRaytheon›ÏSavings€and€Investment€Account,€the€œRaytheon›€Share€account€andÏthe€œRaytheon›€Single€Life€Pension€Annuity€account.ðð€€The€trialÏcourt€made€other€decrees€pertaining€to€the€partiesðð€maritalÏproperty,€none€of€which€are€œrelevant›€to€the€issues€on€thisÏappeal.Ð v2&(0 Їà  àà ` àThe€trial€court€established€Husbandððs€supportÏobligations€pending€the€sale€of€the€residence.€€The€court€œfurtherÏaddressed›€œthese›€obligations€œas€follows:›ÌÌÓÓà  àà8 ` àAfter€the€residence€is€sold€beginning€the€first€ofÏthe€month€next€following€the€sale€of€theÏresidence,€the€husband€shall€pay€to€the€wifeÏ$500.00€alimony€per€month€for€five€years.€ÏThereafter,€based€upon€the€guidelines€forÏTennessee,€finding€the€net€income€of€the€counter„¼defendant€to€be€$3,542.00€and€subtractingÏtherefrom€the€$500.00€alimony€and€applying€theÏguidelines€to€those€tables,€he€shall€pay€as€childÏsupport€for€two€children€$973.40.€€œThis›€shall€beÏpaid€monthly€and€shall€be€paid€at€the€first€ofÏeach€month€beginning€on€the€first€month€nextÏfollowing€the€closing€of€the€sale€of€theÏresidence.€€After€five€years,€unless€a€substantialÏchange€of€œcircumstances›€has€caused€the€same€to€beÏreviewed€otherwise,€the€court€shall€review€theÏchild€support€to€determine€that€the€same€is€inÏaccord€with€the€guidelines€for€support€and€inÏforce€and€effect€after€five€years.œ×ƒ×Ý  àà ` àThe€divorce€judgment€further€provides€that€Husband€isÏto€ð ðpay€reasonable€moving€expenses€when€the€house€is€sold€for€theÏbenefit€of€[Wife]€and€children.ððÌâ âÐ È5x+4 Ðà  àà ` àThe€divorce€judgment€contains€a€number€of€otherÏâ âprovisions,€the€terms€of€which€are€not€pertinent€to€the€issuesÏraised€on€this€appeal.ÌÌÓÓÓÓà  àà ` àIn€December,€1989,€before€the€divorce€judgment€becameÏfinal,€each€of€the€parties€filed€a€pleading€seeking€œspecificÏrelief›€with€respect€to€that€judgment.€€œIn€her€pleading,€Wife›€œalsoÏasked,€in€the€alternative,›€for€a€new€trial.€€As€pertinent€to€theÏissues€now€before€us,€the€trial€court€entered€an€order€providingÏfor€the€listing€of€the€marital€residence€per€the€partiesððÏœagreement.€€It€also€modified›€the€divorce€judgment€to€provide€thatÏthe€debt€to€American€Express€was€in€the€amount€of€$2,815.85Ïrather€than€the€amount€specified€in€the€divorce€judgment.€€TheÏcourtððs€order€„„€which€was€entered€January€30,€1990€„„€alsoÏprovides€that€ð ðif€[Husband]€should€advance€funds€to€restoreÏand/or€repair€the€property€pending€a€sale€that€the€first€fundsÏreceived€from€a€sale€by€the€parties€shall€fully€reimburse€him€toÏthe€extent€such€monies€are€advanced.ðð€€Other€relief€requested€byÏthe€parties€was€denied.ÌÓaÓÌà@0 0 ìàB.€€œEarlier€Post„Divorce›€ActivityˆÌÌÌÓÓà  àà ` àIn€the€fall€of€1990,€there€was€a€flurry€of€activity€inÏthis€œcase,€some›€of€which€was€directed€at€the€issue€of€the€sale€ofÏthe€marital€residence.€€The€partiesðð€competing€pleadings€resultedÏin€two€orders,€the€first€of€which€was€entered€on€January€25,Ï1991.