àThe€parties€were€married€in€1975.€€At€the€time€ofÏtheir€marriage,€the€wife€had€a€son,€and€œa›€son€was€born€to€theÍparties.€€At€the€time€of€the€divorce,€the€child€of€the€marriageÏwas€19,€the€husband€41,€and€the€wife€39.Ìà àà àThe€husband€is€employed€by€Lockheed€Martin€and€had€aÏnet€income€of€$2,972.49€per€month.€€The€wife€is€employed€byÏMaryville€College.€€She€went€from€part„time€to€full„time€workÏafter€the€parties€separated.€€œHer›€net€income€œis›€$910.00€perÏmonth.€€Her€job€allows€her€sons€to€attend€college€without€payingÏtuition€and€she€is€also€eligible€for€that€program.€€€Ìà àà àThe€Trial€Court€found€that€the€husband€was€notÏcredible€regarding€the€nature€of€his€relationship€with€a€co„worker€and€had€been€guilty€of€inappropriate€marital€conduct.€TheÏJudge€concluded€that€the€wife€will€be€œð ðdramatically›€economicallyÏdisadvantaged€relative€to€the€œhusbandð ð›€and€that€the€wife€can€notÏbe€rehabilitated€due€to€her€age€and€other€factors.€€While€bothÏparties€were€high€school€graduates,€the€training€œand€experienceÏof›€the€husband€œwere›€far€superior€to€that€of€the€wife.€€Ìà àà àThe€partiesðð€assets€and€liabilities€were€divided€inÏthe€following€œmanner:€›€œthe›€marital€residence€with€œequity€ofÏ$119,000.00€was›€awarded€to€the€wife.€€Both€parties€were€requiredÏto€continue€to€pay€the€$64,000.00€mortgage€in€the€amount€ofÏ$734.00€per€month.€The€husbandððs€retirement€of€$872.74€perÏmonth,€payable€at€age€65,€was€divided€between€the€parties.€€TheÏhusband€œis€required€to€pay›€a€K„25€loan€in€the€amount€ofÏ$4,300.00,€and€a€Master€Card€account€in€the€amount€of€œ$3,600.00.€ÍThe›€wife€œis€to€pay›€a€Sears€charge€account€of€$1,000.00.Ìà àà àThe€Trial€Court€set€periodic€alimony€at€$850€perÏmonth,€to€terminate€upon€remarriage,€or€the€death€of€eitherÏparty.œ× ƒ+ ××  ×›€€When€the€husband€begins€receiving€his€retirement,€theÏperiodic€alimony€will€be€reduced€by€the€amount€of€the€retirementÏaccount€payment€to€the€wife.€€The€Court€made€œfurther›€provisionÏto€increase€the€alimony€award€at€the€end€of€each€five€years€byÏthe€amount€of€increase€in€the€Consumer€Price€Index.€€Ìà àà àThe€husband€urges€the€Court€to€examine€the€wifeððsÏmonthly€expenses,€as€listed€in€her€affidavit€and€modified€byÏtestimony€showing€that€some€expenses€were€for€the€partiesðð€son.€ÏThese€expenses€total€œ$1,126.70.€€It€is›€urged€that€since€theÏperiodic€alimony€was€set€at€$850.00,€œthe€award€is€excessive.›Ìà àà àThe€husband€also€argues€that€the€marital€residence€isÏmuch€larger€than€the€wife€needs.€€The€marital€residence€is€aÏhome€of€3,000€square€feet€with€four€bedrooms€and€two€baths.€€ItÏis€located€on€6.8€acres€in€Blount€County.€€He€notes€thatÏalthough€their€son€lives€with€her,€the€son€is€not€a€minor€forÏwhom€he€is€obligated€to€provide€any€support.€€He€would€have€theÏCourt€order€the€property€sold.€€Even€if€the€majority€of€theÏequity€was€awarded€to€the€wife,€he€argues€that€he€would€preferÍthis€result€to€being€burdened€with€the€mortgage€payment.