Thisisagrandparentsvisitationrightscase.WeareaskedtoreviewthejudgmentoftheCircuitCourtofBradleyCountydismissingthegrandparentscomplaint.  ThiscaseoriginatedintheBradleyCountyJuvenileCourt.Theplaintiffs,HarseRayandhiswife,FlorenceRay,filedacomplaintseekingvisitationwiththeirgranddaughterSarahJaneScottpursuanttotheprovisionsofT.C.A.366302 .   כ,thesocalledgrandparentsvisitationrightsstatute.ItisundisputedthatthemotherofSarahJaneScottdiedpriortothefilingofthecomplaint.Itisalsoundisputedthatatthetimeofherdeathshewasmarriedtothechildsfather,thedefendantJamesAnthonyScott.  TheJuvenileCourtgrantedtheplaintiffsvisitationwiththeirgranddaughter.Withintendays,thedefendantfatherfiledanoticeofappealasfollows: 8 JamesAnthonyScott...herebygivesnoticeoftheappealtotheCircuitCourtforBradleyCounty,TennesseeofanOrderandJudgmentrenderedinfavorofHarseRayandwife,FlorenceRay...onFebruary25,1994intheJuvenileCourtforBradleyCounty,Tennessee.Subsequenttothefilingofthenoticeofappeal,thegrandparentsfiledamotioninCircuitCourttodismisstheappealonthegroundthat it[was]notfiledintheappropriateCourt.TheCircuitCourtdeniedthegrandparentsmotion.ThatcourtthenproceededtoholdthattheJuvenileCourtwaswithoutsubjectmatterjurisdictiontoentertain theoriginalcauseforgrandparentsvisitationrights.Consequently,theCircuitCourtdismissedthegrandparentscomplaint.Thisappealfollowed.  Therearetwoissuesbeforeus:first,whethertheCircuitCourthadjurisdictionoftheappealfromJuvenileCourt;and,second,whethertheJuvenileCourthadsubjectmatterjurisdictionofagrandparentsvisitationrightscaseunderthefactsofthiscase.  AppealsfromjuvenilecourtsaregovernedbyT.C.A.Ϝ371159.Thatstatuteprovides,inpertinentpart,asfollows: 8 (a)thejuvenilecourtshallbeacourtofrecordandanyappealfromanyfinalorderorjudgmentinadelinquencyproceeding,unrulychildproceeding,ordependentandneglectproceeding,filedunderthischapter,...maybemadetothecircuitcourtwhichshallhearthetestimonyofwitnessesandtrythecasedenovo.Theappealshallbeperfectedwithinten(10)days,excludingnonjudicialdays,followingthejuvenilecourtsdisposition.@ *** 8 (g)AppealsinallothercivilmattersheardbythejuvenilecourtshallbegovernedbytheTennesseeRulesofAppellateProcedure.Ӝ(Emphasisadded).̛  Therewerenoallegationsinthiscasetosuggestthatthiswas adelinquencyproceeding,unrulychildproceeding,ordependentandneglectproceeding.Thesumandsubstanceofthecomplaintwasanapplicationforcourtorderedvisitationwiththeplaintiffsgranddaughter.Thefatherofthechilddoesnotattempttoargueonthisappealthatthisisotherthanastraightforwardgrandparentsvisitationrightscase.  Undersubsection(g)ofT.C.A.371159,theappealoftheJuvenileCourtsjudgmentshouldhavebeenpursueddirectlytotheCourtofAppeals.ItresultsthattheCircuitCourtwaswithoutappellatejurisdictionunderT.C.A.371159.Intheabsenceofsuchjurisdiction,thatcourtcouldnotaddresstheproprietyoftheJuvenileCourtsaction,includingwhetherthatcourthadjurisdictiontograntgrandparentsvisitationrights;norcanwe.  WearewithoutjurisdictiontoreachtheissueoftheJuvenileCourtsjurisdiction.ThatissueisnotbeforeusbecausetheJuvenileCourtsjudgmentwasnotproperlyappealedtouspursuanttotheRulesofAppellateProcedureasrequiredbyϜT.C.A.371159(g).Insofinding,wearetruetoprecedentholdingthat [i]tisaxiomaticthattheappellatejurisdictionofacourtinanygivencaseisdependentupontheexistenceofjurisdiction,eitheroriginalorappellate,inthecourtfromwhichtheappealcomes.𛀀 Morganv.Betterton ,109Tenn.84,69ϜS.W.969,970(Tenn.1902).Ifthecourtfromwhichanappealispursuedwaswithoutjurisdictiontoaddresstheissuesathand,soarewe.