€€Among€other€things,€that€order€provides€that€ð ðany€offerÏmade€for€the€sale€of€the€house€should€be€submitted€to€the€Court,Ïif€reasonable,€for€the€œCourtððs›€œadjudication›€as€to€whether€itÏshould€be€accepted.ðð€€The€second€order€was€entered€April€16,Ð  9Ð.8 Ð1991.€€It€approves€Husbandððs€offer€to€purchase€Wifeððs€interest€inÏthe€marital€residence.€€The€April€16,€1991,€order€furtherÏprovides€that,€as€consideration€for€œthe›€œpurchase,€Husband€wouldÏpay›€œto€Wife›€$5,000€cash€plus€ð ðthe€further€consideration€ofÏextending€the€alimony€payments€of€[$500]€per€month€for€anÏadditional€three...years€after€the€five...year€period€of€alimonyÏpayments€œ[has]›€expired.ðð€€Husband€was€to€assume€the€firstÏmortgage€indebtedness€of€$148,000.€€Wife€was€given€30€days€œfrom›Ïthe€entry€of€the€April€16,€1991,€order€to€vacate€the€premises.ÌÌà  àà ` àOn€June€3,€1991,€Husband€filed€a€petition€in€which€heÏœalleged›€that€he€œhad€tendered›€$5,000€to€Wife€pursuant€to€theÏcourtððs€order€of€April€16,€1991,€but€that€she€œhad€ð ðrefuse[d›]€toÏvacate€the€premises€and€œ[had]€refuse[d›]€to€deed€the€propertyðð€toÏhim.ÌÌà  àà ` àOn€June€10,€1991,€the€trial€court€entered€an€order,€theÏvalidity€of€which€Wife€challenges€on€this€appeal.€€That€orderÏfinds€œWife›€in€contempt,€œbased€on›€her€failure€to€vacate€theÏmarital€residence.€€It€stays€the€imposition€of€a€ten„day€jailÏsentence€until€July€1,€1991,€and€allows€Wife€an€opportunity€toÏpurge€herself€of€contempt€by€moving€out€of€the€marital€residenceÏby€that€date.€€It€directs€Husband€to€pay€$5,000€into€the€registryÏof€the€trial€court,€said€sum€to€be€held€œpending›€inspection€of€theÏresidence€ð ðto€ensure€no€damage€has€been€doneðð€to€œthe€premises€byÏWife.›€€œThe›€June€10,€1991,€order€describes€the€property€by€metesÏand€œbounds,›€œdivests›€Wifeððs€interest€in€œsame,›€and€vests€thatÏinterest€in€Husband.€€As€particularly€pertinent€to€this€appeal,Ïthe€order€ends€with€the€signature€of€the€trial€judge€but€does€notÐ  àà ` àœThe›€current€round€of€litigation€commenced€œon€June€3,Ï1996,€when›€Wife€filed€a€pleading€styled€ð ðMotionðð€in€which€sheÏœsought›€œthe€following:€€a›€declaration€that€the€June€10,€1991,Ïorder€œwas›€ð ðnull€and€voidðð€because€of€its€failure€to€comply€withÏRule€58,€Tenn.R.Civ.P.;€a€judgment€for€$5,000€ð ðplus€interestðð€forÏthe€payment€ordered€by€the€trial€court€in€the€challenged€June€10,Ï1991,€order;€and€a€judgment€for€alimony€arrearage€in€the€amountÏof€$48,000.ÌÌà  àà ` àWifeððs€motion€was€met€by€Husbandððs€answer€andÏcounterclaim€of€June€24,€1996.€€Among€other€things,€theÏcounterclaim€seeks€a€credit€against€Husbandððs€child€supportÏobligation€for€payments€made€by€œhim›€for€the€support€of€his€minorÏchild,€Karim,€for€a€three„year€period€during€which€œthe›€child€wasÏresiding€with€him.ÌÌà  àà ` àOn€July€26,€1996,€while€the€pleadings€mentioned€in€theÏpreceding€paragraph€were€pending,€Husband€filed€a€motion€allegingÏthat€Wife€had€agreed€to€furnish€a€quit€claim€deed€to€facilitateÏhis€sale€of€the€former€marital€residence,€but€that€she€hadÐ  9Ð.8 Ðthereafter€refused€to€do€so.