Ìà àà àAlimony€is€determined€œupon€consideration€of›€theÏfactors€œin›€T.C.A.€ðð36„5„101.œ× ƒ, ××  ×›€€The€Trial€Courtððs€award€ofÏalimony€will€not€be€€disturbed€on€appeal,€absent€an€abuse€ofÏdiscretion.€€òòCrouch€v.€Crouchóó,€385€S.W.2d€288,€53€Tenn.€App.€594Ï(1964).Ìà àà àœTaking€into€account€the€factors€set€forth€in€theÏstatute,€the›€evidence€does€not€preponderate€against€the€TrialÏCourtððs€finding€that€the€wife€will€be€dramatically€economicallyÏœdisadvantaged.€€T.R.A.P.€Rule€13(d).›€€The€record€shows€that€sheÏis€working€in€a€secretarial€position€with€little€chance€forÍadvancement€because€of€her€lack€of€computer€skills.€€AlthoughÏher€tuition€would€be€waived€at€Maryville€College,€the€CollegeÏdoes€not€offer€vocational€training€and€is€in€the€process€ofÏclosing€its€evening€school.€€In€addition,€she€suffers€fromÏhealth€problems€œwhich›€affect€her€stamina.€€The€Trial€Court€didÏnot€err€by€not€making€the€alimony€rehabilitative.€€òòCranford€v.ÏCranfordóó,€772€S.W.2d€48€(Tenn.€App.€1989).Ìà àà àThe€Court€did€not€err€in€assessing€alimony€òòin€futuroóó.€ÏThe€wifeððs€affidavit€is€a€very€conservative€estimate€of€herÏexpenses.€€The€award€of€alimony€brings€the€parties€closer€to€theÏfinancial€positions€they€held€during€the€marriage.œ× ƒ. ××  ×›€€The€husbandÏhas€the€ability€to€pay,€òòKincaid€v.€Kincaidóó,€912€S.W.2d€140Ï(Tenn.€App.€1995).€€The€award€of€alimony€òòin€futuroóó€is€justified,Ïboth€as€to€accommodate€her€needs€and€to€assure€that€her€standardÏof€living€does€not€drastically€drop.€€òòAaron€v.€Aaronóó,€909€S.W.2dÏ408€(Tenn.€œ1995).›€€Ìà àà àIn€the€well„reasoned€opinion€of€œòòCranfordóó,›€Judge€KochÏsummarized€the€basis€and€rationale€for€an€alimony€award€thus:€€ÌÓÓà0 àà0 àÓÓWe›€do€œconclude,›€however,€the€Court€abused€itsÏdiscretion€in€requiring€the€husband€to€pay€one„half€of€the€houseÏpayments,€under€the€theory€that€one„half€of€the€œequity€in€theÏhouse›€was€awarded€as€a€property€settlement,€and€the€other€halfÏas€alimony€òòin€solidoóó.€€The€œeffect›€of€the€Judgeððs€action€is€a€feeÏsimple€award€of€the€marital€residence€to€the€wife,€and€weÏconclude€that€she€should€have€the€œresponsibilty›€for€paying€theÏentire€mortgage€œthereon,€and€the€ordered€payment€in€the€natureÏof€alimony€would€render€the€total€alimony€award€excessive.›Ìà àœThere€is€a€paucity›€of€authority€on€the€issue€of€œanyÏincrease€in€the›€cost€of€living€impact€on€alimony€awards.€€InÏœòòParker€v.€Parkeróó,›€œ497€S.W.2d€572€(Tenn.€1973),€the›€œChancellorÏhad›€set€child€support€at€$225.00€a€month,€with€an€increase€everyÍJuly€of€$3.75.€€This€increase€was€to€reflect€the€cost€of€living.€ÏThe€Supreme€Court€rejected€the€cost€of€living€increases,€saying:ÌÓÓà0 àà0 àSince€the€court€under€the€express€authority€of€SectionÏ36„820,€T.C.A.,€may€increase€or€decrease€the€allowanceÏon€cause€being€shown,€the€annual€increases€provided€inÏthe€decree€should€not€now€be€ordered.€€The€courtÏcannot€at€this€time€know€or€with€accuracy€predictÏwhether€the€cost€of€living€will€increase€or€the€amountÏof€increase€that€may€œoccur.›ÌÌÓÓà