€€He€alleged€that€Wifeððs€failure€hadÏfrustrated€his€efforts€to€sell€their€former€œresidence,›€which€inÏturn€had€prevented€him€from€closing€on€the€purchase€of€a€newÏhouse€in€Virginia.€€He€sought€an€order€directing€Wife€to€executeÏthe€quit€claim€deed.€€He€further€asked€for€sanctions€and€hisÏattorneyððs€fees.ÌÌà  àà ` àWife€responded€to€Husbandððs€motion€of€July€26,€1996,€byÏfiling€an€answer€in€which€she€œstated›ÌÌÓÓà  àà8 ` àthat€there€were€discussions€regarding€theÏexecution€of€a€quit€claim€deed€through€her€NewÏYork€counsel,€however,€she€was€not€privy€to€thoseÏdiscussions€and€cannot€admit€or€deny€the€same.Ð ` Ð ` Ð  ÐÌÌÌShe€concluded€her€answer€by€pointing€outÌÌÌÌà  àà8 ` àthat€a€hearing€has€been€set€for...August€16,€1996,Ïand€the€issues€set€forth€in€this€Motion€and€theÏissues€in€the€Motion€previously€filed€by€[Wife]Ïshould€be€resolved€at€that€time.Ð ` Ð ` Ð  ÐÌÌÌÓÓà  àà ` àA€hearing€on€August€2,€1996,€œresulted›€in€an€orderÏentered€August€6,€1996,€directing€Wife€to€ð ðòòinstanteróó€sign€theÐ À+p!( ÐQuitclaim€Deed€faxed€to€her€New€York€Attorney€on€June€27,€1996,Ïat€3:00€p.m.€and€[to]€immediately€fax€such€signed€Deed€to€herÏAttorney€[in€Tennessee]€no€later€than...August€5,€1996.ðð€€OnÏAugust€7,€1996,€Husband€filed€a€Motion€for€Contempt€alleging€thatÏWife€œhad›€œagain€refused›€to€sign€the€œdeed.›ÌÌà  àà ` àOn€August€8,€1996,€Wifeððs€Tennessee€œattorney›€moved€toÏwithdraw€as€her€counsel.€€He€also€sought€a€continuance€ð ðuntilÐ ,9Ü.8 Ðsuch€time€as€[Wife]€obtains€counsel.ðð€€An€order€was€signed€andÏentered€on€August€8,€1996,€permitting€Wifeððs€attorney€to€withdrawÏas€her€counsel€of€record€and€directing€that€œWife›€appear€in€courtÏon€August€16,€1996.ÌÌà ЛÌÓb8ÓÌShe€also€asked€for€a€modification€of€Husbandððs€child€supportÏobligation.ÌÓÓÌà@LLìàD.€€Orders€Appealed€FromˆÌÌÌÓÓà  àà ` àœThe€current€controversy€resulted€in€two›€œorders,€both€ofÏwhich€are€before›€us€on€this€appeal.€€The€first€order€was€enteredÏJanuary€24,€1997,€following€a€hearing€on€December€13,€1996.€€InÏthat€order,€the€trial€court€refused€to€set€aside€the€order€ofÏAugust€6,€1996,œ×ƒ×Ý ƒ#ÃÝòòÚ  Ú4Ú  ÚóóÝ  Ý×  ×›€which€directed€Wife€to€òòinstanteróó€sign€a€quitÐ ´d Ðclaim€œdeed.€€The›€court€reserved€all€other€issues,€but€it€didÏagree€œthat€Wife›€œcould€seek›€affirmative€relief€even€though€she€hadÏfailed€to€pay€Husbandððs€expenses€incurred€by€him€in€connectionÏwith€the€failed€closing.ÌÌà  àà ` àThe€last€hearing€in€the€court€below€was€held€on€AprilÏ15,€1997.€€The€trial€court€filed€its€memorandum€opinion€onÏSeptember€4,€1997.€€œThat›€opinion€was€incorporated€by€referenceÏinto€an€order€entered€October€6,€1997.€€In€its€order,€the€trialÏcourt€modified€Husbandððs€child€support€obligation€by€increasingÏhis€monthly€payment€to€œ$1,640€„„›€a€decree€not€challenged€on€thisÏappeal.€€As€pertinent€to€the€issues€on€this€appeal,€the€trialÏcourt€rendered€the€following€decrees:ÌÌÓÓà  àà8 ` à1.€€That€Husband€is€entitled€to€a€credit€ofÏ$15,320€against€the€amount€of€child€support€dueÐ ª6Z,5  àà ` àA€division€of€property€in€a€divorce€case€is€not€subjectÏto€modification€after€the€œjudgment€or€order€decreeing€theÏdivision›€becomes€œfinal,€absent€some€Rule€60.02,€Tenn.R.Civ.P.,Ïbasis€for€relief.€€ò Ðmarital€residence€when€she€was€occupying€it€with€the€children€andÏthat€she€is€entitled€to€be€reimbursed€for€œthese›€œexpenditures.›€ÏThe€trial€court€did€not€œspecifically€address›€this€claim.€€Thus,Ïwe€examine€the€record€to€see€if€the€evidence€preponderatesÏagainst€the€trial€courtððs€tacit€denial€of€œWifeððs›€œclaim.€€òòSeeóóÐ àWife€did€not€present€any€documentation€to€substantiateÏthis€claim.€€Her€claim€rests€solely€on€her€oral€testimony€thatÏshe€expended€this€sum€to€improve€the€property€and€therebyÏœincrease›€or€œmaintain›€its€value.€€Husband€counters€this€claim€withÏhis€testimony€that€Wife€left€the€premises€in€a€œless„than„ideal›Ïcondition.ÌÌà  àà ` àHusband€correctly€points€out€that€the€trial€courtððsÏorder€of€January€30,€1990,€only€addresses€òòexpenditures€by€himóó€andÐ Â,r") Ðnot€those€made€by€Wife.€€If€this€were€the€only€impediment€toÏWifeððs€claim,€we€would€be€inclined€to€honor€œit;›€but€the€fact€ofÏthe€matter€is€that€Wifeððs€testimony€on€this€subject,€whenÏconsidered€in€the€light€of€Husbandððs€testimony,€is€less€thanÏpersuasive.€€We€cannot€say€that€the€evidence€preponderatesÏagainst€the€trial€courtððs€tacit€denial€of€this€claim.ÌÓÓòò̜Р àWife€seeks€to€set€aside€the€trial€courtððs€order€ofÏApril€16,€1991€„„€the€order€which€approved€Husbandððs€offer€toÏpurchase€Wifeððs€interest€in€the€marital€residence€and€œwhich€set›Ïthe€consideration€for€same€at€$23,000.€€She€questions€the€orderððsÏvalidity€œfor€the€following€reasons;€because›€Husband€failed€toÏcomply€with€the€order€by€paying€$5,000€into€court;€because,Ïaccording€to€her,€the€order€ð ðhas€errors€in€computationðð;€œbecauseÏthe›€ð ðorder€is€without€a€certificate€of€service€or€a€notice€ofÏentry€after€it€was€filedðð;€œbecause€the›€order€ð ðwas€superseded€byÏthe€order€of€June€10,€1991";€and€for€another€reason,€the€importÏof€which€is€unintelligible€to€the€court.ÌÌà  àà ` àThe€order€of€April€16,€1991,€is€valid.€€HusbandððsÏfailure€to€comply€with€the€order€does€not€vitiate€its€validity.€ÏœFurthermore,€contrary€to€Wifeððs€assertion,›€the€order€does€notÏreflect€on€its€face€any€ð ðerrors€in€computation.ðð€€œAlso€contraryÏto€Wifeððs€claim,€the›€order€is€signed€by€counsel€for€both€partiesÏand€even€has€a€œcertificate›€in€which€the€clerk€œof€the€trial€courtÏcertifies›€service€of€the€order€on€œWife.›€€œFinally,›€the€order€ofÏApril€16,€1991,€was€not€superseded€by€the€June€10,€1991,€order.€ÏThe€latter€order€addressed€Husbandððs€petition€seeking€enforcementÏof€the€April€16,€1991,€order€and€a€finding€of€contempt€againstÏWife€for€her€failure€to€abide€by€the€terms€of€the€earlier€order.ÌÌà  àà ` àWifeððs€attempt€to€set€aside€the€order€of€April€16,Ï1991,€is€without€merit.Ð ö9¦/9 ÐÓÓà@Ô Ô ìàœ2.›€€Order€of€June€10,€1991ˆÌÌÌÓÓà  àà ` àWife€also€attempts€to€invalidate€the€June€10,€1991,Ïorder€that€found€œher›€in€contempt,€stayed€same,€and€œthen›€divestedÏand€vested€her€interest€in€the€marital€residence.€€WithoutÏreciting€in€detail€Wifeððs€bases€for€challenging€this€order€„„Ïnone€of€which€œappear€to€be€sufficient›€in€this€case€to€set€asideÏthe€challenged€order€„„€the€court€observes€that€Wifeððs€counselÏstated€to€the€trial€court€during€the€April€15,€1997,€hearing,Ïthat€ð ðIððm€not€trying€to€set€it€aside,€Judge.ðð€€It€is€well„¼established€that€a€party€will€not€be€permitted€to€take€a€positionÏon€appeal€that€is€contrary€to€a€position€that€he€or€she€took€atÏœtrial.€€ò òòòClement€v.€Nicholsó óóó,€209€S.W.2d€23,€24€(Tenn.€1948);Ð Š: Ðò òòòEstate€of€Schultz€v.€Munford,€Inc.ó óóó,€650€S.W.2d€37,€40€(Tenn.App.Ð V Ð1982).€€That›€is€precisely€what€Wife€is€attempting€to€do€in€thisÏcase.€€We€cannot€permit€this.€€This€issue€is€found€adverse€toÏWife.ÌÓÓÌà@\ \ ìàœ3.›€€Order€of€August€30,€1996ˆÌÌÌÓÓà  àà ` àWife€also€challenges€the€trial€courtððs€order€of€AugustÏ30,€1996,€which,€among€other€things,€directed€her€to€payÏHusbandððs€expenses€of€$3,162.€€These€expenses€were€incurred€inÏconnection€with€the€failed€closing€of€Husbandððs€sale€of€theÏformer€marital€residence.€€œThat›€sale€did€not€close€because€œWife›Ïfailed€to€supply€a€quit€claim€deed€as€she€had€agreed€to€doÏthrough€her€New€York€attorney.ÌÌà  àà ` àThe€trial€court€made€specific€factual€findings€withÏâ ârespect€to€the€œevidence€presented€at€the€hearing›€of€August€16,Ð Š8:.7 Ð1996,€which€hearing€led€to€the€entry€of€the€August€30,€1996,€œorder:Ìâ âÌÓÓà  àà8 ` àThe€Court€further€finds€that€as€to€defendantððsÏMotion€to€Set€Aside€the€Courtððs€Order€of€AugustÏ30,€1996,€that€the€defendantððs€attorney€of€recordÏby€fax€dated€August€8,€1996...,€advised€defendantÏto€appear€August€16,€1996,€in€court.€€DefendantððsÏcounsel€was€on€his€Motion€relieved€ofÏrepresentation€of€defendant€on€August€8,€1996,€byÏthe€Court,€after€appearing€on€behalf€of€theÏdefendant€pursuant€to€Notice€to€appear€on€AugustÏ2,€1996,€at€which€time€defendantððs€attorneyÏobtained€a€continuance€of€the€matter€to€August€8,Ï1996.€€The€Court€further€finds€that€the€testimonyÏof€the€defendant€is€not€truthful€and€that€herÏveracity€has€been€successfully€brought€into€issueÏby€reason€of€inconsistency€of€defendantððsÏtestimony€with€that€of€her€previous€attorney,€aÏmember€in€good€standing€with€the€Kingsport€BarÏAssociation,€as€to€the€factual€issues€of€whenÏdefendant€testified€she€learned€of€her€attorneyððsÏwithdrawing€from€representation.€€The€Court€hasÏalso€taken€into€consideration€defendantððsÏuntruthful€statement€of€her€income€on€her€1994„¼1995€Income€Tax€Returns;€her€previous€finding€ofÏcontempt€of€the€Orders€of€the€Court€in€1991€forÏher€refusal€to€remove€herself€from€the€partiesððÏmarital€property€and,€additionally,€claiming€theÏchildren€for€deduction€purposes€on€her€Income€TaxÏReturn€contrary€to€order€of€this€court;€andÏnotably,€that€she€as€an€experienced€litigator€wasÏpresent€and€was€available€to€attend€the€scheduledÏhearing€of€August€16,€1996,€if€only€for€theÏpurpose€of€requesting€a€continuance€in€order€to€beÏallowed€time€to€obtain€representation€whichÏdefendant€failed€or€refused€to€do€which€is€anÏindication€to€this€Court€again€of€the€defendantððsÏcombative€and€self„serving€attitude€which€theÏCourt€observed€during€the€hearing€of€this€cause€onÏApril€15,€1997.€€In€fact,€the€defendant€met€withÏher€present€counsel€on€August€20,€1996.€ÏTherefore,€the€Court€denies€the€defendantððs€MotionÏto€Set€Aside€the€Courtððs€Order€of€August€30,€1996,Ïand€the€Court€finds€no€justification€in€truth€orÏin€fact€to€relieve€defendant€of€the€obligation€toÏpay€to€the€plaintiff€the€sum€of€$3,162.00€relativeÏto€which€there€is€no€testimony€in€the€record€as€toÏwhether€this€sum€of€expenses€is€excessive€orÏunreasonable;€therefore,€the€Court€findsÏdefendantððs€Motion€to€Set€Aside€should€beÏoverruled.›Ð ` Ð ` Ð  ÐÓØtÓÌà  àà ` àThe€evidence€does€not€preponderate€against€theseÏfactual€findings.€€This€is€especially€true€in€view€of€the€trialÐ ö9¦/9 Ðcourtððs€credibility€finding€with€respect€to€œWife›€„„€ð ðthat€theÏtestimony€of€[Wife]€is€not€truthful€and€that€her€veracity€hasÏbeen€successfully€brought€into€issue.ðð€€The€evidence€in€this€caseÏis€clear€that€Wife€knew€that€a€hearing€had€been€scheduled€forÏAugust€16,€1996;€that€she€was€in€the€œgeographic€area›€œof€the€courtÏat›€the€time€of€the€hearing;€and€that€she€made€a€consciousÏdecision€not€to€attend€the€hearing.€€Wife€has€only€herself€toÏblame€for€the€adverse€consequences€visited€upon€her€as€a€resultÏof€the€August€16,€1996,€hearing.ÌÌà  àà ` àœThe›€testimony€in€the€record€is€clear€that€Wife,€throughÏher€New€York€counsel,€agreed,€prior€to€the€closing,€to€execute€aÏquit€claim€deed€to€memorialize€the€fact€that€she€no€longer€had€aÏlegal€interest€in€the€former€marital€residence.€€When,€at€theÏlast€minute,€she€refused€to€do€so€and€thereby€œcaused›€theÏœcancellation€of€the€scheduled›€closing,€œthe€trial€court€actedÏappropriately€in€burdening›€her€with€Husbandððs€expenses€occasionedÏby€the€failed€closing.œ×ƒ×Ý àIn€the€greater€number€of€cases€dealing€with€theÏquestion,€interest€has€been€allowed€on€unpaidÏalimony.€€Thus,€where€the€problem€arose€in€respectÏof€judgments€for€alimony€in€gross,€interest€hasÏbeen€allowed€from€the€date€payment€was€due€underÏthe€judgment€until€payment€was€made,€and,€as€toÏunpaid€instalments,€interest€has€been€allowed€fromÏthe€date€the€particular€instalment€matured.€ÏLikewise,€interest€has€been€allowed€on€unpaidÏinstalments€of€alimony€against€the€estate€of€aÏdeceased€divorced€spouse.€€The€theory€upon€whichÏinterest€is€allowed€in€these€cases€is€that€aÏjudgment€awarding€alimony€is€in€the€nature€of€aÏmoney€judgment.€€The€same€result€has€been€reachedÏeven€where€the€judgment€or€instalment€became€dueÏand€payable€pending€an€appeal€of€the€judgmentÏawarding€the€alimony,€on€the€theory€that€the€partyÏawarded€alimony€should€not€be€deprived€of€it€byÏthe€prosecution€of€an€appeal.Ð ` Ð ` Ð  ÐÌÐ  9P/8 Їò òòòIdó óóó.€at€734.Ð P  ÐÌÌÌÓÓà  àà ` àBased€on€the€foregoing€authorities,€we€believe€theÏtrial€court€in€the€instant€case€erred€in€decreeing€that€interestÏon€Wifeððs€$5,000€judgment€and€alimony€arrearage€would€not€beginÏto€accrue€until€October€6,€1997.€€We€find€and€hold€that€theseÏawards€were€made€in€an€order€that€became€final€in€1991.€€It€is€toÏthat€earlier€order€that€we€must€look€to€determine€the€interestÏaccrual€date€of€the€$5,000€award€and€the€alimony€award.ÌÌà  àà ` àWife€is€entitled,€as€a€matter€of€law,€to€interest€atÏthe€rate€of€10%€per€annum,€without€compounding,€on€the€judgmentÏthat€first€awarded€her€$5,000.€€That€judgment€was€entered€JuneÏ10,€1991.€€Since›€that€order€œhad€the€effect€of€divesting›€Wife€ofÏher€interest€in€the€œformer€marital€residence,€Husband›€should€haveÏpaid€$5,000€into€the€registry€of€the€court€as€of€that€date.€€ThisÏis€what€he€was€directed€to€do€œin›€the€June€10,€1991,€order.€€HadÏhe€done€so,€he€œwould›€have€prevented€any€interest€from€accruing€onÏthe€$5,000€œaward.›€€He€cannot€rely€on€his€partial€tenderœ×ƒ#×Ý ƒ#ÃÝòòÚ  Ú6Ú  ÚóóÝ  Ý×  ×›€toÐ x(($ ÐWifeððs€attorney.€€œHe€should€have€made€his€payment€„„€in€the€fullÏamount€„„€directly€to›€the€registry€of€the€court€œas€he€wasÏdirected€to€do.€€Furthermore,›€his€partial€tender€was€conditional.€ÏœThe›€œcondition€„„›€a€œclaimed€credit›€œof€$2,000€for›€œsome›€tools€œthatÏhe€was€awarded€in€the€divorce€judgment€but€allegedly€did€notÏreceive€„„€was›€œlater€rejected›€by€the€trial€court.€€œWife›€cannot€beÏfaulted€for€refusing€to€accept€œHusbandððs€conditional›€partialÏtender.€€That€tender€did€not€have€the€effect€of€stopping€œtheÏaccrual€of€interest.›Ð „74-6 Їà  àà ` àWifeððs€alimony€award€was€a€œjudgment;€but€since€it€wasÏpayable€in€installments,€interest€does€not€accrue€on€any€givenÏinstallment€until€the€due€date€of€the€payment.€€òòSee€ò òWest€AmericanÐ ¨ X ÐInsurance€Co.€v.€Montgomeryó óóó,€861€S.W.2d€230,€232€(Tenn.€1993).€Ð t$ ÐHence€each€installment€accrues›€interest€œat€the€rate€of€10%€fromÏthe€due€date€of€the€payment,€again€as›€a€matter€of€law.€€œThis›€isÏsimple€interest€without€compounding.€€The€trial€court€determinedÏthat€there€was€an€arrearage€of€$13,612€through€April€1,€1997.€ÏThis€represents€27€payments€at€$500€each€and€one€payment€of€$112.€ÏLogically,€the€payment€of€$112€is€the€oldest€one€due.€€GoingÏbackwards,€it€was€due€January€1,€1995,€and€accrues€simpleÏinterest€at€the€rate€of€10%€per€annum€from€that€œdate€until€paid.›€ÏEach€œaward€of€alimony€of›€$500€accrues€interest€at€the€rate€of€10%Ïper€annum€from€œits€due›€œdate,€again€until€paid.›€€For€example,€$500Ïwas€due€February€1,€1995,€$500€was€due€March€1,€œ1995;›€œand,›€goingÏœforward,›€each€additional€$500€payment€was€due€on€the€first€day€ofÏthe€next€succeeding€25€œmonths.ÌÌà  àà ` àThere€is€no€credible€evidence€that€any€of€the€alimonyÏdue€prior€to€January€1,€1995,€was€not€timely€paid.€€Therefore,ÏWife€is€not€entitled€to€any€interest€on€payments€due€prior€toÏthat€date.ÌÌà  àà ` àThe€trial€court€determined€that€Husband€had€effectivelyÏpaid€all€of€the€child€support€due€under€prior€orders€of€thatÏcourt.€€The€evidence€does€not€preponderate€against€this€finding.€ÏThere€is€no€credible€evidence€that€Husband€failed€to€make€theseÏâ âpayments€in€other€than€a€timely€fashion.€€Therefore,€Wifeððs€claimÐ ´7d-6 Ðthat€she€is€entitled€to€post„judgment€interest€on€child€supportÏpayments€is€without€merit.Ìâ âÌà  àà ` àThe€trial€court€did€award€Wife€child€support€at€a€newÏrate,€òòi.e.óó,€$1,640€per€month,€retroactive€to€October,€1996;€butÐ ° Ðthis€award€was€first€reduced€to€judgment€in€the€order€of€OctoberÏ6,€1997.€€Therefore,€interest€on€this€award€for€any€period€ofÏtime€prior€to€October€6,€1997,€would€be€in€the€nature€of€pre„¼judgment€interest.€€An€award€of€such€interest€is€discretionaryÏwith€the€trial€court.€€òòSeeóó€T.C.A.€ðð€47„14„123.€€òòSee€alsoóó€ò àIn€its€order€of€October€6,€1997,€the€trial€courtÏawarded€Wife€a€judgment€for€$2,954.25,€being€the€total€of€theÏobligations€to€Exxon€and€American€Express,€which€obligations,ÏHusband€was€ordered€to€pay€in€the€divorce€judgment.€€The€trialÏcourt€decreed€that€this€award€would€bear€interest€from€and€afterÏthe€October€6,€1997,€order.€€We€believe€this€was€appropriate.€ÏThe€divorce€judgment€did€not€order€Husband€to€pay€Wife€theÏamounts€of€these€bills;€that€judgment€simply€ordered€him€to€payÏthe€creditors.€€The€first€judgment€awarding€Wife€monies€withÏrespect€to€these€bills€was€the€trial€courtððs€order€of€October€6,Ï1997.€€Any€interest€on€this€award€prior€to€that€date€would€be€inÏthe€nature€of€pre„judgment€interest.€€The€trial€court€did€notÏabuse€its€discretion€in€failing€to€award€such€interest€withÏrespect€to€these€bills.€€This€is€especially€true€in€view€of€theÏfact€that€Wifeððs€testimony€was€somewhat€contradictory€as€to€ifÐ l9/8 Ðand€when€she€paid€these€bills,€and,€if€so,€whether€she€paid€allÏor€only€part€of€them.€€Despite€the€less„thanñeñ„definite€nature€ofÏthis€testimony,€the€trial€court€apparently€found€that€Wife€didÏñeññgññeñnotÏpñeññgññhñpñhññeñay€these€two€biñeññfñllsñfññjñ,ñjññiñ€and€this€finding€is€not€challenged€on€thisÏappeal;€but€the€ambiguous€nature€of€Wifeððs€testimony€isÏjustification€enough€for€the€trial€courtððs€decision€not€to€awardÏpre„judgment€interest.ñiñÌÌà  àà ` àIn€fairness€to€Husband€„„€even€though€he€has€not€raisedÏthe€matter€on€appeal€„„€we€would€point€out€that€he€is€entitled€toÏpost„judgment€interest€on€the€judgment€of€$3,162€awarded€to€himÏin€the€trial€courtððs€order€of€August€30,€1996;€to€quote€a€well„¼known€saying,€ð
